Ordinance No.
An ordinance providing for the construction of certain sewers in the
City of Salina, Zansas, letting the constrict therefor and provid-
ing for the payment of the cost of the same.
WHEREAS, plans;and specifications for certain sewers
hereinafter described have been made and prepared by the City Engin-
eer and approved and adopted by the LTayor and Council, and
'IfflEREAS, bods for the construction of such sewers
have heretofore been had by the said City and.are now on file with
the City Clerk;
NOw THEREFORE, Be fit Ordained by the Mayor and
Council of the City of Salina, Kansas;
Section 1. That the I,Iayor and Council deem it nee-
essary and hereby order that sewers be built and constructed and
man -holes and catch basins be built and constructed thereon at and
for the price and prices mentioned in the bid and proposal of M. R.
Imerman dated April 1, 1918 and opened and considered by the Idayor
and Councilmen of said City on April 1'.'), 1918. The sewers so to "be
built and constructed to be of vitrified clay pine, double strength
and the.man-holes to be.of brick as provided in Section 16 of said
proposal; catch basins to be as described and the brick work there-
for constructed as provided for in Sections 1'7 and 18 of such proposal
and the price to be paid forA to be the amount specified in said
proposal for such work less four (4') per cent. Said proposal and bid
being referred to and incorporated in this ordinance as fully and
completely as though written out at length herein.. t.
Section 2. The -plans and specifications of the said
City Engineer of Salina, iansas, for the sewers above described, dated
March 4th, , 1918 and now on file with the City Clerk are hereby
afopted and approved as and for the plans and specifications for such
sewers and are hereby made a part of this ordinance. All work herein
specified and described shall be done in accordanee,with the plans and

lments ofequalamounts each year, none of which bonds nor the in..?
stallments thereof shall ran -longer than ten years or bear interest
exceeding five per -cent per annum, and such bonds may be delivered to
the constractor building such sewers in payment thereof or the Mayor
and Council may sell.baid bonds at not less than their par value and
pay said contractor out of the proceeds thereof, and for the purpose
of, paying principal and interest on said bonds, as they severally be-
come due, the Ilayor and Council shall each year, during the life of
said bonds., levy an assessment or special tax against all taxable real
estate in said City -at the assessed value thereof for general revenue
par -pose, in an amount sufficient to pay the principal and interest of
said bonds for that year, and the City blerk shall certify said assess-
ments and 'special taxes as they are severally I made and levied as afore-
said, to the County Clerk of Saline County, Zansas', at the same time'an,;7L
in the same manner as other taxes of said City are certified.
Section 7. That said contractor shall properly refill
all excavations made in the construction of the above described sewers
according to the Plans and specifications of the City Engineer therefor
and shall properly refill said excavations if any sinking or depression
appears therein within a period of one year after the acceptance of
said sewers by the aforesaid City.
Section 8. This ordinance shall take effect and be
in force from and after its publication once in the Salina Daily Union.

An ordinance providing for the construction of certain sewers in
the City '*of ' Salina, Kansas, letting the contract therefor
and providing for the payment of the cost of the same.
WHEREAS, plans and specifications for certain sewers herein-
after described have been made and prepared by the City Engineer
and approved and adopted by the Mayor and Council, and
WHEREAS, bids for the construction of such sewers have
heretofore been had by the said City and are now on file with
the City Clerk; Now, Therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That the Mayor and Council deem it necessary
and hereby order that sewers be built and constructed and manholes
and catchbasins be built and constructed thereon at and for the
price and prices mentioned in the bid and proposal of M. R. Amer-
man dated April lst, 1918, and opened.and considered by the Mayor
and Councilmen of said City on April 1st , 1918. The sewers so
to be built and constructed to be of vitrified clay pipe, double
strength and the manholes to be of brick as provided in Section
16 of said proposal; catchbasins to be as described and the brick
work therefor constructed as provided for in Sections 17 and 18 of s
proposal and the price to be paid for all of such to be the amount
specified in said proposal for such work less four (4) per cent.
Said proposal and bid being referred to and incorporated In this
ordinance as fully and completely as though written out at length
herein.
Sec. 2. The plans and specifications of the said City En-
gineer of Salina, Kansas, for the sewers above described, dated,
March 4th, 1918, and now on file with the City Clerk are hereby-

such sewers and are hereby made a part of this ordinance. All work
herein specified and described shall be done in accordance with.
the plans and specifications and under the construction of the
City Engineer.
Sec. 3. The contract is hereby let to M. R. Amerman for
the building and construction of the sewers, catchbasins and man-
holes heretofore described at and for the prices hereinbefore men -
tinned.

Sec. 4. It is hereby found and determined that the prices
hereby agreed to be paid*for each of said sewers catchbasins
l , _...._. cost of such sewers,
and manholes is less than the estimated
catchbasins and manholes, and the estimates made by the City
Engineer therefore, and now on file with the City Clerk.
Sec. 5. The person, to whom said contract is awarded as.
aforesaid, shall execute a written contract with said City for
the purpose of building such sewers, catchbasins and manholes as
aforesaid, and shall file with the City Clerk a good and suffi-
cient bond in the total sum of said contract, conditioned that he
will build such sewers according to said specifications; that he
will re -fill the ditches made in the streets and alleys under
which such sewers shall be laid and constructed; that he will ful-
fill the guarantee required in said specifications; and that he
will hold and save harmless the city of Salina, from all damage
to persons and property which may arise through the carelessness
or neglect of said contractor or his servants and employees; that
he will protect said City from all liens or claims for labor and ma-
terial used and employed in the building of such sewers.
Sec. 6. The cost and expense of -constructing such sewers
shall be assessed against all lots and pieces of ground contained
in the City of Salina sa a sewer district, as provided by Ordin-
ance No. 613, passed and approved December 23rd, 1887, and the
Mayor and Council are hereby authorized to provide for the pay-
ment of the cost thereof by installments instead of levying the
entire tax or special assessments at one time, and for such in -
stallment.s they may issue sewer improvement bonds of the City of
Salina, payable in installments of equal amounts each year, none
of which bonds nor the installments thereof shall run longer than
ten years or bear interest exceeding five per cent per annum, and
such bonds may be delivered to the contractor building such sewers
in payment thereof or the Mayor and Council may sell said bonds at
not less than their par value and pay said contractor out of the
proceeds thereof, and for the purpose of paying principal and in-
terest on said bonds, as they severally become due, the Mayor and
Council shall each year, during the life of said bonds, levy an
assessment or special tax against all taxable real estate in said
City at the assessed value thereof for general revenue purpose, in
anamount sufficient to pay the principal and interest of said bonds

for that year; and the City Clerk shall certify said assessments
and special taxes as they are severally made and levied as afore-
said, to the County Clerk of Saline County, Kansas, at the same
time and in the same manner as other taxes of said City are certi-
fied..
