1517 Sewer Improvements0 (Published in the Salina Evening Journal S4 N , 1909 ) ORD INANCE NO - 6LI An 0.- An ordinance providing for the construction .of certain sewers in the city of Salina, Kansas. Be it ordained by the Mayor and Councilmen of the City of .Salina: Section 1• That it is necessary and hereby ordered that the fol- lowing described sewers be .built and constructed in the city of Salina, Kansas, to -wit: (1) A twelve (12) inch lateral sewer commencing at the terminus of the present sewer on Prescott avenue south and east of the south end of Fifth street and from thence directly south to the center of the inter- 1, section of Fifth and Bond streets, thence gest to the center of Santa 41" Fe avenue, thence south to the center of Claflin avenue --a total length of about 6268 feet. (2) Ten "UO -inch stub sewers leading from the manholes to be located on the sewer described as number. one herein, on the streets and for the distances, as .follows: Wilson street, 60 feet; Republic avenue, 120 feet; Bond street, 60 feet; Beloit. avenue, 120 feet; Minneapolis avenue, 120 feet; Ellsworth avenue, 120 feet; Jewell avenue, 120 feet; Kirwin avenue, 120 feet• (3) A ten (10� inch sanitary 'and drainage sewer on Oakdale avenue, commencing at a point about 45 feet south of present manhole on Iron 4. avenue and Oakdale avenue, 'thence south on Oakdale avenue to line of alley between Gypsum avenue and Park Place, thence West on said alley for a distance of about 550 feet-; the total length of such sewer being 1290 feet., 0• (4) A ten x,10) inch lateral sewer in the alley between Seventh and r�o Eighth streets, commencing about feet south of the south line of Iron-avenurunning south ab'o feet.- (5) eet• (5) An eight inch sewer orn Well. i'laee,to commence at the end or present sewer about' ten .feet east ' of the east I Inc of Righth Street thence east riGh lateral sewer on College Avenue runnIng from 'Walnut Street tcs Southet* � 7Ate ,, rch sewer in alley between Seventh and Elghth Streets r=n g � . south from Elm Street about $OO feet* fications are hereby incorporated in and made a part of this ordinance in all respects as if the same were written out in full herein, and all the work herein and therein provided for shall be done in accordance with such plans and specifications, and under the direction of the city en- gineer of the city of Salina. Sec. 3• That, a ten the passage and publication of this ordinance, the city clerk shall advertise for 'bids for all the sewers herein and in such plans and specifications described, in the official city paper, 4l for such time and upon such conditions as the said mayor and council may designate, and the contract for the building and construction of such sewers a be let to the and most responsible bidder, as determined by the said mayor and council, the said mayor and council reserving the' right to reject any and all bids • Sec. 4. For the purpose of laying that part of the sewer designated as number one herein running from Prescott avenue to Crawford avenue, a right of way is hereby condemned therefor over and across the lots and lands lying between ,said Prescott avenue and Crawford avenue, with the condition, however, that the city of Salina shall leave such lots and land in as good condition as they were before the laying of such sewers. Sec. 5. The cost and expense' of constructing such sewers shall be - assessed against all lots and pieces of ground contained in the city of Salina as a sewer district, as provided by Ordinance No.. 613, passed and approved December 23, 1887, and the mayor and council are hereby authorized to provide for the payment of the cost thereof by installments instead Of levying the entire tax or special assessment at one time; and for such installments the mayor and council may issue improvement bonds of the city of Salina, payable in installments of egaal amounts each year, none of which bonds or any i,�stallment thereof sha.11.run longer than ten years or bear interest exceeding five per cent per annum. Such bonds may be issued to the contractor constructing such improvements in payment thereof, or the mayor and council may sell said bonds, at not less than their par value, and pay the proceeds thereof to the contractor, and such bonds shall.be of such denomination as the mayor and council may deem proper. And for the purpose of paying principal and interest on said bonds as they severally become due, the .mayor and council shall each year during the life of said bonds levy an assessment against all the real estate in the city of Salina in an amount sufficient to pay the principal and interest for that year; and the city clerk shall certify such assessments, as they are severally made, to the county clerk of Saline county, Kansas, at the same time and in the sane manner as other city taxes are certified, and said ,assesszments shall be liable to the same penalties as all other taxes.
