ORDINANCE NO /V® 2 .
An ordinance providing for the construction of certain sewers in the
city of Salina, Kansas specifying the manner of construction
providing for the cost thereof and the manner of payment, and iet-
ing the contract therefor.
Whereas, specifications have been filed by the city engineer for the
construction of certain sewers in the city of Salina, Kansas, as herein-
after and in said specifications described; and,
Whereas, estimates of the cost;:" of each and all of said sewers have
been made by the city engineer and are now on file with the city clerk of
said city; and,
1hereas, the mayor and council of said city hereby declare that the
construction of said sewers is an improvement necessary to be made,
therefore,
Be it ordained by the Mayor and Councilmen of the city of Salina: --
Section 1. That the following described sewers, to -wit: A teh (10)
/xf�,'inch sewer on University place from Baker street west to a point east of
the right of way of the Missouri Pacific railroad; A twelve (12) inch
sanitary and surface sewer on Elm and Ninth streets and described as
follows: Commencing at the manhole at the junction of Wlm and Eighth
streets, running west about 295 feet to the junction of Elm and Ninth
streets, thence north along Ninth street about 700 feet to a point south
of the Missouri Pacific-, railway tracks; and a ten (10) inch lateral
,-. sewer on Walnut street from Phillips street west to the center of Col-
lege avenue; be built in the city of Salina, and that a contract therefor
be and is hereby let toat and for the total

given and specified in the proposal or bid of said- WQ-t� /��
now on file with the city clerk, which said proposal or bid is hereby
specially referred to herein and made a part of this.ordinance, said
price to cover and include all the cost of labor and material for con-

strutting and blilding said sewers according to the � ineer's plans
and sspecifications therefor, and which contract price is hereby found
not to exceed the cost of such improvements as estimated by the city
engineer's,,, which;estimate is now on file with the city clerk.
Sec. 2. That all such wor and improvements as contracted and pro-
vided for by section one of this ordinance shall be done in strict com-
pliance with the city engineer's specifications therefor now on file
with the city clerk, and in accordance with the instructions and direc-
tions of said city engineer made and given from time to time.
Sec..3. That the cost and expense of the construction of said
sewers shall be assessed against all lots and pieces of ground contained
in the city of Salina as a sewer district, as provided by Ordinance No.
613, passed and approved December 23, 1887, and that the mayor and coun-
cil are hereby authorized to provide for the payment of the cost thereof
by installments instead of levying the entire tax or special asseessment
at one time; and for such installments. the mayor and council .are hereby
authorized to issue improvement bonds of the city of Salina, payable
in installments of equal amounts each year, none of which bonds ornin-
stallments thereof shall run longer than ten years or bear interest
exeeeding five per cent per annum; Provided, that such bonds shall not
be issued in an amount in excess of the contract price for the work or
improvements, except that the installment coupons shall include the in-
terest on such installments until the maturity thereof; and, Provided,
further, that such bonds may be issued to the contractor constructing
such improvement in payment thereof, or the mayor and council may sell

Sec. 4. That the city attorney is hereby instructed to prepare a
