1516 Improve Santa Fe(Published in the Sarna Evening Journal September, 1909) i ORD IN.ANCE NO An ordinance providing for, the curbing and guttering of both sides of Santa Fe avenue, in the city of Salina, Kansas between the south side of Crawford avenue and the south side of haflin avenue; speci� Eying the manner of construct ion,' providing for the cost thereof and the manner of payment, and letting the contract therefor. Whereas, by resolution duly adopted and approved on the 15th day of March, 19099 the mayor and council declared that ,they deem it :necessary to pave and to curb and gutter. Santa Fe avenue, in said city, between the south side of Crawford avenue and the south side of Claflin avenue; and, 'Whereas, said resolution Jas duly published for t.en consecutive . days in the Salina Evening Journal,. as daily newspaper printed in the city of Salina; and, Whereas, a majority of the resident owners of property liable to taxation for the cost of .such paving and such curbing and guttering of said street, within the limits defined -,-did not, within twenty days from the last publication of such xsjdkx= resolution, file with the city clerk of said city their pretest against such paving or against such curbing and guttering of such street; and, Whereas, the said Mayor and.Council deem it necessary and for the best interests of said city that such Santa Fe avenue, iadthin the limits herein defined, be at this time curbed and guttered on both sides thereof, and that the paving thereof be. deferred until such time as the mayor and council shall determine to pave the same; therefore, Be it ordained by the Mayor and Councilmen of thecity of Salina: Section 1. That 'it is necessary and hereby ordered that Santa Fe avenue, in the city of Salina., Kansas, between the south .side of Craw- ford avenue and the souuh side of Claflin avenue, be curbed on both - aides thereof with cement curbing and guttered on both sides thereof with cement guttering, such curbing and guttering to be made and con- structed as a combined curb and gutter, the curb part of the same to be six (6) inches in thickness. and the gutter part thereof. to be thirty (30} inches,'more or less, from the -back edge of such curb to the street, and the46dge of such curbing shall be set_ 0feet from and parallel with the lot line on either side of said street, except at the intersections of streets and alleys where such curb and gutter shall return to the lot line of said street See. 2. That all exca*sting, filling and rolling necessary for the proper construction of such curbing and guttering shall be done. Sec. 3. That the plans, specifications and profiles of the city engineer now on file with the city clerk for the -curbing and guttering herein and,therein provided for are.hereby adopted and approved as and for the plans, specifications -and profiles for the curbing and guttering of such street, and all 'the_'.work herein and in such plans andspecifi- cations provided for shall be done in accordance with such plans and specifications., which are hereby_: `incorporated in and made a part of this ordinance, ; and all the work herein and therein provided for shall be done under the direction of the city engineer or his duly authorized assistant. See. 4. That after the .passage of this ordinance the mayor and council shall appoint three disinterested householders, who., after having taken an oath to faithfully and .impartially appraise all lots and pieces of ground liable to. taxation Por .the improvement herein provided for, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and.pieces.of. ground liable to taxation without regard to any buildings or improvements thereon, and after making paid appraisement shall return the same to the city council at the first meeting thereof, after such appraisement shall have been completed, and after said appraisement is returned to the city council the mayor and council shall -designate a time for holding a special xlw&t session for the purpose of hearing complaints and, equalising said appraisement, of Vd&Zc which apedial session due notice shall be given in the official city paper, and. at said special session the mayor and council shall, if they deem it just and.proper, alter or change such appraisement. Sec. 5. That a contract be and is hereby aet to L. K. Lyon and A. A Lyon, partners doing business under the name of-Lyon Bros-9 for the curbing and guttering ptovided for in this ordinance, at and for the uniform. price of forty (40) cents per lineal foot for the curbing and thirty'-two (32) cents per lineal foot for the-guttering, 'Pro- vided, that for curb built into the private driveway of any property owner along such street the price to such property owner shall not be more per foot than the, contract price stipulated herein to be paid by the city. Payment for the work hereby let by the said city of Salina shall be made on the measurements iaade by the city, engineer and the city shall pay for such work in cash -or in improvement bonds, as hereinafter P rovided and described, at,the option of the mayor and council. Sec. 6• For the purpose' of, paying for'said curbing and guttering in installments, instead of levying the entire tax or spec ial assessiaent for such cost at one time,tx the Yaayor and council are hereby authorized to issue improvement 'hands ofsaid city, payable in installments of equal amounts each year, none of which bonds nor any of the installments Nkl theredshall run longer than ten (144 years nor bear interest exceeding five (5) per, cent per annum. Such bonds may be issued to this contractors constructing such improvement in payment thereof, or the mayor and council may sell said bonds at„ not. less than their par value, and pay the pro- ceeds thereo.f to the' contractors, and such bonds shall be of such denom�- inations as the m4yor .and council may deems proper. And for the purpose of ;paying principal and interest on said bonds, as they severally become due, the mayor and council shall each year., during the life of said bonds, levy an assessment against the lots and pieces of ground liable to tax-. ation for the improvement, in an amount sufficient to pay the principal and interest for that year;. Provided, that for the purpose of paying the cost of curbing and guttering the squares and areas formed by the crossing of streets and alleys, for which the',city would be Liable, the assess: ments shall be made against all the taxable property of the city; and the city clerk.shall certify said assessments, as they are severally made, to the county cler'.c of Saline county,. Kansas, at the same time and in the same manner as other city taxes are certified, to' be colledted as other taxes are collected. Sec. 7.
