Section 1. It shall be unlawful for any person, firm or corporation to run, use or drive, upon the public streets and • _ thoroughfares of the city of Salina, any carr*age, hacks cabs, coach, or vehicle of automobile, transfer wagon, express wagon, dray, or wagon any kind or description used for the carrying, conveying or transporta- tion of persons, passengers, baggage, &cods, wares or merchandise within said city for pay, without first having and procuring u license therefor, as in this ordinance provided; and it shall be unlawful for any person, firm or corporation to drive or use any omnibus or other vehicle in the transporjation of passengers to and from any hotel and railroad depot and station, or run the same over any established line or route of travel in the city, whether such omnibus or other vehicle be propelled by horse or other locomotive power and whether Pay is charged or not for riding in the same, without first having a permit therefor, as herein -provided; Provided, the.provisions of this ordinance shall not.apply to vehicles kept and used solely y { in the prosecution of the ordinary livery business,, or to mer8hants using their own wagons or vehicles for the delivery of goods sold by them in the ordinary course of their business in said city. Term of license. ec. 5. Driver to wear badge_. Articles left in vehicle. Sec. 11. Thenever any package or article of baggage,, or goods or merchandise of any kind shall be left by the owner in or on any licensed vehicle, or when such package or article shall be left in the custody of the driver or chauffeur of any such vehicle, such driver or chauffeur shall, upon the discovery of such package or article, forthwith deliver the same at police headquarters, unlessz such package or article shall be sooner delivered to the owner thereof. Misi� ngperaons. Sec. 13. No owner, driver or chauffeur of any licensed vehicle shall induce any person to employ him by either knowingly, wantonly or carelessly misinforming or misleading such person, either as to his identity or as to the time of the arrival'or departure of any railroad train, or the location of any railroad depot, office, station, hotel, public place or private residence within said city; and any of the provisions of this section shall be any person violating deemed guilty of a misdemeanor,and upon conviction fined in any su* not exceeding ten dollars. Vehicles running to fair grounds, etc. Sec. 14. The owner of any automobile, hack, wagon or other vehicle, or the chauffeur or driver thereof, carrying passengers for hire to or from Oakdale Park, the county fair grounds, any show grounds or other places near or adjacent to the cit of Salina, shall be r �t ay the same license tag, to-wit: y 4r�& v9 ,) the sum of $80.00 f ori i le,, and $20.00 for each cab, hack, wagon or other vp4,6i by horses, as is required to be paid under �din this ordinance fo or licensed vehicles of the same class, an y such person whop shall fail, decline or refuse to pay such license tax shall be ddemed guilty of a misdemeanor and upon conviction fined in any sum not exceeding one hundred dollars. No driver of any coach, cab, omnibus, wagon or other vehicle using the streets of the city of Salina shall enageg in racing, or drive faster than a moderate and ordinarybtrot while passing along or through any of the public streets or thoroughfares of the city, and all such vehicles shall keep to the right whale in motion passing along the streets of the city. All vehicles required to be licensed under this ordinance are hereby required to and shall,, when unemployed, stand at such stand or stands or place or places as may be designated, from time to time, by the city marshal of Salina, subject to the approval of the mayor and council,, and subject to the provisions of this ordinance, and the said city marshal is hereby au» thorized and required, subje roval of the mayor and council and of the provisions sed ce, to establish such hick a wagon and vehicle stands 9' Qa of licensed vehicles, by designating, as near as practica ;�"SSaces where any such licensed vehicles may stand, when unemployed, at the several railraod stations or depots, and upon the streets and elsewhere in said city, so as best to accommodate the public, and the said city marshal shall have the right, subject to the approval of the mayor and council, to change such stands or places where • such licensed vehicles may stand as the convenience of the public may require: Provided, That if any such licensed vehicle or vehicles shall stand, while unemployed, on any of the public streets of the city, such vehicle or vehicles shall stand parallel with the street on which such stand is taken, except at any of the depots in said city, and no two or *ore of such vehicles shall stand closer than fifty (50) feet in the clear to each other, except at the depots, as aforesaid,,, and no two or more of any such vehicles shall at y side on any side of any street of said city, except a t s aforesaid; Provided further, that after it 10 o'clock ' ii ` � �Y of such licensed vehicles may stand ter: -� _ closer than fifty feeO other on the same side of any street. Any (" owner,, d -river., chauff Gtr, or person in charge of any vehicle mentioned and designated in this section who shall fail or refuse to obey the �-- directions of the city marshal as to standing his vehicle at any place or places in said city, or who shall stand or place his vehicle, while unemployed, in any position other than parallel with the side of the street on which he so stands or places it„ except at depots, as afore. said, or shall stand it side by side or abreast of any other vehicle then properly and legally standing as close as practicable to the curb of any street, as aforesaid, except as aforesaid, or who shall stud en llicase his vehicle closer than a clear distance of fifty feet from anygehicle then properly and legally standing and being on the same side of any street, as aforesaid, and except at depots, as aforesaid, or who shall in any manner violate any of the provisions of this mtxm section, shall be deemed guilty of a misdemeanor and upon conviction thereof be fined in any sum not exceeding one hundred dollars for each offemse. eralty. Sec. 17. It shall be unlawful for any person to do any of the things hereinbefore prohibited, or to fail to do any of the things hereinbefore commanded to be done; and any person who shall drive, propel or run any of the vehicles named in this ordinance used for the carriage of passengers or goods or merchandise for pay without first procuring a license therefor, as in this ordinance provided, or who shall violate any of the provisions of this ordinance for which a penalty is not. hereinbefore prescribed, shall be deemed guilty of a misdemeanor and upon conviction thereof fined in any sum not exceeding one hundred dollars for each offens► Re e9 l,. ThatvOrdinance No. 880, passed and approved March Yo 30, 1895, Ordinance No. 898, passed and approved August 24, 1895, Or- dinance No. 1015, passed and approved September 18, 1899,, and section. 34 of Ordinance No. 635, passed and approved March 7, 1888, and all other ordinances and parts of ordinances in conflict with this ordi- nances are each and all of them hereby repealed. Take effect. Sec. 19. This ordinance shall take effect and be in force from and after its publication once in the Salina Evening Journal.
