. upon the conditions herein named.
Be it ordained by the Mayor and Counoilmon.of the City of Salina:
Section le That that part or portion of the alley lying
between Santa Be Avenue and Fifth Street north of Elm Street which
extends from the north line of said Elm Street to the north line of
Lot lo.35 on Santa Be avenue and Vot NO,36 on Fifth Street, be and
the same Is hereby vacated, annulle4 and discontinued as a public
alley in the city of Salina,, Zansas; Provided, however, that the
vacation of such portion of.such alloy above described is upon the
express condition that the owner or owners of said Lot No.35 on Santa
Fe Avenue and Lot Noi, 36 OnL.Pifth Street, in said city,, shall Is -
mediately establish and continuously maintain for the uses and pur•
poses of a public alley for said city, an alley or fifteen
(15) toot In width across said lots east and west connecting Santa Be
Avenue and Fifth Street, and., provided further, that the vaoqtlon of
the alley heroin provided .for shall not in any manner Interfere with
the maintenance and operation of.any telegraph, telephone and elotric
light'poles and wires now located In and along stiah.alloy; and such
clty.of Salina hereby reserves an easement in and over such ground so
vacated for the purposes last hereinbefore set forth.
Boos 2. This ordinance shall take effect and be ,in force
from and.after Its publication 6noe in the Salina Evening Journal.
