An ordinance providing for the condemnation and appropriation of certain of real estate in the city of Highland uesand Ninth street for the efrom opening an alley between Hight Crawford avenue to Bond street; establishipointmentfof appraisers© pay for the same, and providing for the app therefor and prescribing their duties- the or and Councilmen of the city of Salina:-- Be it ordained by y Section 1• .It is hereby declared necessary to condemn and appro- c use for the purpose of opening an alley, fifteen (15) priate for. publi , feet wide, running north and south through the center of the block bounded by Highland avenue, Bond street, Ninth street and Crawford ave- nue, in the city of Salina, Kansas, all that piece of land described as follovKs, to -wit: the east seven and one-half (7 1�2) feet ®f Lots num- bered one (1) to thirty-one (31), inclusive, and the west seven and one- half (7 1/2) feet of Lots numbered two (2) to thirty-two (32).l inclu- sive, all in Block One (1), Bond's addition to and in the city of Salina, Kansas, making a strip of ground running north and south fifteen got feet in width and 800 feet in length. Sec. 2• For the purpose of providing a fund to pay for the con- demnation and appropriation of said ,land as aforesaid, a benefit dis- trict is hereby created and established, including all lots and pieces of ground contained in Block One (1), Bond's addition to and in the city of Salina, Kansas-. Sec • 3 • the mayor, by and with the consent of the council, shall householders as appraisers, who appoint three disinterested according to law to give notice and assesl the shall qualify and proceed damages caused by the condemnation and appropriation of said lands for said alley; they shall ascertain the actual value of the lands proposed to be taken, without reference to the projected improvement and the actual damage done to all other property thereby For the payment of Su value and damgge said appraisers or householders shall assess the dam- ages against the lots and pieces of ground within such benefit district; n the judgment and opinion of said appraisers, be especially which shall, i J benefitted by the opening of said alley, in proportion to the benefit derived by each by the opening and extending of said alley as herein provided. The said appraisers shall report to the mayor and council their proceedings in all things as required by law and shall, upon com- pletion of their report, file the same with the city clerk. Sec. 4.
