1443 Levy Special Assessments(Published in the Salina Evening Journal Oct., 1908)
ORDIN9NCE NO. -I
An ordinance relating to apportioning and levying a special assessment
on certain lots and pieces of groubd in the city of Salina, Kansas,
to paythe cost of paving, excavating and curbing Fifth street in
said city between , m street and Walnut .street, and relating to the
collection thereof.
Be it ordained by the Mayor and Councilmen of the city of Salina: --
Section 1. That for the purpose of paying the cost of paving,
excavating and curbing Fifth street, in the city of Salina, Kansas,
between the blocks thereof bounded by the south side of Elm street and
the north side of Ash sire;'the south side of ash street and the north
side of Iron avenue and the south side of Iron avenue and the north side
od Walnut street, there is hereby levied and assessed a -special assess-
ment on all lots and pieces of ground liable therefor, to the center of
the block on either side of said Fifth street, the distance improved,
according to the. appraised value of such .lots and pieces of ground
without regard,to the.buildings.or improvements thereon; said special
assessments.,being based on the special valuation and appraisement of
said lots and pieces of ground heretofore made by three disinterested
appraisers appointed by the mayor and council of said city, and being
computed and made for each block separately, and the several amounts
levied, apportioned and assessedainst each of the said lots and pieces
o be
of ground according to the benefits derived by reason of the paving, ex-
cavating and curbing of said Fifth street, between the limits hereinbe-
fore defined, are described and designated as follows, to -wit:

Sec. 5. Said amounts levied, apportioned and assessed aforesaid
shall be due and collectable in ten equal annual installments, the first
becoming due in the year 1909, and one of said installments coming due
each and every year thereafter, and all to be collected with interest
as in this ordinance provided; Provided, that the owner of any piece of
property liable for any such special assessment may redeem 4is property
into the city treasury
from such liability by paying the entire amount chargeable against the
same, as in this ordinance designated, at any time within thirty days
after the publication of this ordinance and before the issuance of the
bonds of said city in payment of the amount of money that may be due for
such work and improvement at the time of their issue, and his property so
paid on shall not thereafter be liable for any further assessments for
the cost of said work nor for the said bonds.
Sec. F. That there is hereby further levied and assessed against
each lot and piece of ground described in sections two, three and four
of this ordinance five per cent interest per annum on all of said in-
stallments therein mentioned from the date of the bonds until the col-
lection of each of said installments, as provided by law, which shall be
collected.annual.ly at the same time and in the same manner as said in-
stallments; and after the taking effect of this ordinance, and after
the issuance of said bonds, it shall be the duty of the city clerk of
said city, annually, at the same time other taxes are to be certified„
and until all of said taxes and assessments so apportioned and levied
have been certified, to certify to the county clerk of Saline county,
Kansas, a full list of all property liable for the cost of such work and
improvement, except such property zz on which the special assessments.
aforesaid have been paid in full, as herein provided, together with the
respective amounts due on each of said tracts, pieces and parcels of
land, which amounts shall include the annual installments and the in-
terest on the same on all unpaid balance for one year at the rate of five
per cent per annum as aforesaid; and such amounts so certified shall be
collected as other taxes are collected.
Sec. 7. This ordinance shall take effect and be in force from
and after its publication once in the Salina Evening Journal.
