1521 Automobiles:ORDINANCE N'0. 1521. An ordinance regulating the propelling and running of automobiles in the city of Salina, requiring,the registration thereof and the payment of a registration fee, providing a penalty for violations hereof, and repealing Ordinance No -.12431 and all ordinances and parts of ordinances in.conflict with this ordinance., Be it ordained by the Mayor and Councilmen of the City of Salina: --- Section 1. On, axed after the first day of November., 1909, it shall be unlawful for any person to propel.or run, or case to be propelled or run, any automobile .on the thoroughfares or highways, or in the.parks, of the city of Salina without first registering the name of the owner, keeper or person in control, thereof, the.: name of the maker and the man- ufacturer's -number and the horse power hof said automobile with the city clerk of said city; and for.that puprose; the.city.clerk shall keep a suitable book or record and shall register therein, by number, in the order in which such registration is made, the name of the owner, keeper or person in control of��said automobile, the name of the maker thereof, the manufacturer's number and horse ,power thereof, and he shall furnish to the person or persons se registering any automobile a certificate which shall show, among other things, the registration number of any such automobile.. Thee fee to be paid such city clerk for the registration of any aut.om'obile hereunder shall be $P.00, and for such fee the said clerk shall furnish to the person so registering his'automobile-hereunder a number plate with the number or numbers thereon corresponding with the number or numbers shown in such personAs registration sertificate, and which number or numbers shall be separate Arabic numerals not less than preceding such' number, three inches in,height, and Hca tsa c:, and an a part of such number plate, the Word Salina shall be attached, and such number plate shall be con- spicuously on- spicuously displayed upon the rear of the automobile for which the same .is issued by said clerk as aforesaid. Sec. 2• The registration -certificate hereinbefore provided for shall 'be good -•,for a period of one year from the date thereof, after which time it shall, no longer be .of force, :rand a new registration. of said automobile shall.be required; and if at any time prior .to the expiration of one year.the.ownership or control of any automobile shall pass to another party, then and in that case said registration certificate shall no longer be in force,:but it shall be necessary`io.register said auto- mobile, again,; Provided, however,. that , in . all cases where any owner, keeper or person in control ' ­'of any automobile re -registers his vehicle under the provisions of. -.this ordinance and retains, his original number and number plate he shall be: required to pay a fear, of $1.00 only. for such .re-regis- t rat ion • Sec • 3. Each dealer in automobiles doing business in this city shall register one vehicle of each class dealt in `by :him, and if a number plate corresponding to the number of •the .registration of such dealer is dis- played upon every automobile -of the class for which it was issued while 'such automobile .is :being 'operated by such dealer, or his agent or repre- enstative, in said city, it shall be deemed a sufficient compliance with section one of the provisions ofAthis ordinance until such automobile -shall be sold; Pro- vided, that electrically:driven automobiles shall constitute a class under an this, section, sand those propelled by explosive type of engine a class, and those propelled.by.steam another class; and provided, further,. that no .such dealer shall be permitted to use such registration'number'on.more than three automobiles of any one class during the year for which his cer- tificate of registration may be in force; and provided further, that nothing in this section shall.be construg(ed to exempt any automobile of any dealer in said city used in the livery or hack business from being regis- tered and the owner..thereof..paying the.registration fee thereon, as in this ordinance provided. Sec. 4..No automobile shall be used 'or operated.upon-the public high- ways or in the parks of.said city after this ordinance shall take effect which shall display thereon a number belonging to any 'other automobile or vehicle or fictitious registration number. See - .5 • The provisions of .this ordinance with reference to regis- tration of automobiles shall not apply to automobiles owned by non-. residents of the city of Salina,:'or to automobiles driven into this city and upon the public streets and inthe parks of said city. where .the owner or owners thereof have eomplied.with.any law or ordinance requiring the registration of automobiles, or .the name or: names of the owner or owners thereof, in force.in.the state or. city of the.residence of such ovmer, provided the registration number shoving the initial or xamax abbreviation of the name or the name of.ouch state or city shall be dis- played on such'automobil`e substantially as in section one of this ordi- nance.provided;. Provided, however, that any non-resident owner of any automobile not ha*ing his automobile registered under any law or ordinance of any city or state of. his residence,and having his registration number dtspl.syed 'on his 'autonobile as hereinbefore provided, who shall run, his said automobile upon aany of 'the.thoroughfares of this city for. a longer period of time that three days shall have such automobile registered as in this ordinance provided; Provided :further,that nothing' in this section tion construced so as'to exempt non --resident owners or drivers of automobiles from complying with the provisions of this ordinance requiring the carrying of lighted lamps.and with,comp lying with all sections of this ordinance subsequent.hereto. See. 6• The following rates of speed may be ,maintained,. but shall not be exceeded, upon any public'highway-or in any park in the city of Salina by any one driving an automobile or motor cycle: (a) A speed of six .(6) .miles 'per hdur when turning. a corner of intersecting streets or cross-roads. (b):A speed.of eight (8.) miles an hour upon Santa Fe avenue between Elm,and Wsalnut streets, upon Fifth street between Ash and Walnut streets, upon Seventh street between Walnut and Ash :streets, and upon Iron avenue and Ash street between Fifth street and Eighth street._ (e) ..Elsewhere and except as above provided,'a speed 'of twelve (12) miles per hour; Provided, however, that nothing in this section con- tained shall.pe'rinit any person to'drive or run an automobile in said city at a -greater rate of spe,ed'that is reasonable, having regard to the traffic, use of highway and parks',or so as to endanger the life or:limb, or injure . the property of'any person. And provided, further, that the rates of speed hereinbefore provided shall.not apply to any officer or member of police force or.fire department while operating an.automobile in the discharge of his official duty. Sec. Any person propelling or .running any automobile in.the city of S ling, or in any of the parks in said city, shall give iarning of the approach of such automobile when danger or, accident: is imminent to persons, animals or vehicles, by sounding his whistle, bell, horn or. gong; such person shall also decrease the speed of such zutomobile, or stop the same if necessary when any animal shows signs of becoming. frightened, or when the rider or driver.of such animal.requests or signals such person to stop or decrease the speed of such automobile; rand such person shall, between the hours of sunset and.sunrise, carry on such automobile at least two lighted,lamps showing white lights, visible at least two hundred feet in the direction toward which such automobile is proceeding, and' sha-11 also exhibit at least one lantern or lamp visible in'the reverse direction showing a colored light to the rear,ftnd a white light so placed that.the number of his automobile may be clearly read and shown by such light. See. • Upon approaching a person walking along or upon a;. public highway or in any park, or a horse or horses or other draft- animal being ridden, led or driven thereon, the operator.of 4"utomobile or. motor cycle shall give reasonable warning of his approach, and use every, reasonable precaution to avoid injuring such person 'or frightening'such horse, horses or other draft animals, and .in case of injury to a person or property on the public highway or in the parks, due.to the presence or operation of any automobile or'motor cycle, the operator of such vehicle shall stop, and upon request of a person injured or any person present, give his name and address, and the name and address of xxz the owner of such automobile or.motor cycle. Sec. �. Any and all persons using the public streets and thor- oughfares of the city of Salina, whether with automobiles, motor cycles, bicycles or with vehicles drawn by horse or horses, shall in doing.so observe the recognized rules of thB road, which rules are hereby made a part of this ordinance, and are as follows: (1) Keep .to .tree right when overtaken bya a vehicle going in the same direction. (2) Keep to the left when about to -pass another vehicle going in the same direction. (3) Pass to the right, when meeting a vehicle.moving in the opposite direc- tion. (4) Alawys have consideration for the equal rights of others. ;21x*xxmxftme (5) In all cases, where the ignorance of others using the highway may seem to be about to cause an accident, in which you may be personally involved, stop your own machine or vehicle. (6) In :turning xm to the right at street intersections always keep close to the curb on the: right. --hand side; in turning to the left at street 'intersections cross the street upon which you are about; to change your direction until near the curb, then turn to the left. In both cases have your machine or your horses under perfect control. Sec lit. It. shall be unlawful for any person to do any of the things hereinbefore prohibited, or to fail to do any of the things here- inbefore commaneded to be done., and any person violating any of the pro- visions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof fined in any sura, not les -s;.. than five dollars nor iaore than fifty dollars for each offense . c Sec. ��• Ordinance No. 1243, entitled"an ordinance regulating the propelling and running of automobiles in ,the city of. Salina," approved October 17, 1904, and all,,ordinances and parts of ordinances in conflict with this ordinance.are hereby repealed. ff Sec.
