2240 Sewer ImprovementsA ORDINANCE NO. 2240 (-`ublished in the Salina Daily Union March 1919) An ordinance providing for the construction of certain sew- ers in the City of Salina, Kansas, letting the contract therefor, and providing for the payment of the cost of the same. WHEREAS, plans and specifications for certain sewers hereinafter described have been made and prepared by the City Engineer, filed with the City Clerk and adopted by the Mayor and Council upon March 3, 1919, and WHEREAS, one C. T. Snyder, for and. in consideration of the payment of the sum hereinafter mentioned has agreed to construct the same in accordance with such plans and specifi- cations, Now Therefore, BE IT ORDAINED by the Mayor and Councilmen of the City of Salina:. Section 1. That the Mayor and Council deem it necessary and hereby order that sewers be built and constructed and man- holes and catchbssins be built and constructed thereon at and. for the price and prices mentioned hereinafter, such sewer,to be laid and installed on Second Street beginning at the pres- ent stub on the south side of Iron Avenue, thence south approxi- mately three hundred ninety-six (396) feet, and upon Third Street,, commencing at the present stub on the south line of Iron -Avenue, thenve south for a distance of approximately Two Hundred Sixty -Five (265) feet. Catchbasins •and manholes ` t'n ' be constructed at the places and in accordance with the plans and specifications of the City Engineer hereinbefore referred to, which said plans and specifications are hereby made a part of this ordinance as fully as though written out at length herein. Section 2. The said C. T. Snyder, shall be paid for the construction and installation of such sewer the sum of One ($1.00) Dollar per lineal foot, for the actual amount of such sewer laid and constructed. He shall be paid the sum df Forty (40.:00) for each manhole so built and constructed. Sec. 3. -The plans and specifications of the said City Engineer of Salina, Kansas, for the sewers above described, dated March 3rd2 1919, and now on file with the City Clerk are -h"ereby adopted and approved as and for the plans and specifications for such sewers .and are hereby made a part of this ordinance. All work herein specified and described shall be done in ac- cordance with the plans and specifications and under the di- rection of the City Engineer. 1 1 1 1 Section 4. The contract is hereby let to C. T. Snyder for the building and construction of the sewers, catchbasins and manholes heretofore described at and for the prices here- inbefore mentioned. Section 5. It is hereby found and determined that the prices hereby agreed to be. paid for each of said sewers, catch - basins and manholes, is lets than the estimated cost of such sewers,.catchbasins, and manholes, and the estimates made by the City Engineer therefor, and now on file with the City Clerk. Section 6. The person to whom said contract is awarded as aforesaid, shall execute a written contract with the said City for the purpose of building such sewers, catchbasins and manholes as aforesaid, and shall file with the City Clerk a good and suf- ficient bond in tht total sum of said contract, conditioned that he will build such sewers according to said specifications; that he will re -fill the ditches made in the streets and alleys under which such seders shall be laid and constructed; that he will fulfill the guarantee required -in said specifications; and that he will hold and save harmless the City of Salina from all dam- age to persons and property which may arise through the careless- ness or neglect of said contractor or his servants and employ- ees; that he will protect said City from all liens or claims for labor and material used and employed in the building of such sewers, Section 7. The cost and expense of constructing such sewers shall be assessed against all lots and pieces of ground contained in the City of Salina as a sewer district, as provid- ed by -Ordinance No. 613,_. passed and approved December 23rd, 1887, and the Mayor and Council are hereby authorized to provide for the payment of the cost thereof by installments instead of levy- ing the entire tax or special assessments at one time, and for such installments they may issue Sewer Improvement Bonds of the City of Salina, payable in installments of equal amounts each year, none of which bonds nor the installments thereof shall run longer than ten years or bear interest exceeding five per cent per annum, and such bonds may be delivered to the -contractor building such sewers in payment thereof, or the Mayor and Coun- cil may sell said bonds at not less than their par value and pay said contractor out of the proceeds thereof, and for the purpose of paying principal and interest on said bonds, as they sever- ally become due, the Mayor and Council shall each year, during 276 CAD the life of said bonds, levy -an assessment or special tax against all taxable real estate in said City at the assess- ed value thereof for general revenue purposes, in an amount sufficient to pay the principal and interest of said bonds for that year ; and the City Clerk shall certify said assess- ments and special taxes as they are severaly made and levied as aforesaid, to the County Clerk of Saline County, Kansas, at the same time and in the same manner as other taxes of said City are certified. Section 8. That said contractor shall properly refill all excavations made in the construction of the above describ- ed sewers according to the plans and specifications of the City Engineer thereofrand shall properly refill said excaations if any sinking or depression appears therein within a period of one year after the acceptance of said sewers by the afore- said City.
