.An ordinance relating -to hpportioning and levying a special assessment
on certain lots and pieces of _ground i�r the city of Salina, Kansas,
to pay. the cost of paving, excavating and curbing Seventh street in
said city between Elm street and Walnut Awddea street; and re-
lating to the collection thereof.
Be it ordained by the Mayor and Councilmen of the city of Salina: --
of
Section 1. That for the purposepaying the cost of paving, ex-
cavating and curbing Seventh street, in the city of Salina, Kansas,
thereof
between -the blocks,\bounded by the south side of Elm street and the
north side of .ash street, the south side of Ash street and the north
side of Iron avenue and the south side of Iron avenue and the north side
of Walnut street, there is hereby levied and assessed a special assess -
went on all lots and pieces of ground liable therefor, to the center of
the block on either side of said Seventh street, the distance improved,
according to the appraisedvalue of such lots and pieces of ground
without regardo the buildings or improvements thereon; said special'
assessments being based on the special valuation and app raisement of
said lots and piecesof ground heretofore made by three disinterested
appraisers appointed by the mayor and council of said city, and being
computed and made for each block separately, and the several amounts
levied, apportioned and assessed against each of said lots and pieces of
ground according to the benefits to be derived by reason of the paving,
excavating and curbing of said Seventh stret, between the limits herein-
before defined, are described and designated as follows, to -wit.

the south side of Elm street and the north side of Ash street:

Sec. 5. Said amounts levied, apportioned and assessed aforesaid
shall be due and collectable in ten equal annual installments, the first
becoming due in the year 1909, and one of said insfiallments coming due
each and every year thereafter, and all to be collected with interest
as in this ordinance provided; Provided, that the owner of any piece
of properly liable for any such special assessment may redeem his prop-
erty from such liability by paying into the city treasury the entire
amount chargeable against the same, as in.this ordinance designated, at
any time within thirty days after the publication of this ordinance and
before the issuance of the bonds of said city in payment of the amount
of money that may be due for such work and improvement at the time of
their issue, and his property so paid on shall not thereafter be liable
for any further assessments for the cost of such work nor for the said
bonds.
Sec. 6. That there is hereby further levied and assessed against
each lot and piece of ground described in sections two, three and four of
this ordinance five per cent interest per annui* on all of said install-
ments therein mentioned from the date of the bonds until the collection
of each of said installments, as provided by law, which shall be colected
annually at the same time and in the same manner as said installments;
and after the taking effect of this ordinance, and after the issuance
f ,
of said bonds, it shall be the duty of the city clerk of said city,
annually, at the same time o'Ier taxes are to be certified,,and until
all of said taxes and assessments so apportioned and leviethave been
certified, to certify to the county clerk of Saline cunty, Kansas, a
full list of all property ldable for the cost of such ork and improve.
went, except such property on which the special assessments aforesaid

have been paid in fulls as herein provided, together with the respect-
ive amounts due on each of said tracts, pieces and parcels of land,
which amounts shall include the annual installments and the interest on
them same on all unpaid balances for one year at the rate of five per
cent peri annum as aforesaid; and such -amounts so certified shall be
collected as other taxes are collected,
Sec. 7. This ordinance shall take effect and be in force from and
of ter its publication once in the Salina Evening Journal.
