ORDINANCE NO.�d ®M
An ordinance providing for the paving and excavating of South street, in
the city of Salina, Kansas, between the east line of Fourth street
and the west line of College avenue, specifying the material to be
used, the manner of construction and providing for the payment of
the cost thereof and for the manner of such payment; and letting
the contract for such work and improvement.
Whereas, a petition signed by three-fourths of the resident prop-
erty owners fronting on South street bet -=seen the east line of Fourth
street and the west line of College avenue, has been presented to the
mayor and council, requesting said mayor and council to cause said Fourth
street, between the limits above set forth, to be paved; therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:---
Section 1. That it is necessary and hereby ordered that South
street, in the city of Salina, Kansas, between a point about fifty-o3be
feet
(51)Nast of the west line of Fourth stroet and the west line of College
avenue, be paved, with the material and in the ;canner hereinafter desig-
nated, said paving to be -'feet in width, from,gutter to gutter,
between said point about 51 feet east of the west line of Fourth street
and the east line of Eighth street, and twenty- (24) feet in width,
from gutter to gutter, between Highth street and College avenue, except
at the intersections of streets and alleys where such paving shall extend
from lot line to lot line.
Sec. 2• That the plans and specifications for the paving of such
South street, , with asphaltic -concrete
paving material, on a five (5) inch concrete base, made and prepared by
the city engineer of Salina and now on file with the city clerk, are
hereby adopted and approved as and for the plans and specifications for
the paving of such.ctreet, and are hereby specially referred to and made
a part of this ordinance in all respects as if the same were written out
in full herein, and all the work and improvement provided for in this
ordinance shall be done in accordance with and under such plans and spec-
ifications.

ment , proceed to appraise said lots and pieces of ground liable to taxa-
ation as aforesaid, without regard to any buildings or improvements
thereon, and after making said appraisement shall return the same to the
city council at the first meeting thereof after said appraisement shall
have been completed, and after said appraisement is returned to the city
council the mayor and council shall designate a time for holding a special
session for the purpose of hearing complaints and equaligingssaid'appraise -
ment, of which special session due notice shall be given in the official
city paper, and at said special session the mayor and council shall, if
they deem it just and proper, alter or change such appraisement.
Sec. 6. For the purpose of paying the cost of the work and improve-
ment herein provided for the mayor and council are hereby authorized to
issue bonds of the city of.Salina, in an amount not to exceedthe contract
price and cost of such work and improvement, and to run for a period of
ten (10) years, and be payable in ten (10) equal annual installments,
together with interest not to exceed five (5) per cent per annum, which
bonds shall be made payable at the fiscal agency of the State of Kansas;
and for the purpose of paying the princiapl and interest on said bonds,
as they severally become due, the mayor and council shall each year
during the life of said bonds levy an assessment against the lots and
pieces of ground liable to taxation for the improvement herein provided
for in an amount sufficient to pay the.princippl and interest for that
year; Provided, that for the purpose of defray ing the cost of paving the
squares and areas formedby the intereseotion of streets and alleys, as
well as where the improvement is through or adjacent to property of the
city, for kx which the city would be liable, the assessments shall be
made against all the taxable property of the city; and the city clerk
shall certify such assessments, as they are aeverally made, to the county
clerk of Saline county, Kansas, at the same time and in the same manner
as other city taxes are certified, to be collected as other taxes are
collected.
Sec. 7. This ordinance shall take effect and be in force from and
after its publeation once in the Salina Evening Journal.
