Prescott Avenue, in the city of Salina, between Fourth Street and Ninth Street, specifying the manner of con- struction, providing for the cost thereof, the manner of pay- ment and letting the contract therefor. Whereas, there has Been presented to the Mayor and Council a petition signed by three-fourths of the resident pro- perty owners owning property fronting on Prescott.Avenue between Santa Fe Avenue and Ninth Street, asking that the Mayor and Council pave, curb and gutter said street between the limits 'herein mggm defined; and Whereas, there has been presented to the Mayorand Council a petition.signedby three-fourths of the resident pro- perty owners owning property fronting on Prescott Av6nue between Fourth Street and Santa Fe Avenue, asking that the Mayor and Council pave,, curb and gutter said street between the limits +herein,o,eeftned.; therefore'. Be it ordained by theMayorand Councilmen of the city of Salina.* Section 1. That it is necessary and hereby ordered that Prescott Avenue in the city of Salina between the west side of Fourth Street and the East side of Ninth Street be paved with asphaltic-conerete paving -material on a five inch concrete base, a & i dpating!-to bi-, 46ibt in width, from gutter to gutter, be., tween'Fourth Street and -Santa Fe: Avenue/ and* -R feet in width between Santa Fe Avenue and Highland.Avenue,and 10. A0 w 12 feet in width from gutter to gutter between Highland Avenue and Ninth -Street except n of streets and alleys such at the intersectio. Section 1- hereof be. curbed and guttered on both si des Vlwreof - vwitb cemet concrete pavement on a five inch concrete base, and for the excavating of said street, at and for the follo�, ing proces, to -wit: for excavating, thirty-three (33) cents per cubic yard of dict actually removed from said street, for paving said street One Dollar and Seventy-five Gents 01.75} per square yard for the number of square yards of paving and base Laid upon saidstreet ; and a contract is hereby let for the curbing and guttering of said street to L.H.1yon, of Salina, Kansas, at the.price of Seventy-seven (774 Cents sad per lineal foot cu bing and guttering actually laid, said street; measure- ment thereof to be made as in said specifications provid*d� and it is hereby determined that t1he prices herein contracted for the paving, curbing, guttering and excavating of said street, as aforesaid, are within the estimated price or c;;* of said work and improvement as made by the City Engineer of Salina, which estimates of such price and cost ale now can file with the City Clerk. Sec. 6. After the passage of this ordinance, the Mor and Council shall appoint three disint rested householders, ay who, after having taken an oath to faithk\ lly'and impartially appraise all lots and pieces of ground lia�le to taxation for the improvements herein provided for, shall, wi�hin ten days after having been notified of their appointment proceed to appraise said lots and pieces of .ground liable to taxaiion, without re- gard to any buildings or improvements tln*neon, ':end after making said appraisement shall -return the same to\ they ror and Council at the first meeting thereof after -such app)�aisement shall have been completed and after said appraisement ireturned to t Mayor and Council, the said Mayor and Council;,shall designate a time for holding a special seesioh for the P4pose of hear- ing complaints and equalizing said :apPsisement�` of which ' f special session due notice shall be, Bien in 4 official- city ' paper., and at said special session the Mayor a d Council shall, if they deem it just and proper, alter or change such appraise- ment. i- Sec.7. For the purpose of paying for the work and im- provements in this -ordinance provided for, the Mayor and Council are hereby authorized and directed to issue bonds of the city of Salina, in an amount not to exceed thecon.tract price of such work. and improvement and to run fora period of ten years and be payable in ten (10) equal annual installments, t-ogether with interest not to exceed Five t5) per cent per annum, which bonds shall be made payable to the Fiscal Agency of the State of Kansaq and for the purpose of paying principal and interest on said bond as they severally become dde, she Mayor and Council shall each year, during the life of said bonds, levy an assessment against the lots and pieces of ground liable to taxation for the improve- ments herein provided for in an amount sufficient to pay the principal and interest for that year: Provided, That for the purpose of defraying the test of the curbing, guttering and othev, wise improving the squares formed by the crossing of streets, for which the city would be liable, the assessments shall be made aginst all taxable property of the city; and the City Clerk shall certify such assessments, as they are severally made to the County Clerk of Saline County, Kansas, at the same tine and in the same manner as other city taxes are certified, and the said assessments shall be liable t.o the same penalties and rebates as other city taxes.
