1486 Improve Iron Avenue(Published in the Salina Evening Journal May______, 1909.) ORDINANCE NO. / An ordinanceproviding for the paving, curbing, Sutterir� and excavat- ing of Iron avenue, in the city of Salina, Kansas, and the east end of the bridge crossing the Smoky Hill River crossing said street and the West- side of Penn avenue; specifying the manner r . . of construction} and providing_fQr the., cost thereof and the manner of payment. Whereas, by resolution duly adopted on the 15th day of March, 1909, the mayornand council of the city of Salina have declarbd that they deem it necessary to pave, curb and gutter Iron avenue, in said city, between the Iron avenue bridge and Penn avenue; and, Thereas, said resolution was duly published for ten (10) consecu- tive days in the "Salina Evening Journal,* a daily newspaper published in the city of Salina; Mad, Thereas,.a majority of the resident owners of property liable to taxation for the cost of such paving, curbing and guttering of said street, did -not, within twenty (20) days from -such last publication, file with the city clerk of said city their protest against such paving, curbing and guttering; therefore, Be it ordained by the Mayor and Councilmen of the city of Salina: -- Section 1. That it is necessary and hereby ordered that Iron ave- nue, in the city of Salina, between the east end of the bridge crossing the Smoky Hill River crossing said street and the Wes -t- si d of Penn avenue, be paved, with such material as the mayor and council may here» after designate and select, as hereinafter provided, sixty (60) feet in width, more or less,, in. the blocks between Iron avenue bridge and Front street, and thirty-seven (37) feet in width,more or less, from Front street to Penn avenue; and at the intersections of all streets and alleys said paving shall extend from lot line to lot line. Sec. 2. That it is necessary and hereby ordered that Iron avenue, between the limits.defined in section one hereof, be curbed, on both sides thereof, with cement curbing, and guttered, on both sides thereof, with cement guttering, such curbing and guttering to be made and con- structed in one piece as a combined curb and gutter, the curb part of the same to be six (6) inches in thickness and the gutter part thereof to be thirty (30) inches, more or less, from the back edge of such curb to the edge of such paving, and such curbing shall be setZoz. des feet from and parallel with the lot line on either side of daid street from the Iron avenue bridge to Front street, and --Z— feet from and parallel with the lot line on either side of said street from Front street to Penn avenue, except at the intersections of streets and alleys where such curb and gutter shall return to the lot line. Sec. 3. A4xcavating, filling and rolling necessary for the proper construction of said paving, curbing and guttering shall be done, and such paving, curbing and guttering shall be done and constructed accord- ing to the established grade of said Iron avenue as hereibfore estab. lished by the ordinances of the city of Salina. Sec. 4. That the plans., specif icatios,.and profile "kof the city engineer, now on file with the city clerk, for the paving of said street with the different kinds of material for street paving, to-wit: brick block, bitulithic and asphalt, and for the curbing, guttering and exca- vating of said street, are hereby adopted and approved, and all of the work antdd improvements herein provided for shall be done in accordance with zwftlans specifications and profiles of the kind of paving to be selected by the said mayor and council, as hereinafter provided, and with the plans, specifications and profiles of such city engineer for such curbing and.guttering aforesaid, which such plans, specifications and profiles for the paving so selected as aforesaid and for such curbing and guttering are hereby incorporated in and made a part of this ordi- nance in all respects as if.the same were written out in full herein, and all the work and construction herein provided for shall be done under the direction and supervision of the city engineer, orchis duly author- ized assistant. Sec. 6. That after the passage of this ordinance, the mayor and council shall appoint three disinterested householders, who, after having taken an oath -to faithfully and impartially appraise all lots and pieces of ground liable to taxationn for the improvements herein provided for, shall, within ten (10) days after having been notified of their ap- pointment, proceed to appraise said lots and pieces of ground liable to taxation (without regard to any buildings or improvements thereon) and after making said appraisement shall return the same to the city coun- cil at the first meeting thereof after said appraisement shall have been completed, and after said appraisement is returned to the -city council the mayor and council.shall designate a time for holding a special ses- sion for the purpose of hearing complaints and equalising said appraise- ment, of which special session due notice shall be given in the offic44 city paper, and at said special session the mayor and council shall, if they deem it just and proper, alter or change such appraisement. Sec. 6. After the passage -and publication of this ordinance, the city clerk shall advertise for bids for the paving, curbing, guttering and excavating herein provided for, in the official city paper and such other newspapers as the mayor and council may direct, for not exceeding days, and such advertisement shall call for bids or proposals ' i s for all the kinds of paving specified and described n said pland and specifications of the city engineer now on file with the city clerk, and after the reception of such bids or proposals the mayor and council shad, l determine the kind of paving to be used on said street and may and are hereby authorized to let the contract for the paving of said street with the material so selected, and for the curbing and guttering of said street, to the most satisfactory and responsible bidder, as determined by the said mayor and council, the said mayor and council,.reserting the right to let the contract for the curbing and guttering, or for the paving, separately., or for all together, or to reject any and all bids or proposals. Sec. ?. For the purpose of paying for said paving, curbing, gutter. ing, etc., the mayor and council are hereby authorized to issue bonds of'the city of Salina, in an amount not to exceed the contract price, and to run for a period of ten (10) years, and be payab4e in ten (10) equal annual installments, together with interest not to exceed five (5) per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interst on said bonds, as they severally become due, the mayor and council shall each year during the life of said bonds levy an assessment against the lots and pieces of groubd liable to taxation for the improve- ments herein provided for in an amount sufficient to pay the principal and interest for that year; Provided, that for the purpose of defraying the cost of paving and otherwise improving the squares and areas formed by the intersection of streets and alleys, as well as where the improve. went is through \or adjacent to property of the city, for which the city would be liable, the assessments shall be made against all the taxable property of the city; and the city clerk shall certify said assessments, as they are severally made, to the county clerk of Saline county, at the same time and in the same manner as other city taxes are certified, and said assessments shall be liable to the same penalties as all other taxes. Sec. 8. This ordinance shall tkke affect and be in force from and after its publication once in the Salina Evening Journal. Passed and approved May 17, 1909.
