ORDINANCE NO.
An ordinance providing for the curbing and guttering of both sides of
a
street, -between �� street and
ql�&_O_&�=
in the city of Salina, Kansas; specifying the manner
of construction'and providing for the cost thereof and the manner of
payment.
W ERAS, by resolution duly adopted on the 20th day of July, 1908,
the mayor and council of the city of Salina have declared that they deem
it necessary to curb and gutter both aides of ,+street in said

'Whereas, said resolution was duly published for ten (10) consecutive
days in the "Salina Evening Journal,"-a'daily newspaper published in the
city of Salina, Kansas; and'
Whereas, a majority of the resident owners of property liable to
taxation for the cost of such curbing and guttering of said street within
the limits defined did not, within twenty (20) days from the last publi-
cation of such resolution, file with the city clerk of said city their
protest against such curbing and guttering, or against the doing of the
work or the making of the improvement; and,
Whereas, the.eity'of Salina, Kansas, is a city of the second class
With less than ten thousand inhabitants; therefore,
Be it ordained by the Mayor and Councilmen of the city of Salinas --
Section 1. That it is necessary and hereby. ordered .that

thereof, with cement.curbing, and guttered, on both sides thereof, with
cement guttering, such curbing and guttering'to be made and constructed
in one piece as a combined curb and gutter, the curb pert of the same to

and alleys where said curb and gutter shall return to. the lot line of

Sec. 2. That all excavating,
filling and tamping necessary for the
proper construction of such curbing and guttering shall be done.
Sec* 3• That the plans,.specifications and profiles of the city
engineer, now on file with the city clerk, for the curbing and guttering
of said street within the limits defined, are hereby adopted and approved
as and for the plans, specifications and profiles for the curbing and gut-
tering of such street,: and all the work provided for in this ordinance
shall be done in accordance with such plans, specifications and profiles,
which are hereby incorporated in and made a part of this ordinance in all
respects as if the same were written out in full herein; and all the work
herein provided for shall be done under. the direction of the city engine
or his duly authorized assistant.
See. 4. That -after the paesage of this ordinance the mayor and
council shall appoint thr.ee.disinte.rested.householders, who, after having
taken an oath to faithfully and impartially appraise all lots and pieces
of ground liable to taxation for the improvement herein provided for,
shall, within ten days after having been notified of their appointment,
proceed to appraise said lots and pieces of ground liable to -taxation,
without regard to.any buildings or improvements thereon, and after makini.
said appraise.ment shall.return the same to the city council at the first
meeting thereof,after such.appraisement'shall have been completed, and
after . said apprai,sement' is returned to' the city council the mayor and
council shall -designate a time for holding a special session for the pur-
pose of hearing complaints and equalizing said appraiaement, of which
special session due notice shall be given.in.the official city.paper,' and
at said special sessioxi the mayor and council shall, if they deem it just
and proper, alter or change such appraisemerit .
Sec. 5. That ifter the pasage and publication of this ordinance the
city clerk shall advertise .for bids for the oonstruction.„ of. said curbing
and guttering in.the official city paper,.and such other publications or
journals as the mayor and council may direct, and the contract for such
work and improvement shall be let to the lowest responsible bidder, as,
dtermined.by the mayor and council; the said mayor and council reserving
the right to reject any and all bids.
See -6. For the purpose of paying.for said curbing and ,guttering
in installments,'instead of lev$ing the entire tax or special assessment
for such cost at one time, the. -mayor and council, are hereby authorized to
issue improvement bonds of said city, payable in installments of equal
amounts each year, none of which bonds nor any installment thereof shall
run longer than ten years noe bear interest exceeding five (5) per cent
per annum. Such bonds may be issued'td the contractor constructing such
improvement in payment thereof, or the mayor and,00unci may reel said
bonds at not -less than their par value and pay the proceeds thereof to the
contractor, and such bonds shall be of isuch'denomination as the mayor and
council may deem proper. And for the purpose of paying principal and
interest on said bonds, as they severally become due., the mayor and council
shall.each year, -during the life of said bonds, levy an assessment against

the lots and pieces of ground liable to taxation for the improvement,�an
aunt sufficient to pay the principal 'and interest for that year; Pro=
vided, that for the purpose of paying the cost of curbing and guttering
the squares and areas formed by the intersections .of streets and alleys,
for -'which the city would be liable, the assessments shall be made against
all the taxable property of the city; and the city clerk shall certify
said assessments:, as they are severallymade, to the county clerk of Sam
line county, Kansas, at the'same t ime'and in the same manner as other
city taxes are,certified, to be collected as other taxes are collected.
Sec. 7. This ordinance shall take'effect and be in force from and
after its publication once'in the "Salina Zvening Journal."
