That it is necessary and hereby ordered that Walnut street, between the limits defined in section one hereof, be curbed, on both sides thereof, with cement curbing, and guttered, on both sides thereof, j with cement guttering, such curbing and guttering to be made and con- structed in one piece as a.combined curb and gutter, the curb part of the same to be sig (6) inches in thickness and the gutter part thereof to be thirty (SKY inches, more or less, from the back edge of such curb to (Pubblished in the Salina Evening Journal March , 1909•) ORDINANCE NO. An ordinance providing for the paving, curbing, guttering and excavating t of Walnut street, in the city of Salina, Kansas, between the west side of Seventh street and the west side of Tenth street, speci- fying the manner of construction and -providing for the cost thereof and the manner of payment. whereas, a petition has been presented to the Mayor and Council, signed by three-fourths of the resident property owners fronting on, Walnut street, in the city of Salina, between Seventh street and Tenth street, requesting the mayor and council of said city to cause said Walnut street, between the limits above set forth, to be paved and curbed and guttered; and., Whereas, the city of Salina .is ax city, of the second class with o less than ten thousand inhabitants; therefore, . Be it ordained by the Mayor and Councilmen of the city of Salina:-- Section 1• That it is necessary and hereby ordered that Walnut street, in the city of Salina, Kansas, between the west side of Seventh street and the west side of Tenth street,..be paved, with such material as the mayor hereafter designate and select, as herein- and, council may . ater provided',O feet in'. width, more . or, less,^or from curb to curb, except at theintersect ions, of streets and alleys, where such pavement shall be A- •--� from lot line to lot lines', See. 2. All excavating, filling and rolling necessary for the proper construction of'said paving and curbing and guttering.be done, and such pavingand curbing and guttering shall be done and constructed according to the established grade of said Walnut street as heretofore establithed by the ordinances of the city of Salina. Sec. 4. For the paving,-durbing and guttering and work and improve- ment herein provided for, the city engineer shall make and file with the city clerk, on or before the next regular meeting of the city council, plans;, ecifications °fie p4 profiles)hereof, which plans and dpecifications shall cover and embrace the diff rent"kinds of paving, such as brick block with concrete foundation, two course brick, asphalt $sp haltic concrete, itulithic,)�and cement curb and guttering, and.said engineer shall'also file an estimate of the cost of the work'and�improvement herein provided for. Sec. 5.. That after such plans' � specifications and profiles shall have been filed with the said city clerk, the mayor and council(shali) wtj Oause such -clerk to advertise for bids for the different kinds of paving, and for the curbing and guttering. and excavating for sucb(� 4lnut street for such time as such mayor and council shall designate, and such adver- tieement shall call for' bids or proposals on(all)the kinds of paving specified)and described, in said 'specifications of the city engineer, and after the receipt of such bids or,proposals the mayor and council shall determine the kind ,:of paving to 'be used on said street and may, and are hereby authorized 'to legit. the contract for the paving, R'of said street with the material sa selected, and for the curb- ing and guttering and excavating of said street, to thea lowest j most Sat- isfactory and responsible bidder, as, determined by the said mayor and council, for the kind and character of paving which shall be determined .upon -by the said mayor and council, the said mayor and council reserving the right to reject any and all bids. See. 6. After the passage and publi7at.iv of this ordinance, the mayor and council shall appoint three disinterted householders who after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation for the improvements herein provided for, shall,, within ten (10) days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable to taxation (without regard to any buildings or improvements . thereon) and after making said appraisement shall return the same to the mayor and council at the first meeting thereof after such appraisement shall have been completed, and after such appraisement is returned to the mayor and council the said mayor and council shall designate a time for holding a special'session for the purpose of hearing complaints and. equalizing said appraisement, of which special session due notice shall be..given in -the official ,city paper, and at said special,ysession the mayor and council shall, if they deem..it just and proper, alter or change such appraisement. Sec. 7. For the purpose of paying.for such paving, curbing and gutterin and excavating, the mayor and council are hereby authoriged and directed to issue bonds of the city of Salina, in an amount not to ex cesd the contract price,and to run for a period of ten (10) years and be payable in ten (14. ) equal annual installments --one-tenth in one * year � one-tenth in two year's and one-tenth in .each year thereafter until the same shall be fully paid together with interest not to. exceed -five ( 5 ) per .cent per annum,.which bonds shall be made payable at the fiscal agency of the State'ot Kansasp and for the purpose of paying principal and interest on said bonds as they severally become due the mayor -and council shall each year, during the life of said bands, levy an assessment against the lots and pieces of ground liable to taxation for the im- provements herein provided for in an amount sufficient to pay the prin- cipal and interest for that year.; Provided, that for the purpose of defraying the cost of paving and otherwise improving the squares and areas formed by the intersection of streets and alleys as well as where the improvement is through or adjacent to .property of the city, for. which the city would be, liable, the ;:assessments shall be 'made against all the taxable property of the rAy city; and the city clark' shall.'certify said assessments, as they are 'severally made, to the county clerkcf..Saline county,.at the same time and in the same manner as other city taxes are certified, and,:said assessments shall lae .liable to the same.penalties as all other' taxes . .
