1564 Special Election Franchise1 (Published in the Salina, Evening Journal July , 1910.) ORDINANCE NO. An ordinance providing for the calling of a special election in the city of Salina, Kansas,for the purpose of submitting to the qualified electors of said city a proposition to approve or reject a certain proposed franchise granted by the mayor and.council of said city to Vhomas H. Smith, -his successors and assigns, on the 30th day of June, 1910. Whereasy'the mayor and council did, on the 30th day of June, 1910, pass and approve a certain ordinance,, numbered 1560, therein granting to Thomas H. Smith, his successors and assigns, for a period of twnety years, the right to manufacture,, distribute and sell electricity and gas for light, heat, power and other purposes in the city of Salina, and to use the public streets and alleys of said city for the erection of poles, wires and conduits therefor, and contracting with said Thomas H. Snaith, his successors and assigns, for the lighting of the streets and public grounds of said city; and repealing Ordinance No. 1218; and,, Whereas, within the time prescribed by section 749 of the general Statutes of Kansas, 1909, there has been filed with the mayor and council a petition, containing the names of thirty per cent of the qulif ied electors of said city,requesting the mayor and council to submit to the electors of said city, for their approval or rejection, said franchise ordinance No. 1560; therefore, Be it ordained by the Mayor and Councilmen of the city of Salina: .Section.l. That a special el_edtion be and the same is hereby called, to be held in the city of Salina, Kansas, on Tuesday, the Ind day of Augusta 19101, for the purpose of submitting to the electors of said city the proposition whether or not a cerkain proposed franchise granted by the mayor and council to Thomas H. Smith, his successord and assigns, by Ordinance No. 1560,, passed and approved June 30, 1910., shall be approved by said electors, said franchise ordinance No. 1560 being an ordinance entitledXX "an ordinance granting to Thomas H. Smith, his successors and assigns, the right to manufacture, distribute and sell electricity and gas for light, heat,, power and other purposes in'the city of Salina; to use and occupy the streets, alleys and public grounds of said city for the erection and maintenance of poles, wires -and conduits and for the laying of the mains and pipes therefor, and contracting with said Thomas Hs Smith, his successors and assigns, for'the lighting.of the streets, public buildings and grounds of said city, and repealing Ordinance No. 1218, passed and approved March 8, 1904." Sec. 2. Such special election shall be held at the voting places in the several wards of the city, between the hours of eight o'clock a. m. and sig o'clock p. m. on the said Aii7day of August, 1910, and such election shall be conducted in all respects as now provided by law for, bond elections in cities of the second class of the State of Kansas; Provided, that in case a majority of the electors of such city voting atvsuch election shall vote in favor of the approval of such franchise ordinance, such franchise shall be it of full force and effect and there« after be binding upon said city; but if a majority of the electors voting at such election shall vote against the approval of such franchise or- dinance then the same shall become null and void. Sec. 3. The manner of voting at such special election shall be by ballot, and the ballots used shall be in substantially the following f orm: To vote in favor of any question submitted upon this ballot, make a cross X) mark in the square after the word Yes; to vote against it, make .a similar mark in the square after the word No. SHALL THE FOLLOWING BE ADOPTED? Proposition to approve the proposed electric light and gas franchise granted to Thomas H. Smith,. his successors and nNO assigns, b Ordinance No. 1560, passed and approved by the Mayor and by of the city of Salina, June 30, 1910. On the back of each such ballot shall be primed, in addition to the endorsements prescribed for general city ballots, the words "Quer- tion submitted.." Sec. 4. The mayor is hereby authorized and directed togive notice of such special election by proclamation, stating therein the proposi- tion to be submitted to the electors voting at such special election and the time and place of holding such election, which proclamation shall be signed by the mayor and city clerk and shall be publihgd in the off ical city paper for � consecutive days, the first publication of which proclamation shall be made at least fifteen.days before the date of such special election as herein provided.
