An ordinance providing for the curbing and gutteri of South street, in
the city of Salina, Kansas, between Fourth street
and the west line of College avenue, in said city; specifying the
material to be used, the manner of construction and providing for
the payment of the cost thereof and for the manner. o such payment;
and letting the contract for such work and improvement.
Whereas, a petition, signed by three-fourths of the resident prop-
erty owners fronting upon. South street between Fourth
street and the west line of College avenue, has been presented to the
mayor and council, requesting said mayor and council to cause said South
street, between the limits above set forth, to be curbed and guttered on
both sides of said street; therefore,,
Be it ordained by the Mayor and Councilmen of the City of Salina: --
Section 1. That it is necessary and hereby ordered. that South.
street, in the city of Salina, Kansas, between line of Fourth
street, and the west line of College avenue, be curbed, on both sides
thereof, with cement curbing, and guttered on both sides thereof with
cement gutter, such.cur-bing and guttering to be made and constructed as
a combined curb and gutter, the curb part of the same to be six (6)
inches in thickness and the gutter.part thereof to be thirty (30) inches,
more or less. ^from the backed 'of such curbing to the outer edge of
such gutter, and such curbing . 'shall be set eighteen and one-half (18 1/2)
feet from and parallel with the lot line on either aide of said street
between said point about 51 feet east of the west line of Fourth street
and the east line of Ninth street, and --between Ninth street and College
avenue such curbing shall be set ft-fteen (15) feet from and parallel with
the center
line of said street as established
by the city
engineer,except

now on file with the city clerk of
said city, are hereby � �w
adopted and approved as and for the plans and specifications for the curb..
ing and guttering.of said street, and are hereby specially referred to
and made a part of this ordinance in all respects as if the same were
written out in full herein.,, and the work and improvement provided for in
this ordinance shall be done in accordance with and under such plans and
specifications.
Sec. 3. That all excavating, filling and rolling necessary for*the
proper construction of such curb and gutter shall be done.
Sec. 4. That a contract be and is hereby let and awarded to L. H._
Lyon, for the
curing and guttering of said South street, with the material and in the
manner and form provided for in'this ordinance and -said specifications, J
at and for the uniform prices of forty -two -(-42) cents per lineal foot
for the number of lineal feet of curbing and thirty -five -M) cents per
lineal foot for the lineal feet of guttering actually put in place,
engineer of said city, such pricesfor such curb and gutter being fair
and reasonable and being within the estimate of the cost per lineal foot
of such work and improvement made by the city engineer and now on file
with'the city clerk.
Sec. 5. Thdit after the passage of this ordinance the mayor and counr
cil shall appoint three disinterested householders, who, after having
taken an oath`to faithfully and impartially appraise all lots and pieces
of ground liable to taxation for the improvement provided for in this
ordinance, shall, within,ten (10) days after having been notified of
t#eir appoittment, proceed to appraise said lots and pieces of ground
liable to taxation as aforesaid, without regard to any buildings or im..
ppovements thereon, and after making said appraisement shall r9turn the
same to the city council at the first meeting thereof after after said
appraisement shall have been completed, and after said appraisement is
returned to the city coOncil the mayor and council shall designate a time
for holding a special session for the purpose of hearing complaints and
equalizing said appraisement, of which special session due notice shall
be given in the official city paper., and at said special session the
mayor. and council shall, if they deem it just and proper,; alter or change
such appraisement. }-M�

Sec. 6. For the purpose of paying the cost of the work and imK
provement herein provided for in installments instead of levying the
entire tax or special assessment for the same at one time, the mayor and
council are hereby authorized to issue improvement bonds of said city,
pgyable
in
installments of
equal amounts each
year,, none of which bonds
nor any
of
the installments
thereof shall run
longer than ten years nor
bear interest exceeding five (5) per cent per annum. Such bonds may be
oissued
to the
contractors
constructing such improvement
in payment
thereof;,
or the
mayor and
council may sell said bonds, at
not less than
their par valte,, and pay the proceeds thereof to the contractors, and
such bonds shall be of such denominations as the mayor and council may
deem proper; and for the purpose of paying principal and interest on
said bonds, as they severally become due, the mayor and council shall
each year during the life of said bonds levy an assessment against the
lots and pieces of ground
liable to taxation
for
the said
improvement
in an amount sufficient to
pay the principal
and
interest
for that year;
Provided, that for the purpose of paying the cost of curbingz and gut,.
tering the squares and areas formed by the crossing of streets and
illeys, for which the city would be liable, assessments shall be made
against all the taxable property of the city; and the city clerk shall
certify said assessments,, as they are severally made, to the county clerk
of Saline county, Kansas,, at the same time andin the same manner as other
city taxes are certified, and to be collected as other taxes are col.
lected.
Sec. 7. This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal.
