1383 Issue Improvement Bonds(Published in the Salina Evening Journal, Aug. , 1907) ORDINANCE NO.��� An ordinance providing for the issuance of bonds of the city of Salina, Kansas, in the sum of $ %�O,O®C� , to pay for the improve- ment of portions of Iron avenue in said city. Whereas, in pursuance of proceedings duly had and taken according to law, a contract has been let for the paving, excavating and curbing of Iron avenue, in the city of Salina, Kansas, between the west end of Iron avenue bridge over the. Smoky Hill River and the east line of Santa Fe avenue, and between the west line of Santa Fe avenue and the east line of College avenue, qnd the cost of such improvement to be paid by special assessments upon the lots and pieces of ground liable therefor has been ascertained, and said amount has been heretofore duly assessed and apportioned to the said several lots and pieces of ground, payable in ten equal annuallinstallments, according to law, and the amount for which bonds are to be issued in anticipation of said special assessments which remain unpaid has been ascertained and is hereby determined to be the sum of $ 12 0 ;and, Whereas, all legal requirements have been fully complied with to authorize the issuance of bonds.on account of said improvements, therefore Be it ordained by the Mayor and Councilmen of the city of Salina: -- Section 1. That there shall be issued, on account of said street improvements, a series of bonds of the city of Salina, to pay for that portion of said improvements for which special assessments are to be levied and assessed according to law upon all lots and pieces of ground liable therefor, in the sum of $ ® 0,00 which shall consist Of ��csof $ ® each,�"all bearing date of September lot, 1907, numbered from a* to viii, inclusive, bearing interest at the rate of five per cent per annum, payable semi-annually on the first days of March and September of each year, and shall become due as follows: $ 2000 e 41 �� September 1, 1908, and $ '0411f- `sqn the lot day of September in each and every year thereafter for a period of nihe years. Sec. 2. That said bonds shall be signed by the mayor and attested by the clerk of said city, and shall have the corporate seal of the city attached thereto, and the interest coupons to said bonds shall be signed by the city clerk, and both bonds and coupons shall be payable at the fiscal agency of the State of Kansas, in the city of New York, State of New York. Sec. 3. That said bonds shall be executed in the form and shall contain recitals substantially as follows: UNITED STATES OF AMERICA. State of Kansas. City of Salina. No. INTERNAL IMPROVEMENT BOND. KNOW ALL MEN BY THESE PRESENTS That the city of Salina, in the countyof Saline state of Kansas for value received, ereby acknowl- edgesitself tself to die indebted to andpromises to pay the earer the sum of Dollars, lawful money of the United States of America, on errsda yy of September, 19 , with interest thereon at the rate of five per ceni per annum, payab?e'semz-annuall , on the first day of March and September each year after the date hereof until the princi- pal sum shall have been ppaid upon the presentation and surrender -of the proper interest coupons hereto attached bearing the signature of the clerk of said'eity, as they severally become due and both principal and interest are_�ayable at the Fiscal Agency of the State of Kansas, in the city of New York State of New York- and the city of Salina is hereby held and firml Mound, and its fai;� and credit and all the real and personal property' in said city are hereby pledfpd for the prompt payment of the principal of this bond and the interes thereon at maturity. This bond is one of a series of bonds of like date and tenor issued by.the said city of Salina to. ay for street improvements in and for said city under and by authority of .and in corrliance with the provisions of the laws of the State of Kansas overning cities of the second class of less than ten thousand inhabitants, and in compliance with an ordi- nance duly and legallypassed by the mayor and council of said city on the 19th day of Augus1907.. i Ahd it s hereb declared and certified that all acts, conditions and things required L be done and to exist precedent to and in the issuing of this bond have been properly done and performed and do exist in r®g�lar and due form as required by im the constitution and laws of the State of Kansas, and that the total indebtedness of said city including this series of bonds, does not exceed any constitutional or statutory limitations. In Testimony Whereof, said city of -Salina, by its mayor and council, kas caused this bond to be si ed by its mayor and attested byy its clerk, and its corporate seal to be hereto affixed and this bond to be dated the first day of September, 1907. ._ Attest: aYj C1 Ey Clerk. Sec. 4. That the interest coupons to be attac d to said.bonds shall be substantially in the form following, to -wit; NO. INTEREST COUPON. On the first day of, 19. the city of Salina Kansas, will Rthe bearer �doll�ars a��ie Fiscal .Agency of the State of Kansas, in the ci o ew York, Mate of New York, being six months' interest on its Internal Improvement Bond dated September 1, 1907. Sec. 5. That the mayor and city clerk are hereby authorized, with- out unnecessary delay, to prepare and execute said bonds and coupons, and that when executed they shall be registered with the city clerk of . the city of.Salina, the county clerk of Saline county, Kansas, and by the auditor of state of the State of Kansas, asrequired by law, and shall be by the mayor of said city delivered to the contractors, making such im- provements, Haskins &`v Ramsey, in payment for so much of the improve- ments made, or the mayor and council may sell said bonds and out of the proceeds thereof pay said contractors, and that the mayor and council shall annually make provision for the payment of the principal and interest of said bonds, as the same shall become due, by levying a tax upon the property , Liable therefor.
