1412 Sewer Improvements}:, (Published in the Salina Evening-Journa, April ", 1908) ORDINANCE NO. 14 4 v An ordinance providing for the construction of a certain sewer in the city of Salina, Kansas. Be it ordained' by the Mayor and Councilmen of the city of Salina: -- Section 1. That it is necessary and hereby ordered that a twenty- one (21) inch surface sewer, commencing at a point about ten (10) feet west of the west.line of Seventh street, running east on Walnut street to the center of Third street, thence along the center of Third street to and into the Smoky Hill River, in the the city of Salina, Kansas, be built and constructed, as in this ordinance provided. Sec'. 2. That the plans and specifications of the city engineer for such surdace sewer, -now on file with the city clerk, are hereby adopted and approved, and such plans and specifications are hereby incorporated in and made a part of this ordinance in all respects as if the same were written out, in full herein, and all the work and construction herein pro- vided for shall be done in accordance with such plans and specifications, and as provided in this ordinance, and all such -pork and construction shall be done under the direction and supervision of the said e�ty en- gineer of said city. Sec.. 3. That all man -holes, catch -basins, digging and trenching necessary for the proper construction of such sewer shall be built ad done and in accordance with such plans and specifications. Sec. 4. That after the passage and publication of this ordinance, the city clerk shall advertise for bids for the construction of said sewer, in the official city paper, for such time as the mayor and council may determine, and upon such conditions As the mayor alit eouncil may designate, and the contract for the building and construction of such sewer shall be let to the lowest responsible bidder, as determined by the mayor and council, the said mayor and council reserving the right to reject any and a l.bids,. Sec • 5. Thatvthe cost and expense of the construction of said sewer shall be assessed against all lots and pieces of ground contained in the city of Salina as a sewer district, as provided by Ordinance No. 613, passed and approved December 23, 1887, and that the mayor and council are hereby authorized to provide for the payment of the cost thereof by installments instead of levying the entire tax or special assessment at one time; and for such installments the mayor and council are hereby au= thorized to issue improvement bonds of the city of Salina, payable in installments of equal amounts each year, none of which bonds or any in- stallments thereof shall run longer then ten (10) years or bear interest exceeding five (5) per cent per annum. Such bonds may be issued to the contractor constructing such improvement, in payment thereof, or the mayor and council may sell such bonds,at not less than their par value, and pay the proceeds thereof to the contractor, and such bonds shall be of such denominations as the mayor and council shall deem proper. And. for the purpose of paying principal and interest on said bonds as they severally become dtae, the mayor and council shall each year, during the life of said bonds, levy an assessment against all.the real estate in the city of Salina in an amount sufficient to pay the principal and interest for that year; and the cil-y clerk shall certify, such assessments, as they are severally made, to the county clerk of Saline county, Kansas, at the same time and in the same manner as other city taxes are certified, and said assessments shall be liable to the same penalties as ail other taxes .
