2243 Improve Alley (7th & 8th)1 1 1 1 ORDINANCE N©. 2243 (yublished in -the Salina D4ilynit ntoal Apr11 1919) An ordinance providing for the paving, excavating and grading of certain alleys in the city of Salina, Kansas, speci- fying the manner of construction, providing for the cost thereof and the manner of payment. WHEREAS, resolutions have been duly passed and approved by the Mayor and Council of the city of Salina, Kansas, for the paving, excavating and grading of the alley between Seventh and Eighth Streets in said City from the north line of Iron Avenue to the south line of Ash Street; and the alley between Santa Fe Avenue and Seventh Street from the north line of Ash Street to the south line of Elm Street, which said alleys are intervening alleys between streets already graded, paved and excavated, and neither of said alleys so to be paved ex- ceed in length two blocks, Now Therefore, Be it Ordianed by the Mayor and Councilmen of the City of Salina Section 1. That it is necessary and is hereby ordered that the alley between Seventh and Eighth Streets in said City from the north line of Iron Avenue to 'the south line of Ash Street; and the alley between Santa Fe Avenue and Seventh Street from the north line of Ash Street to the south line of Elm Street in said City be paved, with such material as the Mayor and Council may hereafter designate as hereinafter pro- vided, such paving to be of such width as the Mayor and Coun- cil shall hereafter determine. Section 2. All excavating, rolling and grading for the prope4 construction of such paving shall be laid and construct- ed on the established grade of said streets as heretofore or hereafter established by the ordinances of the City of Salina. Section 3. The City Engineer's plans and specifications and estimates of cost for the making of the improvements'here- in provided for filed with the City Clerk on the 7th day of April, 1919, are hereby adopted and approved by the Council. Section 4. The Mayor and Council shall hereafter by ordinance determine the kind of paving to be placed on the above described streets, and -shall let a contract for the construction of such paving to the most satisfactory and responsible bidder or person. 282 CO Section 5. After the passage and publication of this ord- inance the Mayor and Council shall appoint three disinterested householders of the City who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment and taxation for the cost of said improve- ments, shall within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable to taxation for such improvements, without regard to the improvements thereon, and after making such appraisement is shall return to the Mayor and Council, and after such appraisemrnt is returned to the Mayor and Council, the said Mayor and Council shall designate a time for holding a special session for the pur- pose of hearing complaints and ewualizing said appraisements, of which special session, due notice shall be given in the official City paper, and at said special session the Mayor and Council shall, if they deem it just and proper, alter or change such ap- praisement . Section 6. For the purpose of paying the cost of such pav- ing, excavating and grading, the Mayor and Council are hereby directed and authorized to issue bonds of the City of Salina, in an amount not to exceed the contract price therefor, and to run for such a period of time as the Mayor and Council shall deter- mine, not to exceed; however, ten years., from the date of such bonds, and to be payable in'equal amounts each year during the life of such bonds, together with interest not to exceed the rate of five per cent per annum, which bonds shall be payable at the fiscal agency of the State of Kansas, and for the purpose of pay- ing the principal and interest on such bonds as they severally be- come due, the Mayor and Council shall each year during the life of such bonds, levy assessments against the lots and pieces of ground liable for taxation for the improvements herein provided for, in an amount sufficient to pay the principal and interest for that year; Provided, that for the purpose of defraying the cost of paving and excavating the squares and areas formed by the cross- ing of the streets and alleys, as well as where the improvement is through or adjacent to City property, for which the City would be liable the assessment shall be made against all of the taxable property of the City, and the City Clerk shall certify said assess- ments`as they are severally made, to the County Clerk of Saline County, Kansas, at the same time and in the same manner:aas other taxes are certified, and ,said assessments shall be liable to the same penalties as other taxes; Provided that the Mayor and Coun- 1 1 �7 1 1 u d 1 1 1 A I cil shall by ordinance apportion and assess the special assess- ments aforesaid against the lots and pieces of ground in the taxing districts for said improvements, which assessment and apportionment shall hold good for all the installments that are to be collected from the specific property chargeable with said improvements.
