ORDINANCE NUMBER 10-10538
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE
ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR
THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE
PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the
rezoning of certain properly therein, hereinafter described has been timely complied with, SO NOW,
THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. AMENDMENT. DISTRICT "PC -511, PLANNED SERVICE
COMMERCIAL DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly
adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina
Code, be and it is hereby amended so that the following described property be rezoned as follows, to -
wit:
Lots Six (6) and Seven (7), Block Three (3), of the Phillips East Addition to
the City of Salina, Saline County, Kansas.
shall become apart of DISTRICT "PC -5", PLANNED SERVICE COMMERCIAL DISTRICT.-

ISTRICT:
Section 2. CONDITIONS OF APPROVAL. The use of said described property shall be
subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number
8526, the same being Chapter 42 of the Salina Code with reference to the "PC -5", PLANNED
SERVICE COMMERCIAL DISTRICT regulations, subject to the following conditions and limitations:
Development shall be limited to a car wash, including automated bay
with overhead doors and hot air dryers, convenience store, gasoline
service station, fast food restaurant plus other uses permitted in the C-3
district.
2. The rear doors of the automated car wash bay shall remain closed when
the car wash and hot air dryers are in operation.
3. The building setback from Connecticut Avenue shall be maintained at
15 feet.
4. Exterior lighting fixtures shall not cast any direct light to the east or
south.
5. Development of the site, including building design and landscaping,
shall substantially conform to the approved site development plan.
6. A building permit for this car wash dryer installation project shall be
obtained within 18 months of site plan approval.
Section 3. That this ordinance amends and supersedes Ordinance Number 98-9883 as it
applies to this property and Ordinance Number 98-9883 as it applies to the above described property is
hereby repealed.
Section 4. , That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
