1442 Sewer Improvements(Published in the Salina Evening Journal 1908) ORDINANCE ITO. An ordinance providing.for the construction of certain sewers and drains in the city of Salina, Kansas. Be it ordained by the Mayor and Councilmen of the city of- Section l.. That it is necessary and hereby ordered that the fol- lowing described lateral sewers be built and constructed, as in this ordinance provided, to -wit: \� A twelve (12) Inch lateral sower on South and Vifth streets, con- ! menc ing at the denter line of the alley running north and south between r`r Fourth and Fifth streets- at ale, thence west to Fifth street and south to Prescott avenue, a distance of 1640 feet, A ten (10). inch lateral sewer on State street, commencing at the manhole on Eleventh and State Street, .and west to the center.of College avenue„ a distance of about 1196 feet; A ten (10) inch .lateral sewer can Prescott Avenue and Ninth street, commencing at the man -hole of the present sewer at Prescott avenue and Tenth.street,- tbance east to Ninth street* thence north on Ifinth street to the south line of Morrison's Reserve; also south from Ninth ly, and Prescott .to a .point 200 feet south of Crawford Avenue on said Ninth street. The --total length of said.sewer is 2340 feet. A ti n (10).. inch'lateral ag er on Walnut street between 'Fourth and Fifth street to alley between Fourth and Third streets, south in alley to Mulberry Street; thence east to point between Third and Second street; which sewer commences at the present man -hole on Walnut Street and the center line of the alley running north and south between.Fifth and FoiAh street, thence east to alley between fourth and Third stireet$ 330 feet; thence south in the center of said alley 830 feeto to Mulberry Street; thence east 330 feet to a point about half way between Third and Second street; the length of said sewer being 3490 feet. A ten (10) inch lateral sewer on Tenth street$ from Elie Street north to the tracks of the ITissouri Pacific Railway, which sewer commences at the present manholes at the junction of Tenth and Elm. Streets and runs thence north a distance of 614 feet to a point south of the tracks of the 1xissouri Paci,fi.c Railway* nance, and under the direction and supervisions of the city engineer. Sec. 3. That all man -holes and catch-basinui digging and trench- ing necessary for the proper construction of such sewers shall be built and done and in accordance with such plans and specifications. Sec. 4. That after the passage and publication of this ordinancef and before the next regular meeting of said mayor and council, the city clerk shall advertise for bids for the building and construction of said sewers, in the official city paper, for at least three issuesof said paper, and upon the receipt of bids therefor the contract for the building and construction of such sewers shall be let to the best and most responsible bidder, as determined by the said mayor and council; Provided, that the mayor and council may let the contract for any amd one or for all of said sewers, at their option, or they may reject any and all bids. Sec. 5. That the cost and expense of the construction of said sewers shall be assessed against all the lots and pieces of ground contained in the city of Salina as a sewer district, as provided by Ordinance No. 613, passed and approved December 23, 1887, and that the mayor and council are hereby authorized to provide for the payment of the cost thereof by installments instead of levying the entire tax or special assessment at one time; and for such installments the mayor and council are hereby authorized to issue improvement bonds of the city of Salina, payable in installments of equal amounts each year, none of which bonds or any installments thereof shall run longer then ten years or bear interest exceeding five (5) per cent per year. Such bonds may be issued to the contractor constructing such improvement, in payment there- of, or the mayor and council may sell such bonds, at not less than their par value, and pay the proceedsthereof to the contractor, and such bonds t shall be of such denomination as the mayor and council shall deem proper, .And for the purpose of paying principal and interest on said bonds as they severally become due, the mayor and council shall each year during the life of said bonds levy an assessment against all the real estate in the city of Salina in an amount sufficient to pay the principal and interest for that year, and the city clerk shall certify such assess- ments as they are severally made to the county clerk of Saline county, Kansas, at the same time and in the same manner as other city taxes are certified, and said assessments skall be liable to the same penaltiest as other taxes.
