An ordinance providing fob the paving, curbing, guttering and excavat-
ing of Ninth street, in the city of Salina between the north line
of South street and the south side of the tracks of the Union
Pacific Railroad where the same crosses said Ninth street, s eci-
f ing the manner of construction and providing for the cost hereof
and the manner of payment. t
Whereas, by resolution duly adopted on the 17th day of April, 1911, ti
the mayor and council of the city of 'Salina, Kansas, have declared that
they deem it necessary to pave, curb, gutter and excavate Ninth street
in said city between the north line of South street and the south side'of
the tracks of the Union Pacific Railroad where the same crosses said
Ninth street; and,
Whereas, said resolution was published for ten (10) consecutive
days in the "Salina Evening Journal," a daily newspaper published in the
city of Salina; and,
Whereas, a majority of the resident owners of.property liable to
assessment and taxation for the cost of such paving, curbing, guttering
and excavating of said street did not, within twenty (20) days frgt the
last publication of such resolution., file with the city clerk of said
city their protest against such improvements or the making thereof; .
therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That it is necessary and hereby ordered that Ninth
street, in the city of Salina, Kansas, between the north line of South
street and the south side of the tracks of the main line of the Union
Pacific railroad where
the same
crosses said Ninth street,
be paved,
with such material as
the mayor
and council may hereafter
designate and
select, as hereinafter provided, said paving to be thirty-two (32) feet
in width from gutter to gutter between the north side of South street
and the south side of State street, and from the south side of State
street totthe main line track of the Union Pacific Railroad where the
same crosses said. Ninth street such paving shall be forty-three (43)
feet in width from gutter to gutter, except that at the intersections
of streets and alleys such pavement shall extend to the lot lines of the
intersecting streets; Provided, that kt the intersections of said Ninth
street with Walnut street, Iron avenue and Ash street shall not be
curbed and guttered

Sec. 2. That it is necessary and hereby ordered that Ninth street,
between the limits defined in section one hereof, be curbed and guttered
on both sides thereof with cement curbing and guttering, according to
the specifications hereinafter provided for, the curb part of the same
to be six inches in thickness and the gutter part thereof to be thirty
inches, more or less, from the back edge of such curb to the street, and
the face of such curbing, between the north side of South street and the
south side of State street, shall be set eighteen feet from and parallel
with the center line of said Ninth street, and between the north side of
State street and the main line track of the Union Pacific railroad such
curbing shall be set twenty-three and one-half feet from and parallel
with the center of said Ninth street; Provided, that at the intersections
of streets and alleys such curb and gutter shall return to the lot line,
of said street.
Sec. 3. That all excavating, filling and rolling necessary for the
proper construction of said paving, curbing and guttering shall be done,
and the work and improvements herein provided for shall be done and con-
structed according to the established grade of said Ninth street as es-
tablished by the ordinances of said. city.
Sec. 4. That the plans and specifications of the city engineer,
now on file with the city clerk, for the paving of said street with the
different kinds of street p aving,to-wit: brick block asphaltic -concrete
.ted_ na.'d for the curbing, guttering and, excavating of said
street, are hereby adopted and approved, and all of the work and improve-.
mems herein provided for shall be done in accordance with the plans
and specifications of and for the kind of paving to' be selected by the
mayor and council, as hereinafter provided„ and with the plans and
specifications for such curbing and guttering aforesaid, which such
plans and specifications for the paving to be selected as of oresaid and . .
for such curbing and guttering are hereby incorporated in and made a
part of this ordinance, and the work herein provided for shall be done
under the direction of the city engineer of said city.
Sec. 5. After the passage and publication of this ordinance, the
city clerk shall advertise for bids for the paving, curbing, guttering
and excavating herein provided for, in the official city paper, for
not exceeding_"days, and such advertisiement shall call for bids
for all of the kinds of paving specified in said plans and specifica-
tions of the city engineer aforesaid, and after the reception of such
bids the mayor and council shall determine the kind of paving to be used
on said street, and may and are hereby authorized to let the contract
for the paving of said street with the material so selected, and for the
curhing, guttering and excavating of said street, to the most satisfac-
tory bidder, as determined by the said mayor and council, the said
mayor and council reserving the right to to let the contract for the
curbing and guttering separately from the paving and excavating or for
all such work together, and to reject any an bids

Sec. 6. After the passage of this ordinance, the mayor the coun-
e disinterested householders, who,
c1 shall appoint thre
after having taken an oath to faithfully and impatially appraise all
and assessment
lots and pieces of ground liable to taxation for the improvements herein
provided for;,,, shall, within ten days after having been notified of their
appointment, proceed.to appraise said.lots and pieces of ground liable
to taxation for such improvements, without regard to any buildings or
improvements thereon, and after making said appraisement shall return the
same to the mayor and council at the first meeting thereof after such
appraisement shall have been completed, and after said appraisement is
returned to the mayor and council the said mayor and council shall des-
ignate a time for holding a special session fir the purpose of he
complaints and equalizing said appraisement, of which special session.
due notice shall be given in the official city paper, and at said spec-
ial session the mayor and council shall, if they deem it just and proper,
alter or change such appraisement.
Sec. 7. For the purpose of paying for the work and improvement in
this ordinance provided for, the mayor and council are hereby author-
ied and directed to issue bonds of the city of Salina, in an amount not
to exceed the contract price of such work and improvement, and to run
for a period of ten years and be payable in ten (10) equal annual in-
stallments, together with interest not to exceed five (5) per cent.
per annum, which bonds shall be made payable at the fiscal agency of
the State of Kansas; and for the purpose of paying principal and inter-
est on said bonds as they severally become due the mayor and council
shall each year during the life of said bonds levy an assessment against
the lots and pieces of ground liable to taxation for the improvement
herein provided for in an amount sufficient to pay the principal and
interest for that year; Provided, that for the purpose of paying the
cost of curbing, paving, guttering and otherwise improving the squares
formed by the crossing of streets, for which the city would be liable,
the assessments shall be made against all the taxable property of the
city; and the city clerk shall certify such assessments as they are
severally
made, to the county clerk
of Saline county,
Kansas, at the
same time
and in the same manner as
other city taxes
are certified, and
the said assessments shall be liable to the same penalties and rebates
as other city taxes.
Sec. 8. This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal.
