ORDINANCE N0. 2146.
(Published in the Salina Daily Union January 1918)
An ordinance providing for the paving, excavating and grading of
Ash Street in the city of Salina, Kansas, from the east line
of Third Street to the west line of Front Street, specifying
the, manner of construction, providing for the cost thereof
and the manner of payment.
WHEREAS, a petition has been presented to the Mayor and Coun-
cil requesting the Mayor and Council to excavate, grade and pave
Ash Street in the City of Salina, Kansas, from the east line of Third
Street to the west line of Front Street, and
WHEREAS, said petition has been examined and found to contain
the names of a majority of resident owners of real property liable
for taxation, Now, Thereofre,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That it is necessary and hereby ordered that Ash
Street in the city of Salina, Kansas, from the east line of Third
Street to the west line of Front Street be excavated, graded and pavd
with such material as the Mayor and Oouncil shall hereafter select and
designate, such paving to be of such width as the Mayor and Council
shall hereafter determine and at the intersection of such streets
with any other street or alley shall extend to the lot line..
Sec. 2. All excavating, rolling and grading for the proper
construction of said paving shall be done and such paving shall be
paid and constructed on the established grade of such street as
heretofore or hereafter established by the ordinances of the City of
Salina.
Sec. 3. The City Engineer's plans and specifications and
estimates of the cost for the making of the improvements herein pro-
vided for filed with the City Clerk on the 21st day of January, 1918,
are hereby adopted and approved by the Council.
See. 4. The Mayor and Council shall hereafter by ordinance
determine the kind of paving to be placed on the above described
streets and shall let a contract for the construcrion of the excavat-
ing, grading and paving to the most satisfactory and responsible bid-
der or person.
Sec. 5. After the passage and publication of this ordinance
the Mayor and Council shall appoint three disinterested householders
of the City, who, after having taken an oath to faithfully and impar-
tially appraise all lots and pieces od ground liable to assessment and
taxation for the cost of said improvements, shall, within ten days
after having been notified of their appointment, proceed to appraise
said lots and pieces of ground liable to taxation for such improvements

without regard to the improvements thereon, and after making said
appraisement, shall return the same to the Mayor and Council and
after such appraisement is returned to the Mayor and Council, the
said Mayor and Council shall designate a time for holding a spe-
cial session for the purpose of hearing complaints and equalizing
said appraisement, of which special session due notice shall be
given in the official City paper, and at said special session the
Mayor and Council shall, if they deem it just and proper, alter
or change such appraisement.
Sec. 6. For the purpose of paying for such excavating, grad-
ing and paving the Mayor and Council are hereby -directed and auth-
orized to issue bonds of the City of Salina in an amount not 'to
exceed the contract price therefor and to run for such a period
of time as the Mayor and Council shall determine, not to exceed,
however, ten years from the date of such bonds, and to be payable
in equal amounts each year during the life of the bonds, together
with interest not to exceed the rate of five per cent per annum.
Such bonds shall be payable at the fiscal agency of the State of
Kansas and for the purpose of paying the principal and interest
thereon as the bonds severally become due and payable the Mayor
and Council shall each year during the life -of the bonds levy
assessments against the lots and pieces of ground liable to taxa-
tion for the improvements herein provided for in an amount suffi-
cient to pay the principal and interest for that year, provided that
for the purpose of defraying the cost of excavating, grading and
paving the squares and areas formed by the crossing of streets and
alleys as well as where the improvement is through or adjacent to
City property for which the City would be liable, the assessment
shall be made against all of the taxable property of the City.
The City Clerk shall certify such assessments as they are sever
ally made to the County Clerk of Saline County, Kansas, at the
same time and in the same manner a s other taxes are certified and
the assessments shall be liable to the same penalties as other taxes;
and provided further, that the Mayor and Council shall by ordin-
ance apportion and assess the special assessments aforesaid against
the lots and pieces of ground in the taxing -districts for saia
improvement, which assessment and apportionments shall hold good
for all the installments that are to be collected from the specif-
ic property chargeable therewith.

Sec. 7. This ordinance shall take effect and be in full
force from and after its publication once in the official City
paper.
