ORDINANCE NO. 1 ',
An ordinance providing for. the curbing andof both ides of
Claflin avenue,, in the city of Salina, Kansa.5 bet:�s rzp �S `fid Fc
avenue and Fourth street, specifying the _canner of construction,
providing for the cost thereof and the manner of payment, and letting
the contract therefor.
Whereas, a petition, signed by three-fqurths of the resident prop-
erty owners fronting on Claflin avenue •betty en^Santa..Fe avenue and Fourth
street, has been.:'presented to the Mayor and Council, requesting .the said
mayor.' and council to cause said Claflin'.Avenue, between the 'limits atove
defined, to, be curbed and, gutto'red on both. sides thereof with cement curb
and gutter; therefore,
-Be. it ordained by 'the Mayor' and Counailmen of the Cit; of . Salina: --
Se,ctiori 1. That it is necessary, and hereby. orderect that Claflin
'a venue. between- the. east side- of SantaFe airenue and the west side of
Fourth street, in the .city'of Salina, Kansas- be curbed on bath sides
thereof with cement curbing` and guttered on both sides thereof with se-
ment guttering, the curb to be six inches in thickness and the gutter to
be thirty inches, Tqore or less,, from"the back edge of such curb to.the
street, and the face 'edge of such 'curbing shall ' be set,' feet from
and parallel with the lot line on either side of said street.
Sec. 2. That the plans and ' specifications for such curbing and
guttering, made ,by the -city engineer and now on file with the city clerk,
are hereby adopted and approved as the plans and specifications for such
curbiing and 'guttering, and all the work herein and in such plans and speci-
fications provided'for shall be done in strict accordance with such
plans and specifications which are'hereby made a part of this ordinance.
See. .3., That after the: _passage of this ordinance the mayor and'
council shall p�prjoint three disinterested 'householders, who; after having
taken an' oath to faithfully.' and impart i€illy appraise all lot's and pieces of
ground liable to taxation for the payment of 'the cost. .of,•such 'wo:rk. and ,

and after raking said appraisemen't shall ret ur.n..the, same, to the 'city
council at, the, first m ,e -t ing . thereof Afte r such* appraisemnnt•. shall hate
been 'completed,. and .after said. appraisement `.is returned to the city
council the mayor and council shall designatea time for holding a
�.speciaal session for the purpose of hearing complaints and equalizing said
apprai,sement, of- which special session due notice shall`be given, in.the.
official city• paper, and at said special. session the' mayor and council
shall, if they, deem it. J)ast and proper, .alter or change such appra:isement .
Sec.-,. 4•... That a contract be and •.is - hereby let to L. H. L�ro,.n .for
the curbing and guttering provided forin. this ordinance, . at and ,for.. the
uniform price .of cents per lineal foot for- the .curbing and

are less than the estimate of the. same made by the city engineer for
said carbine `and gui tteriing and now on file with thecity clerk. Payment
for the owrk hereby let'by the said city of Salina on measurements .made
by the said city engineer. and the 'city shall pag for such fvork in cash,
or improvement 'bonds, as hereinafter specified' at. the. option' of the
said. city..
Pec. 5. Fo'r the purpose of , paying for said • curbing and guttering in
•.installments,, instead of levying the entire tax or .special assessment for
such cost at one time, the .mayor and 'council are hereby a zthorized to
issue improvement 'bonds of said city payable. in inst '1'1*nts 'of equal
amounts in each.•year, none of which bonds nor any of ,the installments
shall. run longer than ten years nor bear interest exceeding five. pe.r cent
per annum. Such bonds pay be issued t -o the contractor constructing such
improvements in payment thereof, nr the fmyor and council may sell said
bonds at not less than their par .value . and pay the -proceeds thereof to the
contractor, acid such bonds may be of .such denomination^a,s the, mayor and
council deem proper; and'for the purpose of paying:�principal and interest
