An ordinance relating to apportioning and levying a special.assessment
on certain lots and pieces of ground in the city of Salina,
Kansas,. to'pay the cost of curbing and guttering both sides of
State street between Ninth street and College avenue, and re -
lacing to the collection thereof.
Be it ordained by the Mayor and Councilmen of the city of Salina: --
Section 1. That f,or the purpose of paying the cost of.curbing and
guttering both sides of State.street,.between Ninth.strest and College
avenue, in the city of Salina, Kansas, there is hereby leaied and assessed
q special assessments on all lots and pieces of ground liable therefor to
the center of the block.on either side of State street the distance im-
proved, according to the assessed value of said lots and pieces of ground
without regard to the buildings or improvements thereon, said special
assessment being based on the special valuation and appraisement of said
lots and pieces of ground heretofore made by three disinterested app..
-raisers appointed by the mayor and council of said city, and being com-
puted and made for each block separately, and the several assessment
blocks into which said State -street is hereby divided for the purpose of
making an equitable distribution of the cost of such curbing and gutter-
ing, and the several amounts levied, apportioned and assessed against
each of said lots and piece s of ground therefor according to the value of
said sots and pieces of ground and the benefits to be derived thereto by
reason of the curbing and guttering of said street, between the limits
hereinbefore defined, are described and designated as follows, to -wit:

Sec. 8. Said ameunts levied, apportioned and assessed

shall be due and collectible in four equal annual installments, the first
becoming due in the year 1909, and one of said installments falling due
each and every year, thereafter until .all .axe paid, .and .'all .to .be .collected
with interest as in this ordinance pr.ov.ide.d;..Provided,. That the .owner of
any piece of property liable for any .such special assessment .may. redeem
his property from such liabiiity by paying into the ci.ty.treasury the
entire amount chargeable against the same, as in this ordinance desig-
nated, at any time within .thirty (30). days after .the puhilcation ,of this
ordinance and before the 'issuance of the bonds of said city, and his
property so paid on shall. not thereafter be liable for any further as-
sessment for the cost of said improvements, nor for the said bonds.
Sec. 9.. That there is hereby further levied and assessed against
each lot and piece of ground described in sections two, three, four, five,
six and seven of this ordinance five (5) per cent interest per annum on
all of said installments therein mentioned, from the date of the bonds
until
the collection of each of said

the special assessments aforesaid have been paid in full, as herein pro-
vided, together with the respective' amount's: due' on, each; of' said' tracts, .

bear at the rate of five (5)per cent per annum as of ore'said; : 'and such
amounts so certified shall be collected as other taxes and assessments

Sec. 10. 'This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal.
