2244 Improve Gypsum AvenueORDINANCE NO. 2244 , (Published in the'Salina Daily Union April 1919) An ordinance providing for the paving, curbing, guttering and, excavating of certain streets in the city of Salina, Kan- sas, specifying the manner of construction, providing for the cost thereof and the manner of payment. WHEREAS, a petition has been presented to the Mayor and Council requesting said Mayor and Council to pave, curb, gutter, excavate and grade Gypsum Avenue from the east line of Front Street to the west line of C olumbia. Avenue ; and Phillips Street from the'south side of Walnut Street to the north side of South Street; and Second Street from the south side of Iron Avenue south a distance of 400 feet, and WHERFAS, said petitions have been examined and found to contain the names of a majority of the resident owners of real property liable to taxation, and WHEREAS, a resolution was duly passed and approved by the Mayor and Council of the City .of .Salina upon January 20th, 1919, for the paving, curbing, guttering, excavating and grad- ing of Third Street from the north line of Ash Street to the south line of Elm Street in said City, and WHERFAS, within the time allowed by law therefor no pro- test was entered or filed against any of such work and improve- ments, Now Therefore, ' Be it Ordained by the Mayor and Councilmen of the City of Salina; Section 1. That it is necessary and hereby ordered that Gypsum Avenue in the city of Salina, Kansas, from the east line of Front Street to the west line of Columbia Avenue, and Third Street from the north line of Ash Street tv the south line of Elm Street; and Phillips Street . from the south side of Walnut Street to the north side of South Street; and Second Street from thesouth side of Iron Avenue South a distance of 400 feet,, in said City be paved with such material as the Mayor and Coun- oil may hereafter designate as hereinafter provided, such paving to be of such width as the Mayor and Council shall hereafter de - termine and shall extend to the lot line on such streets at the intersection of such streets with any other streets or alleys. Section 2. It is necessary and hereby ordered that said streets,,within the limits aforesaid, be curbed and guttered on bdth sides thereof with cement curb and gutter, the curb part thereof to be six (6) inches in thickness and the gutter part thereof oto be forty-two (42) -inehes in width from the back`"edge of such curbing and guttering to the paving line on said streets. The lot line edge of such curbing and guttering shall be set such a distance from the center of said streets as the Mayor and Coun- oil shall hereafter determine; Provided, however, that at t he :•r 1 1 1 � 1 1 1 F, 1 C intersection of such street with any other streets or alleys such curbing and guttering shall return to the lot line of such streets. Section 3. All excavating, rolling and grading for the proper construction of such paving, curbing and guttering shall be laid and constructed on the established grade of said Streets as heretofore or hereafter established by the ordinances of the Eity of Salina. Section 4. The City Engineer's plans and specifications and estimates of cost for the making of the improvements herein provided for, filed with the City Clerk on the 7th day of April, 1919, are hereby adopted and approved by the Council. Section 5. The Mayor and Council shall hereafter by ordin- ances determine the kind of paving, curbing and guttering to be placed on the above described streets, and shall let a contract for the construction of such paving, curbing and guttering to the most satisfactory and responsible bidder or person. Section 6. After the passage and publication of this ordin- ance the Mayor and Council shall appoint three disinterested house holders of the City who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment and taxation for the.cost of said improvements, shall within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable to taxa- tion for such improvements, without regard to the improvements thereon, and after making such appraisement, shall return the same to the Mayor and Council, and after such appraisement is returned to the 1. Mayor and council, the said Mayor and Council shall desig- nate a time for holding a special session for the purpose of hear- ing complaints and equalizing sand appraisements, of whichspectl, segsion, due notice shall be given in the official City paper, and at said special session the Mayor and Council shall, if they deem it just and proper, later or change such appraisement. e Section 7. For the purpose of paying for such paving, curb - Ing, guttering, excavating and grading, the Mayor and Council are hereby directd_d and authorized to issue bonder of the City of Salina, in an amount not to exceed the contract price therefor, and to run for such a period of time as the Mayor and Council shall determine, not to exceed, however, ten years from the date of such bonds, and to be payable in equal amounts each year during the life of such 286 bonds, together with interest not to exceed the rate of five per cent per annum, which bonds shall be payable at the fiscal agency of the State of Kansas, and for the purpose of paying the principal and interest on such bonds as they severally be- come due, the Mayor and Council shall each year during the life of such bonds, levy assessment against the lots and pieces of ground liable for taxation for the improvements herein provided for, in an amount sufficient to pay the principal and interest for that year; Provided, that for the purpose of defraying the cost of paving and excavating the squares and areas formed by the .,:, crossing of the streets and alleys, as well as where the improve- ment is through ,or adjacent to City property, for which the City would be liable, the assessment shall be made against all of the to'xable property of the City, and the CityClerk shall certify said asseessments as they are severally made, to the County Clerk of Saline County, Kansas, at the same time and in the same man- neras other taxes are certified, and said assessments shall be liable to the same penalties'as other taxes; Provided that the Mayor and Council shall by ordinance apportion and assess the special assessments aforesaid against the lots and pieces of ground in the taxing districts for said improvements, which assessments and apportionment shall hold good for all the in- stallments that are to be collected from the specific property chargeable with said improvements. Section 8. This ordinance shall take effect and be in full force from and after its publication once in the official C it y ` paper. Passed and approved this 7th day of April, 1919.
