2122 Improve Ninth Street2bPr1I481 b`l •2122 An ordinance providing for the paving, curbing, guttering and excavating of Washington Avenue, from the west side of Ninth Street to the east side of Tenth Street in said City, specifying the manner of construction and providing for the cost thereof and the manner of payment. WHEREAS, two parallel streets in the City of Salina, to - wit: Ninth Street from Walnut Street to Prescott Avenue and Tenth Street, from Walnut Street to Prescott Avenue have been graded, curbed, guttered and paved, and, WHEREAS, Washington Street in said City is an intervening street connecting Ninth Street and Tenth Street between the paved portions thereof, NOW THEREFORE, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Washington Street , from the west line of Ninth Street to the east line of Tenth Street in said City, be excavated, paved, curbed and guttered with such material as the Mayor and Council- men shall hereafter select and designate. Such paving shall. be of such width as the Mayor and Council shall hereafter determine and shall extend to the lot line of such streets at the inter- section of such streets with any other street or alley. Sec. 2• It is.necessary and hereby ordered that Washing- ton Street, from the west line of Ninth Street to the east line of Tenth Street in said City, be curbed and gut-tered on both sides thereof with cement curbing and guttering; the curbing part to be six (6) inches in thekness and the guttering thereof to be forty-two (42) inches in width from the back edge of such curb to the lot line of such streets. The lot line edge of such curb and gutter shall he set such distance from the center of said streets as the Mayor and Council shall hereafter determine, Provided, however, that at the intersection of such streets with any other street or alley such curbing and guttering shall return to the lot lines on such streets. Sec. 3. All excavating, rolling and grading for the prop- er construction of such paving, curbing and guttering shall be done and such paving, curbing and guttering shall be laid and constructed on the established grade of said streets as hereto- fore or hereafter established by the ordinances of the City of Salina. 82 Sec. 4. The City Engineer shall prepare the necessary, plans and specifications and estimates of cost for the making of the improvements herein provided for and shall file the same with the City Clerk forthwith.. Sec. 5, The Mayor and Council shall hereafter by ordinance determine the kind of paving, curbing and guttering to be placed on the above described streets, and shall let a contract for the construction of such paving, curbing and guttering to be placed on the above described strets to the most responsible and satisfactory bidder or person. Sec. 6. After the passage and publication of this ordin- ance the Mayor and Council shall appoint-three.disintorested householders of the City, who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessments and taxation for the cost of said improve- ments, shall, within ten days after having been notified of their appraisement, proceed to appraise said lots and pieces of ground liable to assessments without regard to the improvements thereon, and after the making of said appraisement, shall return the same to the Mayor and Council, and after such appraisement is returned to the Mayor and Council, the said Mayor and Council'shall designate a time for holding a special session for -the purpose 6f hearing complaints and equalizing -said appraisements, of which special session, due notice shall be.given in the official City paper, and at said special session the Mayor and Council shall, if they deem it.just and proper, alter or change such appraisement. Sec. 7. For the purpose of paying for such paving, curb- ing, guttering and excavating, -the Mayor and Council are hereby directed and authorized to issue bonds of the City of `'alina, in au amount not to exceed the contract price therefor, and to run for such a period of time as the Mayor and Council shall determine, not to exceed, however, ten years from the date of such bonds, and to be payable in equal amounts each year during the life of such bonds, together with interest not to exceed the rate of five per cent per annum, -which bonds shall be payable at the fiscal agency of the State of Kansas, and for the purpose of paying the principal and interest on such bonds as they severally become due, the. Mayor and Council shall each year during the life of such bonds, levy assessments against the lots and pieces of ground lia- ble for taxation for the improvements herein provided for, in the 1 1 1 1 1 2bPG11 1 1 1 r. amount sufficient to pay the principal and interest for that year; Provided, however, that for defraying the cost of paving and exca- vating the squares and areas formed by the crossing of streets and alleys as well as where the improvement is through or adjacent to City property, for which the City would be liable, the assessment shall be made against all the taxable property of the City, and- the nd-the City Clerk shall certify said asessments, as they are sever- ally made, to the County Clerk of Saline County, Kansas, at the same time and in the same manner as other taxes are certified, and said assessments shall be liable to the same penalties; pro- vided, that the Mayor and Council shall by ordinance apportion and assess the special assessments aforesaid against the lots and pieces of'ground in the taxing districts aforesaid, which assess- ment and apportionment shall hold good for all the installments that are to be collected from the specific property chargeable with said improvements. Sec. 8. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Passed and approved this 17th day of December, 1917.
