ORDINANCE NO. /X146 Z.
An ordinance concerning the purchase and appraisement of the Salina water
works, of Salina, Kansas, appointing an appraiser on behalf of the
city of Salina to make appraisement thereof, defining such ap-
praiser's duties and fixing his compensation, and repealing Ordi-
nance No.. 1460.
Be it ordained by the Mayor and Councilmen of the City of Salina: --
Section 1. .That the city of Salina, Kansas, hereby.decides and
determines to purchase and become the sole owner of the Salina water
works, and all extensions thereof, together with all buildings, machin-
ery and property of every description belonging;.and appertaining thereto,
by paying therefor, to the owner or owners.thereof, the value of said
water works and property as ascertained by appraisement as provided by
section eight (8) of Ordinance No= 372 of the printed ordinances of the
city of Salina, being an ordinance entitled "An ordinance to provide for
a system of water works and a supply of water to the city of Salina '
and the inhabitants thereof," passed and approved March 20, 1883, and
which said section eight (8) of said.Ordinance No 372 is hereby spec-
ially
pec
ially referred:.to and made a part of this ordinance.
Sec. 2,/ That for the purpose of making the appraisement of said
Salina water works and property, as provided in said section eight (8)
of said Ordinance No. 372, and in compliance therewith, the City of -
Salina hereby selects and appoints, as its appraiser, F. D. Shellabarger,
of Salina, Kansas, who shall file his acceptance of such appointment in
writing with the city clerk immediately after the passage of this or-
dinance
See. 3. The said appraiser so appointed in section two (2) hereof
shall receive as compensation for his services under this ordinance the
sum
of ten($10.00)
dollars per day for
the time necessarily employed in
the
performance of
his duties hereunder,
which shall be in full compen-
sation for such services.
Sec• 4. That the ,owner or owners of said Salina wager works be and
they are hereby, required, within a ays from the publication of
this ordinance, to. select an appraiser to act in conjunction with the.
appraiser hereinbefore appointed by the city of Salina, in selecting a
third app raiser, as hereinafter provided, and in appraising the prop-
erty mentioned in section ,one (1) of this ordinance, in accordance with
the provisions of this ordinance and of said section eight (8) of said
Ordinance No. 372..
See.'5. That the said owner or.owners of the said Salina water
works shall, upon the selection of its said appraiser, immediately
notify the city clerk of said city, in writing, of such selection, and a
failure to make such selection and notify the.city clerk thereof, within
the time specified in section four (4) hereof, shall be deemed and held
to be a refusal on the part of said owner or owners of the.said Salina
seater works to comply with the .provisions of this ordinance and of said
section eight (8) of said Ordinance No. 372.
See. 6• Within days after the selection of the said appraiser
to be selected by the owner or owners -of the.said Salina water works, as
provided in section five (5) hereof, and not later than ,O days
Mr from and after the publication of -this ordinance, the owner or
owners of the said Salina water works shall cause its said appraiser to
meet with the appraiser hereinbefore appointed by the said city at the
office of the ci*y clerk of Salina, and said two:,appraisers,shall,
without delay, select a third appraiser -to act with them .in.making such
appraisement of the said -Salina water -works and property mentioned and
described in section.one (1) of this ordinance, in accordance with the
provisions of this ordinance and of said section eight (8) of said Or-
dinance No. 372•
Sec. 7• After the selection and appointment of the said three
appraisers, as in this ordinance provided, it shall be the duty of said
appraisers to make a true inventory of the .said Salina water works, and
all extensions thereof, and the buildings, machinery and property of
every description thereunto belonging, and to make and return to the
mayor and.council of said city of Salina'a true appraisement, at the
actual cash value thereof at the time of such appraisement, of the said
Salina water works and all extensions thereof, and the buildings, machinery
and property of every.description thereunto belonging, which said inven-.
tory.and appraisement'shail be made under the oaths of the said ap-
praisers-.
Sec. 8. That the city clerk 'is hereby required to; :deliver a cer-
tified.copy.% I 'of this ordinance, together with a certified'.copy of the
acceptance of its said. appraiser. appointed herein, to the owner, or .owners
of the' said Salina .water works, or .to the. person in charge thereof,
within three (3) days after 'the taking effect of this-ordinance.

Sec. 10. This ordinance shall take effect and.be in force from
and after its publication once in the Salina Evening Journal.
