1593 Special Assessments(Published in the Salina Evening Journal January 1911)
ORDINANCE NO. 3,
An ordinance re -levying and re -assessing certain special assessments
heretofore levied and assessed under the provisions of Ordinance
No. 1580 of the city of Salina against certain lots and pieces of
ground in the city of Salina for the ppurpose of pa ing the cost of
paving, curbing and gutteri parts of South scree in said city,
and providing fox' the payment and colledtion of such assessments so
re -levied and re -assessed, amending sections one, eilit-and nine of
said Ordinance No. 1590, and repealing such sech1ons.so amended.
Whereas, under the provisions of Ordinance No. 1590 of the city of
Salina, passed and approved January 2, 1911, certain special assessments
were made and levied to pay the cost of paving, curbing and guttering
South street between Eleventh street north of said South street and
Tenth street south of South street, and Phillips street; and,
'Whereas, said assessments so made, levied and assessed have been
f ound'by the mayor and council to be irregular and should be re. -made,
re -levied and re -assessed; therefore,
Be it ordained by the Payor and Councilmen of the City of Salina:
Section 1. That�the assessments heretofore made, levied and as-
sessed.by Ordinance No. 1590 of the city of Salina, for paying the cost
of paving, curbing and guttering South street between the limits last
hereinbefore defined shall be- re -made, re -levied and re -assessed in the
manner and in the amounts hereinafter specified.
Sec. 2. That section 1 of Ordinance No. 1590 be amended so as to
read as follows: "Section 1. That for the purpose of paying the cost
of paving, curbing and guttering.South street, in.the.city of Salina,
Kansas, between the blocks thereof bounded by the west side of Fourth
re and the east side of Fifth street; the west side of Fifth street
e east side of Santa Fe avenue; the west side of Santa Fe avenue
and the east side of Seventh street; the west side of Seventh street and

side of Eighth street
and the
east side of
Ninth street; the
west
side
of Ninth street to the
east side
of Eleventh street on the north of said South street and to the east side
of Tenth street where the same intersects said South street on the south
from the west side of Eleventh street and the east side of Baker street
on the north side of South street and from the west side of Tenth street
and the, east side of Twelfth street on the south side of said South street
from the west side of Baker street on the north and the west side of
Twelfth street on the south of said South street, and the east side of
Phillips street, and from the west side of Phillips street to the east
side of College avenue, therd are hereby levied and assessed for eaeh
such block separately, on the property liable therefor, being all the
lots and pieces of ground lying on either side of said South street to
the center of the block on either side thereof, according to the appraised
value of such lots and pieces of ground without regard to the buildings
or improvements thereon, special assessments covering the cost of such
work and improvements; said special assessments being based on the
special valuations and appraisement of said lots and pieces of ground
heretofore made by three disinterested appraisers appointed by the mayor
and council, which said appraisement is hereby refereed to and made a
part of this ordinance; and the several amounts levied, apportioned and
assessed against each of daid lots and pieces of ground, according to
the benefits as based upon such appraisement and valuation to be derived
by reason of the paving, curbing and guttering of said South street, be-
tween the limits hereinbefore defined, are described and designated as
follows, to -wit:'/
'Sec. 3. That section 8 of said Ordinance No. 1590 be amended so as
to read as follows: 'Sec. 8. For paving, curbing and guttering South
street between Eleventh street and Baker street on the north side of said
South street and Tenth street and Twelfth street on the south side of
said South street:

.Sec. 5. Said amounts re -levied, re -apportioned and reassessed as
aforesaid shall be due and collectible in ten equal annual installments,
the first installment becoming due in the year 1911 and one of 'said in-
stallments falling due each and every year thereafter until all are paid
as in this ordinance provided; Provided, that the owner of any piece of
property liable for any such special assessments may redeem his property
from any such liability by paying
into
the city
treasury the entire amount
chargeable against the same as in
this
ordinance
specified at any time
Within thirty (30) days after the publication of this ordinance and
before the issuance of the bonds of said city, and his property so paid
on shall not thereafter be liable for the cost of said improvement, nor
for any part of the said bonds.
Sec. 6. There is hereby further levied and assessed against each
lot and piece of ground described in sections three and four of this
ordinance five (5) per cent interest.per annum on all of said installmentg
therein mentioned, from the date of the bonds to the time of the collec-
tion of each of said installments, as provided by law, which shall be
collected annually at the same time and in the same.manner as said in-
stallments, and after the taking effect of this ordinance, and after the
issuance of the bonds as herein provided, it shall be the duty of the
city clerk of said city to annually, atvthe same time other city taxes
are to be certified, and until all of said taxes and assessments herein
re -apportioned and re -levied have been certified, to certify to the
county clerk of Saline county, Kansas, a full list of all property
liable to taxation and assessment for said work and improvement, except
such property on which the special assessments aforesaid have been paid,
as herein provided,
together with
the respective
amounts
due on each of
said tracts, pieces
and parcels of
ground, which
amounts
shall include
the annual installments and the interest on the same on all ubpaid bal-
ances for one year at the rate of five per cent per annum as aforesaid;
and such amounts so certified shall be collected as other taxes and
assessments are collected.,

Sec. 7. That section , section whm and section nine of
Ordinance No. 1590 of the city of Salina be and each of them are hereby
repealed.
Sec. 8. This ordinance shall hake effect and be in force from and
after its publication once in the Salina Evening Journal.
