An ordinance providing for the paving, curbing, guttering and excavating
of Tenth street, in the city of Salina, between Walnut and South
streets, specifying the manner of construction and providing for the
cost thereof and the manner of payment.
Whereas, by resolution duly adopted on the 17th day of January, 1910,
the mayor and council of the city of Salina have declared that A hey deem
it necessary to pave curb and gutter Tenth street in said city, between
the south side of Walnut street and the north side of South street; and,
Whereas, said resolution was published for ten (10) consecutive
days in the "Salina Evening Journal," a daily newspaper published in the
city of Salina; and,
Whereas, a majority of the resident owners of property liable to
assessment and taxation for the cost of such paving, curbing and gutter-
ing of said street did not, within twenty (20) days 'from the last publi-
cation of such xxtiaa resolution, file with the city clerk of said city
their protest against such improvements or the making thereof; therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina: --
Section 1. That it is necessary and hereby ordered that Tenth
street, in the city of .Saline, between the south side of Walnut street
and the north side of South street, be paved, with such material as the
mayor and council may hereafter designate and select, as hereinafter
provided, said paving to be ''ls i-_ 1feet in width from gutter
to gutter,except that at the inters zet#erns of streets and alleys such
pavement shall extend from lot line to lot, line.
See. 2. That itis necessary and hereby ordered that said Tenth
street, between the limits defined in section one hereof, be curbed and
guttered on both sides thereof with cement curbing and guttering, accord-
ing to the specifications hereinafter provided for, the curb part of the
same to be six (6) inches in thickness and the gutter part thereof to be

such curbing shall be
set

feet from and parallel with the center line of said street north and
south; Provided, That at the intersections of streets and alleys such
curb and gutter shall return to the lot line of said street.
See. 3. That all excavating, filling and rolling necessary for the
proper construction of said paving, curbing and guttering be done -;:.-and
such paving, curbing and guttering shall be constructed according to the
established grade of said street, as heretofore and hereafter established
by the ordinances of said city.
Sec. d• For the wor'c and improvement herein provided for, the city
engineer shall make and file with the city clerk, on or bsfore the 17 -

day of Larch, 1910, plans and specifications for the paving of said
street with asphalt asphaltic conereteland bitulithic sheet pavements, on
five inch concrete and six-inch macadam base, and for brick block pave-
ment on five inch concrete base, with sand filler and with asphalt filler,
and for the curbing and guttering of said street with cement curb and
gutter of the dimensions, substantially, hereinbefore described; and on
or before the 21st day of March, 1910, said city engineer shall file with
said clerk estimates of., the cost of _paving, curbing and guttering. --said
said street with the different kinds of material aforesaid.
Sec. 5. That after such plans and specifications shall have been
filed with the city clerk, as aforesaid, said clerk shall advertise .for
bids or proposals for the paving of said Tenth street with the different
kinds of street paving named and specified in the preceding section hereof,
and for the curbing and guttering of said street, said advertisement to
be published in the officin.1 city paper for at least four issues, and
said bids or proposals shall be filed with said clergy: on or before the
21et day of March, 1910; and after the receipt of such bids or.proposals
the mayor and council shall select from the kinds of street paving so
specified in section four hereof, and on which bids shall be received as
aforesaid, the kind of paving ro be used on said street, and may, and are
hereby authorized, to let the contract for the paving of said street with
the material so selected and for the curbing and gutterin of said street,
to the lowest, most satisfactory and responsible bidder, as determined by
the said mayor and council, for the kind and character of paving which
shall be determined upon by the said mayor and council, the said mayor and
council reserving the right to let the contract for tjae paving and excav-
ating separately, or all together, and to reject any and all bids.
Sec. 6. After the passage of this ordinance, the mayor and council
shall appoint three disinterested householders, who, after having taken
an oath to faithfully and impartially appraise all lots and pieces of
ground liable to taxation for the improvements herein provided for, shall,
within ten days after having been notified of their appointment, proceed
to4appraise said lots and pieces of ground liable to taxation, without
regard to any buildings or improvements thereon, and after making said
appraisement shall return the same to the mayor and council at the first
meeting thereof 'after such-appraisement shall have been completed, and
after said appraisement is returned to the mayor and council the said
mayor and council shall designate a time for holding a special session
for the purpose of hearing complaints and equalizing said appraisement,
of which special session due notice shall be given in the official city
paper, and at,said special session the mayor and council shall, if they
deem it just and proper, alter or change such appraisement.
Sec. 7• For the purpose of paying xxk for the work and improvements
in this ordinance provided for, the mayor and council are hereby author-
ized and directed to issue bohdo of the city of Salina, in an mount not
to exceed the eonjtract price of such work and improvement, and to run
for a period of ten years and be payable in ten (14) equal annual in-
stallments, together with interest not to exceed five (5) per cent per
annum, which bonds shall be made payable at the Fiscal® Agency of the State
of Kansas, and for the purpose of paying principal and interest on said
bonds as they severally bedome due the mayor and council shall each year,
during the life of said bonds, levy an assessment against the lots and
pieces of ground,liable to taxation for the improvements herein provided
for in an amount sufficient to. pay the principal and interest for that
year; Provided, That for the purpose of defraying the cost of IFS,
curbing, guttering and 5X4W9=X9 otherwise improving the squares
formed by the crossing of streets,. -for which the city would be liable,
the assessments shall be made against all the taxable property of the
city; and the city clerk shall certi_fy.such assessments, as they are sev-
erally made, to the county clerk of Saline county, Kansas, at the same
time and in the same manner as other city taxes are. certified, and the
said assessments shall be liable to the same penalties and rebates as other
city taxes.
Sec. 8. This ordinance shall take effect and be in force from and
