An ordinance opening and creating a cer ain street in South Park Addi-
tion to and in the city of Salina, Kansas.
1hereas, under an ordinance heretofore passed by the mayor and
council electing to peen and create a certain street in South Park ad-
dition to
andin the city of Salina, Kansas,
the --city engineer has
made
and filed
with the city clerk a plat of the
parcels and tracts of
land
sought to be taken therefor, as required by law; and,
'Whereas, commissioners or appraisers having heretofore been ap-
pointed
by the mayor
and council
to assess and
determine
the amount of
damage
sustained by
the person or
persons whose
lands or
lots are sought
to be taken for the purpose of opening or creating such street, have
made and filed with the city clerk their written report, showing their
proceedings as such commissioners or appraisers, as required by law, and
have made adequate compensation to the owner or owners of the property
sought to be taken; therefore,
Be it ordained by the Mayor and Councilmen of the city of Salina: --
Section 1. That the report of said commissioners or appraisers
is hereby adopted and approved, and. it is hereby determined that the
following described lots and lands be and the same are hereby taken for
the purpose of opening and creating a street in the city of Salina,
Kansas, to -wit: Lot One (1) and the west ten (10) feet of Lot Two (2),
Block Five (5), in South Park Addition to the city of Salina; also a
tract of land'ten (10).feet by ninety -sig and 6110 (96.6) feet described
as follows: commencing at the northwest corner of said Lot 2, thence
north 96 and 6110 feet, thence due east 10 feet, thence due south 96 and
6110 feet, thence due west 10 feet to the point of beginning; and that
such property is hereby taken for a public street and is hereby declared
and opended as a public street in said city.
Sec. 2. That the sum of $375.00, the amount so assessed {B damages
for the lands -or lots so taken for said street by said commissioners or
appraisers is hereby appropriated out.of any funds in the hands of the
city treasurer, and that a warrant for such amount be issued by the clerk
to William Russell, the person entitled thereto and whose lands and lots
are so taken for such streetm, upon his filing.with the city clerk his
receipt therefor,
Sec. 3. This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal.
