2148 Street Excating52 ORDINANCE NO. 2148 (Published in the Salina Daily Union February 1918) An ordinance letting the contract for the excavating of certain streets in the City of Salina, Kansas. WHEREAS, upon June 25th, 1917; July 16th, 1917; September 17th, 1917; December 17th, 1917; December 21st, 1917; and January 21st, 1918, certain ordinances Nos. 2059, 2066, 2093, 2124, 2130, and 2145 were duly passed and approved by the Mayor and Councilmen of the City of Salina, Kansas, whereby contracts for the paving of certain streets as set forth in said ordinances, were let to one M. R. Amerman,. and WHEREAS, by inadvertances and mistake there was omitted from said ordinances the provision letting the contract for the excava- -ion of the streets covered by said ordinances and within the limits defined therein, and WHEREAS, it was the purpose and intention of the Mayor and Councilmen of said City to let the contract for the excavation of such streets within the limits defined in said ordinances to the said M. R. Amerman at and for the price of forty-eight (480 cents per cubic yard for such excavating actually made and done, NOW THEREOFORE, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That a contract be and is hereby awarded to M. R. Amerman for the excavation of Santa Fe Avenue, from the north line of the Right of Way of the Union Pacific Railroad Company to the south line of Otis Avenue; Ninth Street, from the south line of the main line right of Way of the Union Pacific Railroad Company to the north line of Otis Avenue; and Otis Avenue from the east line of Santa Fe Avenue to the east line of Ninth Street, the paving of which is provided for in Ordinance No. 2059; Tenth Street, from the south side of Prescott Avenue to the north side of Crawford Avenue; and Wilson Street from the west line of Santa Fe Avenue to the east line of Highland Avenue, the paving for which is provided for in Ordinance No. 2066; Eleventh Street, from the south line of South Street to the north line of Morrison Avenue; Santa Fe Avenue from the south line of the Union Pacific Railroad Right of Way to the north line of the Union Pacific Railroad Right of Way and North Street from the east line of Ninth Street to the west line of Fourth Street, the paving of which is provided for in Ordinance No. 2093; Washington Avenue, from the west line of Ninth Street to the east line of Tenth Street, for which the paving is provided for in Ordinance No. 2124; 1 1 1 1 1 1 1 1 1 1 Eighth Street; from the south 1 ine of Elm Street to the north line of Ash Street; ' and Mulberry Street, from the east line of Santa Fe Avenue to the west line of Fifth Street, the paving of which is pro- vided for in Ordinance No. 2130; Ash Street, from the west line of Fourth Street to the east line of Third Street; ' and Elm Street, from the west line of Fourth Street to the east line of Third Street; and Phillips Street, from the south line of South Street to the north line of Morrison Avenue; the paving of which is provided for in Ordinance No. 2145. That the contract price therefor shall be forty-eight (48¢) cents per cubic yard for the dirt actually removed from said streets. Such excavating shall be paid for according to the measure- ments thereof by the City Engineer of said City .and the Mayor and Council hereby determine and find that the price hereby agreed to be paid for the improvements aforesaid is less than the estimated price and cost of each and all .of said improvements as made and furnished by the City Engineer, which estimated cost is now on file with the City' Clerk. .Sec. 2. That the contract price therefor shall be forty- eight (48V,) cents per cubic yard for the dirt actually removed from said streets. Such excavating shall be paid for according to the measurements thereof by the City Engineer of said City and the TIayor and Council hereby determine and find that the price hereby agreed to be paid for the improvements aforesaid is less than the estimated trice and cost of each and all of said improvements as made and 'far- nished by the City Engineer, which estimated cost is now on file with the City Clerk. .Section 2.
