ORDINANCE NO.
.An ordinance providing for the issuance of bonds of the city of Salina,
Kans as , in. the sum of to pay for the improve-
ment of certain streets in said city.
Whereas, in pursuance of proceedings duly had and taken according -
to law, contracts have been let for the paving, excavating and curbing of
the following streets and parts of streets in the city of Salina, Kansas,
to -wit: Seventh street between the north side of Walnut street and the
south side of Iron avenue, and between the north *side of Iron avenue and
the north side of Elm street; Ash street between the west side of Fourth
street and the east side of Santa Fe avenue, and between the. west side
of Santa Fe avenue and the east side of Seventh street; Walnut street
between the east side of Fifth street and the east side of Santa Fe
avenue, and between the west side of Santa Fe avenue and the west -side
of Seventh street; Elm street between the west side of Fourth street
and the east side of Seventh street, excepting, the squares and areas
formed bY-th-e_crassiw, of_Blm -atm. et--wi th Fifth street and Santa Fe
and 'Fifth stre6t between the north aide of 'TIM stroot luid the
north side of 1,,'.rh1nut street, except the "squares e - Md areas fom, Pd by thn,

all of the taxable property within said city, and for which bonds are to
be issued as herein provided, has been ascertained to be the sum of
$ and the portion thereof to be paid by special as-
sessments upon the lots and pieces of ground liable therefor has been
ascertained, and said amount has heretofore been duly assessed and ap-
portioned to the. said several lots and pieces of ground, payable in ten
annual installments according to law, and the amount for which bonds
are to be issued in anticipation of said special assessments which remain
unpaid has been ascertained and is hereby determined to be the slim of

Whereas, all.legal requirements have been fully complied with to
authorize th issuance of bonds on account of said improvements; therefore
Be it ordained by the Mayor and Councilmen of the City of Salina: -
.Section 1. There shall be issued, oh account of said street im-
provements, a series of bonds of the city of Salina, in the aggregate

inclusive„ bearing interest at the rate of five per cent per.annum,

�.. Sec. 2. That said bonds shall be sued by the mayor and attested
by the clerk of said city, and shall have the corporate seal of the city
attached thereto, and the interest coupons to said bonds shall be signed
by the city clerk, and that both bonds and coupons shall be payable at
the Fiscal Atency of the State of Kansas, in the city of Topeka, in
said state.
Sec. 3. That said bonds shall be executed in the form and shall
contain recitals substantially as follows:

KNOW ALL MEN BY THESE PRESENTS, That the City of Salina, in the:
county of Saline, and State of Kansas, for value received, hereby ac-
knowledges itself to be indebted to and promises to pay the bearer ihhe

interest coupon hereto attached bearing the signature of the clerk of
said city, as they severally become due, and both principal and interest
are payable at the Fiscal Agency of the State of Kansas, in the city of
Topeka, Kansas, and the city of Salina is hereby held and firmly bound,
and its faith and credit and all real and personal property in said city,
are hereby pledged for the prompt payment of the principal of this bond
and the interest thereon at maturity.
This bond is one of a series of bonds of like date and tenor
issued by the said city of Salina to pay for street improvements in and
for said city under and by authority of and in compliance with the
provisions of the laws of the State of Kansas governing cities of the
second class of less than ten thousand inhabitants, and in compliance
with an ordinance duly and legally passed by the mayor and council of
said city on the 30th day of November, 1908.
And it is hereby declared and certified that all acts, conditions
and things required to be done and to exist precedent to and in the
issuing of this bond have been properly done and performed and do exist
in regular and due form as required by the constitution and latus of the
State of Kansas, and that the total indebtedness of said city, including
this series of bonds, does not exceed any constitutional or statutory
limitations.
In Fitness Whereof, said City of Salina, by its mayor and council,
has caused this bond to be signed by its mayor and attested by its
clerk, and its corpora a seal to be hereto affixed and this bond to be

Sec. 4. That the interest coupons to be attached to said bonds
shall be substantially in the form following, to -wit:

will pay the bearer dollars, at the Fiscal Agency of the
State of Kansas, in the City of Topeka, Kansas, being six months'
interest on Its Internal Improvement Bond dated Z 19og.

Sec. 5. That the 'payor and City Clerk are hereby authorized;X
without unnecessary delay, toprep are and execute said bonds and cou-
pons, and that when executed they shall be registered with the.city
clerk of the city of Salina, the county clerk of Saline county, and by
the Auditor of State of the State of Kansas, as required by law, and
shall be by the mayor of said city delivered to Yj I con-

for such work and improvements; or, the mayor and council may sell
said bonds and out of the proceeds thereof pay saioccontractor4 and that
the mayor and council shall annually make provisions for the payment
of the principal and int;rest of said bonds, as the same shall become
due, by levying a tag on the property liable therefor.
Sec. F. This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal.
