Gentlemen: ---I herewith return to you, with my disapproval and
veto, Ordin*nce No. being an ordinance providing for the con-
struction of certain sewers in the city of Selina, and give as xqy reasons
therefor:
1•
No
provision
has
been made
by the council
to meet the extra
expense
that
will have
to
be.paid by
the city during
the next year for
the construction of such sewers.
2. A part of the sewer provided for in said ordinance is nothing
more nor less than private sewer and if built should be paid for by the
fewv'individudls who would be benefitted by its construction.
3. A great deal of the swwer included in said ordinance is to be
constructed on streets where there -is no cite water and where there is
not likely to be any for some time in the future and where, therefore,
house connections cannot and w_-uld not 'be made.
4. Some of the sewer provided for in said ordinance is to be
built on streets where only a small per cent of the property owners
would connect, and when it is considered that there are so many streets
and sections of the city where sewers are badly needed and would he
generally connected with, it would be a piece of extravagance on the
part of the mayor and c ounc it to build any sewer or piece of sewer on
streets or places where its construction -would not be appreciated and
would not be or could not be connected with.

ORDINANCE NO.
An ordinance providing for the construction of certain sewers in the
city of Salina, Kansas, and letting the contract therefor.
Whereas, specifications have been filed by the city engineer for
the construction of certain sewers in the city of Salina, Kansas, as

hereinafterAdeser bed; and,
Whereas, xx estimates of the cost of each and all of said sewers
have been made by the said city engineer and are now on file with the
city clerk of said city; and
Whereas, the mayor and council of said city hereby declare that
the construction of said sewers is an improvement necessary to be made,
Therefore,
Be it ordained by the Mayor and Councilmen of the city of Salina:
Section 1. That the following described sewers, to -wit:
A ten (10 inch lateral sewer on Eleventh street from Irori avenue
oto Walnut street;
e/ A ten inch lateral sewer on University Place from Baker street
west to a point east of the right of way of the Missouri Pacific Railrapd
ten (10) inch lateral sewer on State street from the cerate of
lev nth street west to the center of College avenue;.
ten (10) inch lateral and drainage sewer on Tenth a

Elm street north to the tracks of the Missouri Pacific Ra; _�.
P/A twelve (12 ) inch sanitary and surface water sewer L on
Elm and Ninth streets described as follows: Commencing at the manhole
at the junction of Elm and Eighth streets, running west about 295 feet
to the junction of Elm and Ninth street, thence north along Ninth street
about 700 feet to a point south of the Missouri Pacific Railway tracks;
4/A ten (10) inch lateral sewer on Walnut street from'(?Wi4sstreet
west to the center of College avenue;
An eight (8) inch lateral sewer on Weil Place commencing at the
manhole at the intersection of Eighth street and Weil Place and thence
east on Weil Place to the east line of Seventh street.

therefor and laying the pipe therefor and the cost of all material furnish

proposal are hereby found not to exceed the cost of such improvements
as estimated by the said city engineer and now on file with the city
clerk.
Sec. 2• That all such work and improvements as contracted and
provided for by section one of this ordinance shall be done in strict
compliance with the city engineer's specifications therefor now on file
with the city clerk, and in accordance with the instructions and dired-
,tions of the city engineer and his assistant made and given from time
to time.
Sec. 3. That the cost and expense of the construction of said
sewers shall be assessed against all lots and pieces of ground contained
in the city of Salina as a serer district, as provided by Ordinance No.
613, passed and approved December 23, 1887, and that the mayor and
council are hereby authorized to provide for the payment of the cost
thereof by installments instead of levying the entire tax or special
assessment at one time; and for such installments the mayor and council
are hereby authorized to issue improvement bonds of the city of Selina,
payable in installments of equal amounts each year, none of which bonds
or any installments thereof shall run longer than ten years or bear
interest exceeding five per cent per annum, provided, that such bonds
shall not be issued in an amount in excess of the contract price for the
work or improvements, except.that the installment coupons shall include
the interest on such installments until the maturity thereof, and, pro-
vided, further, that such bonds may be issued to the contractor con-
structing such improvement in payment thereof, or the mayor and council
may sell the same at not less than their par value and pay the proceeds
thereof to the contractor.
See. 4. That'the city attorney is hereby instructed to prepare a
contract with the said ���- ►��---�' �� for the construction
of said sewers, in 'accordance.with this ordinance and the city engi-
neer's specifications therefor, and such contract shall be exeduted by the
mayor And city clerk on behalf of said city
