ORDINANCE NO. /X��
An ordinance concerning the purchase and a.praisement of theas and
electric li t plant and works o the People's Lighf,wHeat &
Power co any olty.of
Salina Kansas; appointing an a raiser on
behalf of said Salina to make appraisemenu thereof,
defining such appraisers duties and fixing his compensation.
Be it ordained by the Mayor and Councilmen of the City of Salina: --
Section 1. The city of Salina, Kansas, having heretofore, on the
.16th day of -November, 1908, passed a resolution giving at least three
months' notice to the owner of its intention to purchase the gas and
electric light plant and works of the People's Light, Heat &•.Power Co.,
said city of Salina hereby decides and determines to purchase and be-
t'come the sole owner of the gas and electric light plant and works of the
.People's Light, Heat & Power Company, of Salina, Kansas, the same being
the plant, property and works operated by said named company under a
certain franchise given by the said city of Salina to one Thomas H.
Wbb, his successors and assigns, by Ordinance No. 1218 of the city of
Salina, Passed and approved March 8, 1904, and of all the extensions of
said gas and electric light plant and works, and the buildings, machinery
and property of every description thereunto belonging, by paying there-
for to the owner or owners thereof the value of said gas and electric
light plant and works and property, to be ascertained by appraisement
as provided by section twelve (12) of Ordinance No. 1218 of the ordi-
nances of said city -of Salina entitled "An ordinance granting to Thomas
H. Smith, his sucessors and assigns, the right to manufacture, distribute
and sell electricity and gas for light, heat, power and other purposes
in the city of Salina; to use and occupy the streets, alleys and public
grounds of said city for the erection and maintaining of poles, wires
and conduits and for the laying of the mains and pipes therefor; and con-
tracting,with said Thomas H. Smith, his successors and assigns, for the
lighting of the streets, public buildings and grounds of said city,"
passed and approved March 8, 1904.

Sec. 2. That for the purpose of making the appraisement of said
gas and electric light plant and works, the extensions and property
thereof, as provided in said section twelve (12) of said Ordinance No.
1218, and in compliance therewith the City of Salina hereby selects and
appoints, as its appraiser,V , of Salina,

Kansas; and such appraiser hereby selected and appointed shall file with
the city clerk his acceptance of such appointment, in writing, within
tim (3) days after the publication of this ordinance.
Sec. 3. It shall be the duty of the said appraiser designated in
section two (2) hereof to act in conjunction with any person or persons
who may be selected or appointed under and by virtue of the provisions
of section twelve (12) of Ordinance No. 1218 of the ordinances of the
city of Salina, and in conjunction with such person or persons to make a
true inventory of all the property and material used in the construc-
tion and operation of the gas,and electric light plant and works of the
said People's Light, Heat & Power Co., and to make and return to the
mayor and council of said city a true appraisement of the actual cash
value of all such material and property and of said gas and electric
light plant and works at the time of such appraisement, which said in-
ventory and appraisement shall be made under the oathes of the said
appraisers aforesaid..
Sec. 4. That the appraiser appointed in section two (2) of this
ordinance shall receive as compensation for his services under this or-
dinance the sum of dollars per day for the time necessarily
employed in the performance of the duties hereunder, which shall be in
full compensation for his services
Sec. 5. That the owner or owners of the said gas and electric light
plant and works of the People's Light, Heat & Power Co. be and they are
hereby required, within (10) days from and after the publication
of this ordinance, to appoint an appraiser to act in conjunction with the
appraiser hereinbefore appointed by the city of Salina, to appraise the
property mentioned in section one (1) of this ordinance in accordance
with the provisions of section twelve (12) of said Ordinance No. 1218.
Sec. 6. Within ten (10) days after the appointment of the said
appraiser to be appointed by the owner or owners of the said gas and
electric light plant and works, as provided in section five (5) hereof,
and not later than ( ) days from and after the publi-
cation of this ordinance, the owner or.owners of said gas and electric
light plant and works shall cause its said appraiser to meet with the
appraiser hereinbefore appointed by said city, at the office of the city
clerk of the city of Salina, Kansas, and the said two appraisers shall,
without delay, select a third appraiser to act with them in making an
appraisement of the said property mentioned and described in section
one (1) of this ordinance, in accordance with the provisions of this
ordinance and Ordinance No. 1218.
Sec. 9. That the city elerk of said city is hereby required to
deliver a certified copy of this ordinance together with a certified
copy of the acceptance of said appraiser appointed by the city $erein
to the owner or owners of said gas and electric light plant and works, of
the People's Light, Heat & Power Co., of Salina, Kansas, or to the per-
son in charge thereof, within five (5) days after the taking effect of
this ordinance.
Sec. B. This ordinance shall take effect and be in force from and
after its publication once in the Salina Livening Journal.
