2129 Improve Eighth StreetORDINANCE NO. 2129.

An ordinance providing for the paving, curbing, guttering and ex-
cavating of certain streets in the- city of Salina, Kansas,
specifying the manner of construction and providing for the
cost thereof and the manner of payment.
WHEREAS, Ash Street and Elm Street in said City run parallel
to each other and both Ash Street and Elm Street heretofore have
been curbed, paved and guttered, and,
WHEREAS, Eighth Street in said City intersects both Ash and
Elm'Street therein and said Eighth Street is not now paved, and,
,WHEREAS, Eighth §treet between Ash Street and Elm Street as
aforesaid consists of but two blocks, and,
WHEREAS, Santa Fe Avenue a in said.City and Fifth Street in
said City run parallel with each other and both said Santa Fe Avenue
and Fifth Street has heretofore been graded, paved, curbed and gut-
tered, and,
WHEREAS, Mulberry Street in said City intersects both Santa
Fe Avenue and Fifth street and is not .now paved and graded, and,
WHEREAS, said Mulberry Street
between Santa Fe' Avenue and
Fifth Street in said City consists of but one block, Now Therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That it is necessary and hereby ordered that
Eighth Street from the south line of Elm Street to the north line
of Ash Street in said City shoudl be excavated, paved, curbed and
guttered and Mulberry Street from the east line of Santa Fe Avenue
to the west line of Fifth Street should be paved with such material
as the Mayor and Council shall hereafter select and designate; such
paving to be Made of such width as the Mayor and Council shall here-
after determine and shall extend to the lot line on such streets at
the intersection of such streets with any other street or alley.
See. 2. It is necessary and hereby ordered that Eighth Street
within the limits aforesaid shall be curbed and guttered on both
sides thereof with cement curbing and guttering; the curbing part
to be six inches in thickness and the guttering part thereof to be
forty-two inches.in width from the back edge of such curb to the lot
line of such streets. The Lot line edge of such curb and gutter shgil
be set such distance from the center of said streets as the mayor
and Council shall hereafter determine; Provided, however, that at the
intersection of such streets with any other street or alley, such
curbing and guttering shall return to the lot .lines on such streets.

See. 3. All excavating, rolling and grading for the
proper construction of such paving, curbing and guttering shall
be done and such paving, curbing and guttering shall be laid
and constructed on the established grade of said streets as
heretofore or hereafter established by the ordinances of the'
City of salina.
Sec. 4. The City Engineer shall prepare the necessary
plans and specifications and estimates of cost for the making of
the improvements herein provided for and shall file the same"
with the City Clerk forthwith.
Sec. 5. The Mayor and Council shall hereafter by ordinance
determine the kind of paving, curbing, -and guttering to be placed
on the above described streets, and shall let a contract for the
construction of such paving, curbing and guttering to the most
responsible and satisfactory bidder or person.
Sec. 6. after the passage and publication of this ordin-
ance the Mayor and Council shall appoint three disinterested
householders of the City who, after having taken an oath to faith-
fully and impartially appraise all lots and pieces of ground lia-
ble to assessment and taxation for the cost of said improvements,
shall, within ten days after having been notified of their ap-
pointment, proceed to appraise said lots and pieces of ground lia-
ble to improvements without regard to the improvements thereon,
and after making said appraisement, shall return the same to the
Mayor and Council, and after such appraisement is returned to
the Mayor and Council, the said Mayor and Council shall designate
a time for hodling a special session for the purpose of hearing
complaints and equalizing said appraisements, of which special
session, due notice shall br given in the official City paper,
and at said special session the Mayor and Council shall, if they
deem it just and proper, alter or change such appraisement.
See. 7. For the purpose of paying for such paving, curbing
guttering and excavating, the Mayor and Council are hereby direct-
ed and authorized to issue bonds of the City of Salina, in an
amuont not to exceed the contract price therefor, and to run for
such a periof of time as the Mayor and Council shall determine,
not to exceed however, ten years from the date of such bonds,
and to be payable in equal amounts each year during the life. -of
such bonds together with interest not to exceed the rate of five

per cent per annum, which bonds shall be payableat the fiscal
agency of the State of .Kansas, and for the purpose of paying the
pricnipal and interest on such bonds as.they severally become due,
the Mayor and Council shall each year during the life of such bonds
levy an assessment against the lots and piecee of ground liable for
taxation for the improvements herein provided for, in the amount
sufficient to pay the principal and interest for that year; Provicibd,
that for defraying the cost of paving and excavating the squares
and areas formed by the crossing of streets and alleys as well as
where the improvement is thourgh or adjacent to City property, for
the City would be liable, the assessment shall be made against all
the taxable property of the City, and the City Clerk shall ceritfy
said assessments, as they are severally made, to the County Clerk
of Saline County, Kansas, at the same time and the same manner as
other taxes are certified, and said assessments shall be liable to
the same penalties; Provided, that the Mayor and Council shall by
ordinance apportion and assess the special assessments aforesaid
against the lots and pieces of ground in the taxing district afore-
said which assessment and apportionment shall hold good for all the
installments that are to be collected from the specific property
chargeable with said improvements.
Sec. 8. This ordinance shall take effect and be in full
force from and after its publication once in the official City
paper.
