I . 'Whereas, by resolutiion duly adopted on, the �DCday of 1909, the mayor and `council of the city of -Salina Nave declared that they deem it necessary to pave, curbAgutter Ash street in said city,, between the west side of Seventh street and the west side of College avenue; and, ereas, said resolution was published for ten (10) consecutive days in the "Salina Evening Journal," a daily newspaper published in the said city of Salina; and, 1hereas, a majority of the resident owners of` property liable to assessment and taxation for the. roost of 'each pavingi' curbing and gutter► ing of said street did not, within twenty days from such last publican tion, fine with the city clerk of said city their protest against such improvements. or the making thereof; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina.: Section I. That it is necessary and hereby ordered that Aeh'street, in the city of Salinas, between the gest side of Seventh -et 'eet and tho west side of College avenue, be paved, with such material as the mayor and council may hereafter designate and solact,, as herei4gter provided, said pavir to be, ort)�)f� in width froom titer 'to ' ttor. on that part of said street between the west 'sid 3w�enth street and the westvside of Ninth street, and to be in � ` , 3' feet lin width from gutter to gutter on that part of said street lying between Ninth, street and College avenues, except that at the intersections of streets - and alleys such,pavement shall be eighty feet in *3dth, or extend from lot lute to lot line. :Sec. 2. That it is necessary and hereby ordeted that said Ash street, between the limits defined in section one hereof, be curbed and guttered on both sides thereof, with cement curbing and guttering, according to the specifications hereinafter prouided f'or, the curb part of the same to be six (6) inches in thickness and the gutter part thereof to be thirty (30) inches, more or less, from the back edge of such curb to the street, and the lot line edge of such curbing shall be set, on that part of the feet street lying between Seventh and Ninth streets, twenty-four (24),from and parallel with the center line of said street east and west, and on that part of said street lying between Ninth street acid College avenue the lot line edge of such curbing shall be set nineteen and one-half (191) -feet from and parallel with the center line of said street aforesaid; Provided, That at the intersections of streets and alleys such curb and gutter shall return to the lot line of said street. Sec. 3. That all excavating, filling and rolling necessary for the proper construction of said paving, curbing and guttering be done, and such paving, curbing and guttering shall be done and constructed accord- ing to the established grade of said street, as heretofore and hereafter established by the ordinances of said city. Sec. 4. For the work and improvement herein provided for, the city engineer shall make and file with the city clerk, on or before the 12th day of march, 1910, plans and specifications for the paving of said st street with asphalt, asphaltic concrete and bitulithic sheet pavement, on five inch concrete and six inch macadam base, and for brick block pave- ment on five inch concrete base, with sand filler and with asphalt filler, and for the curbing and guttering of said street with cement curb and gutter of the dimensions, substantially, hereinbefore described; and within the time aforesaid, said city engineer shall file with said clerk detailed estimates of the cost of paving, curbing, guttering and excavating said street with the different kinds of material aforesaid. Sec. 5. That after such plans and specifications shall have been filed with the city clerk, as aforesaid, said clerk shall advertise for bids or proposals for the paving of said Ash street with the differ- ent kinds of street paving named and specified in the preceding section hereof,and for the curbing and guttering of__gaid street, said advertise- ment to.be published in the official eity paper for at least five issues, and said bids or proposals shall be filed with the said cl.erk'on or before the 21st day of March, 1910; and after the receipt of such bids or pro- posals the mayor and council shall select from the kinds of street paving so specified in section four hereof, and on which bids shall be received as aforesaid, the kind of paving to be used on said street, and may,4pd are hereby authorized, to let the contract for the paving of said street with the materil so selected, and for the curbing and guttering of said street, to the lowest,most satisfactory and responsible bidder, as de- termined by the said mayor and council, for the kind and character of paving which shall be determined upon by the said mayor and council, the said mayor and council reserving the right to let the contract for the paving and excavating separately, or all together, and to reject any and all bids or proposals. Sec. 6. After the passage of this ordinance, the mayor and council shall appoint three disinterested householders, who, after having taken an oath to faithfully and imV;ar4�1-a 1,; a praise._ 1 _ loth and pieces of,,,,,J ground liable to taxation for the improvements herein provided i'o'r shall, within ten (10) days afteir having been notified of their appoittment, proceed to appraise said lots and pieces of ground liable to taxation, without regard to any buildings or improvements thereon, and after making said appraisement'shala return the same to the mayor and council at the first meeting thereof after such appraisement shall have been completed, and after such appraisement is returned to the mayor and council the said .mayor and council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper, and at said special session the mayor and council shall, if they deem it just and properi'alter or change such appraisement. Sec, 7. For the purpose of paying for the work and improvements in this ordinance provided for, the mayor and council are hereby authorized and directed to issue bonds of the city of Salina, in an amount not to exceed the contract price of such work and improvement, and to run for 1 i ti period of ten (104 years and be payable in ten equal annual installments, together with interest not to exceed five •} per cent per annum,, which bonds shall be made payable at that Fiscal Agency of the State of Kansas; and for the purpose of paying rrincipal and interest on saiekbonds as they severally become duet1ne mayor and council shall each year, during the life Rg of said bon&,, levy an assessmentz against the lots and pieces of ground liable;_ to taxation for the improvements herein provided for in an amount suNicient to pay the principal and interest for that year. Provided, TAat for the purpose of defraying the cost of paving, curbing, gottex ing, excavating and otherwise improving the squares and areas formed by the intersections of streets and alleys as well as where the Improvement is through or adjacent to property of the city, for which the city would-be liable, the assessments shall be made against all the taxeb18 property of the city; and the city clerk shall certify such 3 assessments, as they are esverally made, to the county clerk of Saline county,, Kansas,at- the time and "n the ease manner as other city t es are cartifledp -pd the said assessments shall be liable to the `same penalties as other taxes, Sec, 8a 7his ordinance shall take effect and be inforce from and after its publication once in the Salina Evening Journal, Gassed and approved February 21, 1910a Attest: er 4
