An ordinance specifying and selecting the material to be used
and letting the contract for the curbing and guttering of
certain streets in the City of Salina.
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That the Mayor and Council hereby determine
that Washington Avenue in the city of Salina, Kansas, between
the west line of Ninth Street'and the east line of Tenth Street
in said City, shall each and all be curbed and guttered with one-
piece cement curbing and guttering; the curb to be six (6) inch-
es in thickness at the top and seven (7) inches at the base and
sixteen (16) inches in depth.. The guttering to be six (6)
inches in thickness next to the curb and eight (8) inches next
to the street. The width of the gutter to be forty-two (42) f
inchesmeasured from the back of the curb to the edge of the
gutter next to the street.
Sec. 2. That a contract be and is hereby let and awarded
to L. H. Lyon for the curbing and guttering of all of the herein-
before mentioned streets, within the limits hereinbefore defined,
and with the materials specified in Section One (1) hereof, at
the price ninety-six (96¢) cents per lineal foot for the curbing
and guttering actually laid on said streets; all of such work to
be done in strict compliance with and in accordance with the plans
and specifications of the City Engineer of the City of Salina,
Kansas, for the construction of such curb and gutter.
Sec.. 3. -Such contract is awarded upon the express condi-
.tion that the work and improvements to be done in strict accord -
ante with Ordinance No. 2122 and that all of such worj shall be
done in a proper and workmanlike manner; and upon the further
condition that the said L. H. Lyon, to whom said contract is award-
ed, shall give to City of Salina, Kansas, a surety bond in a sum
approximating the costs of such improvements, guaranteeing such
curbing and guttering against all defects for the period of two
(2 ) years from the time of the completion and acceptance of such
curbing and guttering by the Mayor and Council of the City of
Salina. Said bond to be approved as to its sufficiency by the
` Mayor of said City, and as to its form by the City Attorney.
Sec. 4. The curbing and guttering of Washington Avenue
within the limits hereinbefore defined shall be so constructed
that the lot line edges thereof shall be 92 feet from and parall el
with
the center of such street.

Sec. 5. All excavating and filling necessary for the proper
construction of such curbing and guttering shall be done in strict
conformity to and in compliance with the plans and specifications
of the City Engineer of the City of Salina, Kansas, for the con-
struction of such work and improvements, which said pland and speci-
fications are hereby made a part of this ordinance and incorporated
herein as fully and completely as though written out at length herein.
Sec. 6. This ordinance shall take effect and be in full force
from and after.its publication once in the official City paper.
