1539 Improve Santa Fe AvenueA", JY�rej P (Published in the Salina Evening Journal.� oxnixaxca No. - J 3 An ordinance providing for the paving and excavating of Santa Fe avenue, in the city of"Salina. between.the south side of Crawford avenue and the south side of Claflin avenue; specifying the manner of con- struction providing for the cost thereof and manner of payment,, and letting tie contract therefor.. Whereas, by resolution duly adopted and approved -on the 15th day of March, 1909, the mayor and council of the city of Salina declared that' they deemed it necessary to pave Santa Fe avenue, in said city, between the south side of Crawford avenue and the south side of Claflin avenue and, Whereas, said resolution was duly published for ten consecutive days in thePQSalina Evening Journal"' ¢ a daily newspaper printed in the city of Salina; and, Whereas, a majority of the resident owners of property liable to taxation for the cost of paving 0 144—street, within the limits defined, did not, within twenty days from the last publication of such resolution, file with the city clerk of said city their protest against such paving or the improvement of such street; therefore, Be it, ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Santa Re avenue, in the city of Salina, Kansas, between the south side of Craw ford avenue and the south side of Claflin avenue, be paved with Pitts bugh paving blocks, laid on a five inch concrete.* oncrete foundation, with -sand filler, fifty-six (56) feet in width sM from gutter to gutter, except at the intersections of streets and alleys where such pavement shall extend from lot line to lot line; Provided, That a strip eight (8) feet in width, down the entire lingth of said street.... at or near the center of the same, shall not be paved under this ordinance; and all as more de* - finitely and particularly described in the specifications for such paving now,,on file with the city clerk. Sec. 2. all excavating, filling and rolling necessary for the proper construction of such paving shall be done. Sec. 3. That the plans and specifications of the city engineer for the paving of such street, now on file with the city clerk, are here- by adopted and approved as and for the plans and specifications for such paving, and all the work herein and in such plans and specifications provided for shall be done in accordance therewith, which plans and speci- fications are hereby incorporated in and made a part of this ordinance; and all the work herein and therein provided for shall be done under the direction of the city engineer or his duly authorized assistant. Sec. 4. That such paving shall be constructed and laid according to the established grade of such street, as heretofore or may hereafter be established by the ordinances of said city. Sec. 5. That a contract be and is hereby let to John Ritchie, of Topeka, Kansas, for the paving and oxcavatif9of said Santa Fe avenue, at and for the following prices, viz: for brick block paving, furnished and laid in }lace, with vitrified Pittsbugh paving blocks, laid on a five inch concrete foundation, with send filler, as specified in said speci- fications, one dollar and seventy-five cents ($1.75) per square yard for the square yards of brick block paving actually laid on said street, for all necessary excavating on said street, as specified, thirty-three (33) cents per cubic yard, and for oak headers furnished and put in place on either side of said eight foot strip, as specified, seven and one-half (72) cents per lineal foot, which prices so agreed to be paid herein are hereby found to be fair and reasonable and do not exceed the price of sural viork and improvement as shown by the estimate of the city engineer hereto- for made by him and submitted to the mayor and council. Payment for such work shall be made on measurements of the city engineer, and said city shall pay for such work in cash or in improvement bonds, as hereinafter provided and described, at the option of the mayor and council. Sec. 6. That after tha passage of this ordinance the mayor and council shall appoint three disinterested householders, who, after having taken an oath to faithfully and impartially appraise all lots addpieces of ground liable to taxation, without regard to any buildings or improvements thereon,and after making said appraisement shall return the sgme to the city council at the first meeting thereof after such appraisement shall have been completed, and after said appraise- ment is returned to the city council the mayor and council shall desig- nate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which spedial session due notice shall be given in the official city paper, and at said special session the mayor and council shall, if they deem it just and proper, alter or change such appraisement. Sec. 7. For the purpose of paying for such paving in installments, instead of levying the entire tau or spedial assessment for such cost at one time, the mayor and council are hereby authroized to issue improve ment bonds of said city, payable in installments of equal amounts each year, none of which bonds nor any of the installments thereof shall run longer than ten years nor bear interest'esceeding five per cent per annum. Such bond may be issued to the contractor constructing such im. provement in payment thereof, or the mayor and council may sell said bonds at not less than their par value and pay the proceeds thereof to the contractor, and such bonds shall be of such denomination as the mayor and council may deem proper. And for the purpose of paying prin- cipal and interest on said bonds, as they severally become due, the mayor and'council shall each'year during the life of said bonds levy an assess- . .: ment against the lots and pieces of ground liable to taxation for the im provement in an amount sufficient to pay the principal and interest for that year; Provided, that for the purpose of paying the cost of paving and excavating the squares and areas formed by the crossing of streets and alleys, for which the city would be liable the assessments shall be made against all the taxable property of the city; and the city clerk shall certify said assessments, as they are severally made, to the county clerk of Saline county, Kansas, at the same time and in the same manner as other city taxes are certified, to be collected as other taxes are collected_.
