2227 Sewer Improvements1 1 1 1 1 .237 ORDINANCE N0. 2227 (Published in the Salina Daily IInion December 1918) An ordinance providing for the construction of certain sewers in the City of Salina,, Kansas, letting the contract therefor and providing, for tho payment of the cost thereof. WHEREAS plans and specifications for certain sewers herein- after described have been made and prepared by the City Engineer and have been approved by the Mayor and council, and WHEREAS, an estimate of the price of said work has been filed in the office of the City Clerk by the City Engineer of said City, and WHEREAS, a bid for the construction of said sewer for said City has been made and is now on file with the City Clerk of said Therefore, City, Now., Be it .ordained by the Mayor and Councilmen of the City of Salina: Section 1. That the Mayor and Council deem it necessary and hereby order that the following sewer be -built and constructed and the following manholes and catchbasins be built and constructed by the city of Salina, Kansas, to -wit: 1. 600 feet of ten (10) inch sewer in the alley between Republic Avenue and Beloit Avenue commencing at the manhole on Highland Avenue and running thence West across Ninth Street at and for the price of $1.31 per lineal foot for the number of feet of such sewer actually built and constructed. Two manholes at and for the price of 40.00 each. One �'atchbasin including top and brick work at and for the price of $28.00 25 feet of eight (8) inch pipe from manhole to catchbasin at and for the price of 60¢ per lineal foot for the amount actually used therefor. 2. 200 feet of ten (10) inch sewer on Ninth Street in line with the alley between Beloit and Minneapolis Avenues thence west across Ninth Street at and for the price of $1.31 per lineal foot for the number of feet of such sewer actually built and constructed. One catchbasin including top and brick work at and for the price of $28.00 30 feet of eight (8) inch pipe from manhole to catchbasin at and for the price of 60g per lineal foot for the amount actually used therefor. 3. 600 feet of ten (10) inch pipe in the alley between Minnea- polis inneapolis and Ellsworth Avenues commencing at the present manhole on Highland Avenue thence west across Ninth Street at and for the price of $1.31 per lineal foot for the number of feet actually built and constructed. One manhole at and for the price of $40.00 One catch - basin including top and brick work at and for the price of $28.00 25 feet of eight � ( 8 ) inch pipe from catchbasin to manhole at and for the price of 60¢ per lineal foot for the amount actually used therefor. 238 4 4. 600 feet of ten (10) inch sewer in the alley between Ellsworth and Jewell Avenues commencing at the present manhole on Highland Avenue thence west across Ninth Street at and for the price of $1.31 per lineal foot for the number of , geet. of such sewer actually built and constructed. One manhole at and for the price of $40.00 One catchbasin including top and brick work at and for the price of $28.00 25 feet of eight (8) inch pipe from manhole to catchbasin at and for the price of 50¢ per lineal foot for the amount actually used therefor. 5. 510 feet of ten (10) inch sewer in the alley between Minneapolis and Beloit Avenues commencing at the end of the present sewer at the west line of Santa Fe Avenue thence west to the manhole on the Highland Avenue sewer at and for the price of $1.31 per lineal foot for the number of feet of such sewer actually built and constructed. 6. 300 feet of ten (10) inch sewer in the alley north of Walnut Street commencing at the present manhole on Baker Street thence east in the alley to -Faulkner Street at and for the price of $1.31 per lineal foot for the number of feet actually built and constructed. One manhole at and for the price of $40.00 7. 600 feet of ten (10) inch, sewer on Eighth Street north of Elm Street. commencing at the end of the present sewer on Eighth Street at the north line of Elm Street thence north on Eighth Street at and for the price of $1.31 per lineal foot for the number of feet of such sewer aftually built and con- structed. Two manholes at and for the price of $40.00 each. Two catchbasin including top and brick work at and for the price -of $28.00 each. 60 feet of eight (8) inch pipe from the catchbasin to manhole at and for the price of 60¢ per lineal foot for amount actually used therefor. 8. Two catchbasin on the south side of Grand Avenue at Tenth Street including top and brick -work at and for the price of $28.00 each 70 feet of eight (8) inch pipe from present mamhole to catchbasin at and for the price of 60¢ per lineal for the amount actually used therefor. 1 1 Ci 1 1 1 A 1 1 239 9. 475 feet of twelve (12) inch sewer 110 feet west of Ninth Street commencing at Pacific Avenue and running north to Harsh Street and for the price of $1.31 per lineal foot for the number of feet of such sewer actually built and constructed. One man- hole at and for the price of $40.00 Two catchbasins including top and brickwork at and for the price of $28.00 each. to 50 feet of eight (8) inch pipe from catchbasin to manhole at and for the price of 60¢ per lineal foot for the amount actually used therefor. -See. 2. The plans and specifications of the City Engineer of said City of -Salina.. for the above described sewers, dated November 18th, 1918 and now on file with the City Clerk are here- by adopted and approved as and for the plans and specifications for the construction of the above described sewers and parts of sewers and such plans and specific ations are hereby made a patt of this ordinance as fully as if set out at length herein, and all work and improvements herein specified shall be done in strict accordance with such plans and specifications and under the direc- tion of the laity Engineer aforesaid. Sec. 3. That a contract be and is hereby let to M. R. Amdr- man for the building and construction of the sewers and parts of sewers hereinbefore specified at and for the prices hereinbefore' specified; such prices to include and cover all labor and material necessary for the proper construction and completion of all of said sewers and parts of sewers, all of such sewers and parts of seweu; in place as a part of the sewer system of the City and as speci- fied in the said plans and specifications for the construction thereof. Sec. 4.. Said M.R. Amerman shall execute a written contract with said 4ity for the building and construction of said sewers ad parts of sewers according to the terms of said plans and specifi- cations and this ordinance, and shall file with the City Clerk good and sufficient bonds to said City, in such amount, not exceeding the total amount of said contract pri'vee, as the Mayor shall direct, conditioned that they will build and complete such sewers acc ordin g to the said plans and specifications; that they will properly re- fill the ditches made by them for the construction of such sewers according to the ordinances of the City; that they will fulfill the guaranty set out in the above mentioned plans and specifications that they will hold and save harmless the City of Salina from All damage to persons or property which may arise be reason of the: 9AO construction of sewers and parts of sewers or through the care- lessness or neglect of such contractor, his servants or employ- ees; and that they will protect the said City from and against all liens for labor or material used and employed in the build- ing and construction of such sewers and parts of sewers. Sec. 5. The cost and expense of constructing and completing such sewers and parts of sewers shall be assessed against all lots and pieces of ground contained in the City of Salina as a sewer district as provided by Ordinance No. 613 passed and approved De- cember 23, 1887, and the Mayor and Council are hereby authorized to provide for the a payment therefor by installments instead of levying the entire cost thereof as one special assessment at one time, and for such installments they may issue sewer improvement bonds of the Uity of "'alina, payable in installments of equal amounts each year, none of which bonds nor the installments there- of shall run longer than ten years nor bear interest exceeding five per cent per annum, and such bonds may be delivered to the contractors constructing such sewers in payment thereofr, or the Mayor and Council may sell such bonds at*not less than their par value and pay said contractors s out of the proceeds thereof, pro- vided that if said bonds be sold and the contractor paid the pro- ceeds thereof then that the total contract price of the work and improvements covered herein shall be subject to a discount of four (4%) per cent. For the purpose of paying principal and in- terest on such bonds,, as they severally become due, the Mayor and Council shall each year during the life of such bonds levy a tax or special assessment against all taxable real property in said City of Salina, at the assessed value thereof for general revenue pur- poses, in an amount sufficient to pay the principal of such bonds for that year, and the City Clerk shall certify said assessments and special taxes as they are severally made and levied as afore- said to the County Clerk of Saline County, Kansas, at the same time and in the same manner as other taxes of said City are certified. Sec. 6. The said contractors shall properly re -fill all exca,�ations made by them in the construction of such sewers accord- ing to the plans and specifications of the City Engineer aforesaid and shall property re -fill such excavations if any sinking or de- pression appear therein within a period of one year and after the acceptance of said Sewers by said City. 1 �1_ 1 1 1 from and after its publication once in The Salina Daily Union.
