1553 Extend Fifth Street(Published in the Salina Evening Journal April %, 1910)• ORDINANCE N0. An ordinance opening and extending Fifth street, in the city -of Salina, Kansas, between Prescott avenue and Crawford avenue and providing for the payment to the persons entitled thereto of the damages caused thereby. T#ereas, under the provisions of Ordinance No. 6534, of the city of Salina, the mayor and council determined to condemn the real estate there. in described for the purpose of opening and extending Fifth street, sixty feet in width, between Prescott avenue and Crawford avenue,,,and for that purpose appointed three disinterested householders to appraise and assess the damage caused by the taking of such real estate for such purpose; and, Thereast such householders duly qualified as appraisers therein, and have assessed and determined such damages, in all respects as re- quired by law, and have made a report in writing to the mayor and council of their acts and doings under said Ordinance No. 1534, which said re- port, where not changed by the provisions hereof, is hereby approved and confirmed and made a part of this ordinancei and, Whereas, No appeal has been taken by any of the persons whose prop- erty is sought to be taken for the opening of said street from the de. termination and findings of said appraisers within the time prescribed by law, and, 'Whereas, Since the filing of said report of said householders, D. A. Van Trine has become tha.ownex_of the property to betaken ft for such street which was formerly owned by Niagara Haggart and 'William H. $er- rick, as shown by and described in said report, and that i. A. Pribble, C. M. Jam, IL MMMOOM and D. A. 'fan Trine have each and all relinquished in writing all damages so nx awarded to them for the property so -owned by them as aforesaid and tem . f or said street as of oreCad, said relinquishment being attached to said report and is hereby specially referred to and made a part of this ordinance. Now, therefore,, Be it ordained by the Mayor and Councilmen of the city of Salina: -- Section 1. That Fifth street, between Prescott avenue and Crawford avenue Ain the city of Salina, Xansas, be and it is hereby opened and extended as a public street in said city, and for such purpose and uses; there is hereby condemned and appropriated all of the following property, land and lots -lying within the following metes and bounds in said city,! to�witt Commencing at a point four hundred sixty (460) feet due east of the southeast corner of Lot No. Twenty-two (22) on Santa Fe avenue, Prescott•s addition to the city of Salina, running thence due north about one thousand ninety-eight and one-half (1,098 1/2) feet to the south line of Prescott avenue, thence east sixty (60) feet, thence south from said last named point about one thousand ninety-ei t and 1/2 (1,098 1/2) feet to the north line of Crawford avenue,A thence west along the said north line of Crawford avenue,,as y (6_0) feet to the place of beginning, bei piece iece of ground sixty (60),�b one thousands ninety-eight and 1/2 (10098 1/2) feet in size. Sec. 2. For the purpose of paying damages to W. C. Addison, Edith C. Duncan and P. G. Wakenhut, for the property taken from them for the opening of daid street,, as particularly described in said householders' report aforesaid, there is hereby appropriated to W. C. Addison $860.00, to P. G. Wakenhut $850.00 and to Edith C. Duncan $255.00, and that orders be drawn on the city treasurer for such amounts in favor of the persons named, and the city clerk shall pay said amounts to said persons'upon their filing in his office proper receipts for the sal, Seca 3. That the city engineer is hereby instruct4d to make the necessary measurements and survey and set the necessary stakes for the designation of said street so opened and created, and the street commis. sioner is hereby directed to clear such -� of any all buildings and fences or other obstructions that may be standing within the limits of said street as designated by the city engineer. Sec. 4. This ordinance shall take effect and be in force from and after its publication once in the Salina Evening Journal.
