ORDINANCE NO.
An ordinance providing for the condemnation and appropriation of certain
real estate in the city of Saling,/ Kansas, for the purpose of open-
ing and extending Fifth street;, sixty feet in width, from Prescott
avenue to Crawford street, establishing a benefit district to pay
for the same, appointing appraisers therefor and prescribing their
duties.
Be it ordained by the Mayor and Ci@uncilmen of the city of Salina:--
Section
alina:--Section I. It is hereby declared necessary to condemn and appro-
priate for public use, for the purpose of opening and extending Fifth
street, in the city of. Salina, Kansas, sixty (60) feet in width, between
the south line of Prescott avenue and the north line of Crawford street,
all the land and pieces of ground in said city comprised and contained
within the following metes and bounds, to -wit: Commencing four hundred
sixty (460) fest due east from the southeast corner of Lot twenty-two
(22), on Santa Fe avenue in Prescott's addition; thence due north.to
intersect with the south line of Prescott avenue; thence east on said
south line.of Prescott avenue sixty (60) feet; thence due south from such
last named point to a point on the north line of Crawford street five
hundred twenty (520) feet east ofthe southeast corner of said Lot 22, on
Santa Fe avenue, in Preseott's addition, thence west sixty (60) feet to
the place of beginning.
See. 2• For the purpose of providing a fund to pay for the con-
demnation and appropriation of said land, as aforesaid, a benefit dis-
trict is hereby created and established, including all lots and pieces of
ground contained within the territory bounded by Prescott, avenue on the
north; the*right 'of way of the Salina & Southwestern railway (sometimes
called the McPherson branch of the Union Pacific Railroad company), on
the east; Crawford street on the south and Santa Fe avenue on the west,
excepting, of .course,.such land to be taken for the opening of said Fifth
street, as hereinbefore described.
Sec . 3 • That R. P. Cravens, John W. Titus and J. E.. Ridings, three
disinterested householders of the city of Salina, are hereby appointed and
confirmed as appraisers, who shall qualify and proceed as required by
law to give notice and assess the damages caused by the condemnation and
appropriation of said lands .for said street; they shall ascertain the
actual value of the lands-proposed,to be taken, without reference to the
projected irproveitent, and the actual damage done to all other property
thereby. For the payment of such value and damages.said appraisers or
householders shall assess the damages against the lots and pieces of
ground within such benefit district, which shall, in the opinion of said
appraisers, be especially benefitted by the opening of said street:, in
proportion to the benefits derived by each by the opening and extending of
said Fifth street as herein provided. The said appraisers shall report
tonthe mayor and council their proceedings in all things as provided by
law and shall, upon completion of their report, file the same with the
city clerk.
Sec. 4. This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal.
