(rublished in the Salina vaily union June 8th, 1918.) s,n ordinance providing for the paving and excavating and grad- ing of Penn .avenue in the city of Salina, Kansas, from the north line of Iron avenue to the north. line of Ash Street; specifying.the manner of construction, providing for the cost thereof and the manner of payment. WHERFAS, a petition has been presented to the Mayor and Gouncil requesting the excavating, grading and paving of kenn Avenue in the City of Salina, Kansas, from the north line of Iron Avenue to the north line of Ksh Street; and WHEREaZ, said petition has been examined and found to con- tain the names of a majority of resident owners of real property liable to taxation therefor, Now, Thereofore, be it ordained by the Mayor and Councilmen of the City of saliva: Section 1'. That it is necessary and hereby ordered that Penn Avenue, from the north line of .Iron avenue to the north line of -ash Street in the city of Salina, Kansas, be excavated, graded and paved with such material as the Mayor and Council shall hereafter select and designate, such paving to be of such width as the Mayor and Council shall hereafter determine and at the intersection of such street; with any other street or al- ley shall extend to the lot line . Sec. 2. all excavating, rolling, and grading for the proper construction of said paving shall be.done and such paving shall be laid and constructed on the established grade of such street as hr retofore or hereafter established by the ordinances of the City of Salina. Sec. 3. The City Engineer's plans and specifications and estimates of the cost for the making of the improvements here- in provided for, filed with the City Clerk on the 3rd day of June, 1918, are hereby adopyed and approved by the Council. See. 4. The Mayor and Council shall hereafter by ordinance determine the kind of paving to be placed on the above described street and shall let a contract for the construction of the excavating, grading and paving to the most satisfactory and re- sponsible bidder or person. Sec. 5. 'after the passage and publication of this ordin- ance the Mayor and Council shall appoint three disinterested householders of the'City, who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment and taxation for the cost of said improve - ments, shall, within ten days after having been notified of their 1 1 1 1 1 1 1 appointment, proceed to appraise Aa.id Zdtt and pices of ground liable t o,taxation for such improvements, without regard to the buildings or improvements thereon, and after making, shall return to the Mayor and Council, and, after such appraisement is returned to the Mayor and Council, the said Mayor and Council shall desig- nate a time for holding a special session for the purpose of hear - Ing complaints and equalizing said appraisements, of which special session due notice shall be given in the official City paper, and at said special session the Mayor and Council, shall, if they deem it just and proper alter or change such appraisment. See. 6. For the purpose of paying for such excavating, grad - Ing and paving the Mayor and Council are hereby directed and auth- orized to -issue bonds of the City of Saline in an amount not to exceed the contract price therefor and to run for such a period of time as the Mayor and Council shall determine, not to exceed gowever, ten years from the date of such bonds and to be payable in equal amounts each year during the life of the bonds, together with interest not to exceed the rate of five per cent per annum. Such bonds shall be payable at the fiscal agency of the State of Kansas and for the purpose of paying the principal and o interest thereon as the bonds severally become due and payable, the Mayor and Coun- c1l shall each year, during the life of the bonds levy assessments against the lots and pieces of ground liable to taxation for the improvements herein provided for in an amount sufficient to pay the principal and interest for that year, provided that for the pur- pose of defraying the cost of excavating, grading and paving the squares and areas formed by the crossing of streets and alleys as well as where the improvement is through or adjacent to City property for which the City would be liable, the assessment shall be made against all of the taxable property of- the City. The City Clerk shall certify such assessments as they are severally made to the County Clerk of Saline County, Kansas, at the saem time and in the same manner as other taxes are certified and the assessments shall be liable to the same penalties as other taxes, and provided furth er, that the Mayor and Council, shall by ordinance apportion and assess the special assessments aforesaid against the lots and pieces of ground in the taxaing district for said improvement, which assess- ment and apportionments shall hold good for all the installments that are to be collected from the speefici porperty chargeable therewith. 52 Sec. 7.
