1477 Improve Eighth Streetr (Publishediin the Salina Evening, Journal April ot 1909• ) ORDINANCE NO. An ordinance providing for the paving, curbing, guttering and excavating of.Eighth street, in the city of. Salina, Kansas, between the south side of Ash street and the.,north side of Prescott avenue, excepting the square*or area,forme�. the crossing of said Eighth street with Iron avenue; specifying the manner of construction and pro- viding for the cost thereof and the manner of payment. 'Whereas, by resolution duly adopted on the 15th day of March, .1909p the mayor and council of the city of*Salina have declared that they deem it necessary to pave' curb and gutter Eighth street,.in said city, between the south side of Ash street and the North side of Prescott avenue, ex_. cepting the square or area fermed by the .crossing of said Eighth street with Iron avenue; and, 'Whereas, said resolution was duly published for ten (10) consecu- tive days in the "Salina Evening'Journal," a daily newspaper published. in the city of Salina; and, 'Whereas,a majority of the resident owners`of.property liable to taxation for the cost of such paving,:curbing and guttering of said street did not, .within twenty,.(20), days from such last publication, file with the city clerk of said city''their protest -against such paving, curbing and guttering or the doi#g of the worker the making of such improvements; and, 'Whereas, the city of Salina is a city of the second, class with less than ten thousand inhabitants; therefore, Be it ordained by the Mayor and Councilmen of the city of Salina: -- Section I. That it is necessary and hereby ordered that Eighth street, in the city of Salina,.betwee'n the south side of Ash street and the north side of Prescott avenue, excepting the square or area formed by the crossing of said EightJ& street with Iron avenue, be paved, with such material as the mayor and council may hereafter designate and select, as hereinafter provided, �....... ��� feet in width, more or less, or from.curb to curb,'except at the intersections of'streets. and alleys, where such pavement shall be z�� apt in width, or from lot .line to lot line. See. 2. That it is necessary and hereby,ordered that Eighth street, between the limits defined in section one hereof, be curbed and guttered on both Bides thereof, with cement curbing and guttering, such curbing and guttering to be made and constructed as a combined curb and gutter, the curb part'of,the same'te be six '(6) inches.in thickness and the .gutter part thereof to be thirty• (3©) inches, more...or. less, from the back edge of such curb to the street, and such curbing shall be sett=" GdZ,eet,�a paralle l with the lot line on either side of said street, except at the interesetione.of streets and alleys, where such curb and gutter shall return to the lot line of said Eighth street. See. 3.,^All excavating, filling and rolling necessary for the proper construction of said paving, curbing and guttering be done, and such paving, curbing and guttering shall be done and constructed accord - Ing to the established grade of said Eighth street as heretofore estab- lished by the ordinances of said city. Sec. 4. For the paving,.curbing, guttering and work and improvement herein provided for the city.engineer shall make and file with the, city clerk, on or before the next regular meeting of the city council, plans, specifications and profiles therefor, which plans,, specifications and profiles shall c©ver and embance the different kinds'of paving, such as brick block with concrete foundation, two course brick, asphalt, and bitulithic, and cement, curb and gutter, and such city engineer shall also file with the . city clerk a detailed estimate of the cost -of all such work and improvementaherein provided for. Sec... 5.' That after such plans, specifications and profiles shall have been filed with the said city clerk, the said city clerk shall advertise for bids or proposals for the different kinds of paving and for the curbing, guttering and.excavating of said Eight street for at lik"three days, in the official:city papery, such advertisement to call for bids or proposals on all the kinds of paving specified and described in the said specifications -of the city engineer, and after the receipt of such bids or proposals the.mayor and council shall determine the kind of paving to.be. used on said street and may, and are hereby authorized, to let the contract for the paving of said stseet with..the material so selected, and for the curbing, guttering and excavating of said street, to the lowest} most satisfactory and responsible bidder,, as determined by the said mayor and council, for.the kind and character of paving which shall be determined upon by the said mayor and council, the said mayor -WF and council reserving the right to let the contract for the curbing and guttering and for the paving and excavating separately, or all together, or to teject any,and all d bids.or proposals. Sec. 6• :after the passage and publication of this ordinance, the mayor and council shall appoint three disinterested householders, who, after having taken an , oath to faithfully andf impart sally appraise all lots and pieces of ground liable to taxation for the izirprovements herein provided for, shall, within ten (10) days after having been notified of their appointment, proceed to appraise said lots*and pieces of ground liabl6 to taxation, without regard to any building or improvements thereon, and after making said apprai,sement shall return the same to.the mayor and council.at the first meeting thereof after such appraisement shall have been completed, and after such appraisement is returned to the mayor and council the said Mayor' and',council shall designate tjm a time for holding a special session for the purpose,of hearing complaints and equalizing said apprai Bement, of which special session due notice shall.be given in the official city paper, and at said special session the mayor and.council shall, if -they deem it just and proper., alter or change such appraisement• See. 7•. For the purpose of paying for'such paving, curbing, gut--. tering and -excavating, the mayor and council are hereby authorized and directed to issue bonds of the city of Saline,, in an amount not to exceed the contract price of such.work'and improvement, and to..run for a period of ten (10) years .and be payable in ten equal annual.installments, one-- tenth in'one year, ons: -tenth in two years and one tenth in each year thereafter until the whole sum shall be fully paid, together with inter- este not to exceed -five -.(5) per cent per annum, which bonds shall be', made payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally.become due the mayor and council shall each year, during.the life of said bonds, levy an assessment against the lots and pieces of ground liable to tax- ation for the improvements herein provided for in an -amount sufficient. to pay' the principal and interest for that year; Provided, that for the purpose of defraying the cost of paving, curbing, guttering and other- wise improving the squares and areae formed by the intersections of streets and alleys as well as where the improvement is through.or ads jacent to property of the city,.for which the city.would be liable, the assessments shall be made against all the taxable property of the city; and the city clerk shall.certify such assessments; as they are severally made, to the county clerk ,of Saline,'couinty, at thesame time and in the :same manner as other city taxes are certified, and the said assessments shall be liable'to the same penalties as all other taxes. .Seco 8. This 'ordinafice shall take effect and be in force . from and after its publication once in the. Salina Evening Journal,
