2229 Issue Sewer Bonds245 ORDINANCE NO. 2229 (Published in the Salina Daily onion December 1918) An ordinance providing for the issuance of Sewer r Im iogovement Bonds of the City,of,,,Sal;a, the f,632.55 WHEREAS the Mayor and Council of the City of Salinas Kan- sassas have caused to be built and constructed certain sewers in said City as provided in Ordinance.No. 2227, the total price of which is in excess of 5,632.55; Now, Therefore, Be it ordained by the Mayor and Councilmen of Salina, Kansas: Section 1. That the cost of such sewers shall be payable in ten (10) annual installments instead of levying the entire taxes for'such cost at one time, the first installment of which is to be paid with the taxes for the year 1919 and one installment each year thereafter until the whole of such sum is paid and that for such installments there shall be issued Sewer Improvement Bonds of the City of Salina, in the total sum of $5..632.55., as herein provided. Sec. 2. Said issue of bonds shall consist of eleven (11) bonds of the denomination of Five e u d H n red500 00 (� ) Dollars each and one bond of the denomination of One Hundred Thirty-two and 55/100 (132.55) Dollars. They shall be dated January 1st, 1919 and payable as follows: $1,132.55 on the first day of January, 1920 and $500.00 on the first day of January in each year thereafter for a period of nine (9) years. Sec. 3. Said bonds shall bear interest at the rate of Four and three-quarters (4-3/4%) per cent per annum, such interest to u be payable semi-annually on the first day of January and July of each year. Such bonds shall have interest coupons attached and both bonds and coupons shall be payable at the fiscal agency of the State of Kansas in the City of Topeka, Kansas, Sec. 4. Said bonds shall be s . i geed b the mayor and y y attested by the Clerk of the City of Salina, Kansas and shall have the cor- porate seal of the said City attached thereto. Interest coupons to said bonds shall be signed by the said Clerk. Sec. 5. Said bonds shall be executed in the form and shall contain recitals substantially as follows: i 24 6. UNITED STATES OF AMERICA STATE OF KANSAS. CITY OF SALINA. NO. KNOW ALL VEN BY THESE PRESENTS, That the City of Salina, in the County of Saline and State of Kansas, for value re- ceived hereby acknowledges itself to be indebted and promises to pay the sum of , in lawful money of the United Stated of America on the first day.of A. D. 19 , with interest thereon at the rate of four and three-quarters per cent per annum, the first installment of which shall be payable July, first 1919, and interest payable semi- annually thereafter on the first day of January and July of each year after the date hereof until the principal sum shall have been paid, upon the presentation and surrender of the proper interest coupon thereto attached., -bearing the signature of the Clerk of said City, as they severally be= come due and payable. Both principal ' and interest are paya- bel at the Fiscal Igency of the State of Kansas in the City of Topeka, Kansas,"and the City of Salina, Kansas, is held and firmly bound and its faith and credit and all real and personal property in said City are hereby pledged for the prompt payment of the principal and interest of this bond upon their maturity.. This bond is one of a series of bonds of like date and tenor issued by said City of Salina. Kansas, to pay for Sewer Improvements in and for said City under and by the authority of and in compliance with the provisionf of the laws of the State of Kansas governing cities of the sec- ond class, and in compliance with an ordinance duly and legal- ly passed by the Mayor and Council of said City on the 16th day of December, A. D. 1918. And it is hereby declared and certified that all acts, conditions and things required to be done and to exist precedent to and in the issuance of this bond, have been properly done and performed and do exist in regular and due form as required by the.constitution and laws of the State of Kansas, and that the total indebtedness of said City, including this series of bonds does not exceed any consti- tutional or statutory limit. IN WITNESS WHEREOF, said City,of"Salina, by its Mayor and Council has caused this bond to be signed by its Mayor and attdsted by its Clerk and its corporate seal hereto attached. Dated this lst day of January, A. D. 1919. Attest: Mayor. City Clerk. Sec. 6. The interest coupons "to 'be attached to said bonds shall be substantially as follows: NO. On the first-day of , 19 , the City of Salina, Kansas, will pay to the bearer , at the fiscal agency of the State of Kansas, in the City of To- peka, Kansas, the same being six months° interest on its Sewer Improvement Bond dated January 1st, 1919. The Mayor and Clerk are hereby authorized, and directed to prepare and execute, as soon as practicable, the said bonds herein provided for, therein pledging the credit of C methereof,x the said City for the payment and when executed, said bonds shall be by the Mayor and Councilmen sold, for not less than their par value and out of the proceeds thereof shall be paid the cost of building and constructing the sewers aforesaid; and the Mayor and Council shall make provisions annually for the payment of the principal and interest of said bonds as the same shall become due, by levying an assessment on the property liable therefor.
