An ordinance providing for the construction of.certain sewers
-in the City of Salina, Kansas; letting the contract there-
for, and providing for the payment of the cost of the
same.
WHEREAS, plans and specifications for certain sewers here-
inafter described have been made and prepared by the City Engineer
and have been approved by the Mayor and Council, and,

WHEREAS, bids for the construction of such sewers have here-
tof ore been advertised by the said City and are now on file with
the City Clerk, Therefore,

Be, it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That the Mayor and Council deem it necessary and
hereby order that the following described sewers be built and con-
st1ructed, and the following described manholes and catchbasins be
bu{ilt and constructed thereon, at and for the following mentioned
prices:
1 2145 feet of 10 -inch sewer on Columbia Avenue, south of
Iron Avenue at and for the price of 662¢W per lineal foot.
8 manholes at and for the price of $35.00 each.
1045 feet of 18 -inch ,sewer in ally between' Kansas Avenue and
De's Moines Avenue, north of -Ash Street, at and for the price
of 60 cent s per 1 inea1 f oot

850 feet of 10 -inch sewer on Elm Street. between Kansas and
Oakdale Avenues, at and for the price of 64¢ per lineal foot.
2 manholes at and for the .price of 033.50 each.

j 700 feet of 10 -inch sewer in the alley in Block 11 Riverside
Park Addition, at and for the price of ' 54� per lineal foot.
2 manholes at and for the price of $30.00 each.

'525 feet of 10 -inch sewer on Johnstown Avenue, at and for th e
price of 90� per lineal foot.
2 manholes at and for the price of $45.00 each.
400'feet of 10 -inch sewer in Block 3, Riverside Park Addition,
at and for the price of 60¢ per lineal foot
1 manhole at and for the price of $31.50 each'.
1060 feet of 10 -inch sewer on Ninth Street and Bond Street,
at ! and for the price of 532V per lineal foot.
4 manholes at and for the price of $28.00 each.
705 feet of 10 -inch sewer on Phillips Street from South Street
to 1Morrison Avenue; at and for the price of 532¢ per lineal foot.
1 manhole at and for the price of $28.00 each.
525 feet of 10 -inch sewer in alley between Republic Avenue
and Beloit Avenue, east of Santa Fe Avenue, at and for the price
of 63¢ per lineal foot
2 manholes at and for the price of $33.00 each.
370 feet of 10 -inch sewer in alley between Beloit Avenue and
Minneapolis Avenue, west of Highland Avenue at and for the price
of 58¢ per lineal foot.
1 manhole at and for the price of $30.00 each.
525 feet of 10 inch sewer in the alley between Jewell Avenue
and Kirwin Avenue, east of Santa Fe Avenue, at and for the price
of ZO - per lineal foot
2 manholes at and for the price of $27.50 each.

388 feet of pipe sewer on Claflin Avenue, east of Fourth
Street, (size 10 inch) at and for the price of 50¢ per lineal
foot.
12 feet of cast iron pipe under railroad track, 10 inch,
at and for the price of $2.25 per lineal foot.
1 manhole at and for the price of $23.50 each.
600 feet of 10 -inch sewer on Eleventh Street from Elm
Street to Bishop Street at 70¢ per lineal foot.
2 manholes at and for the price of $37.00 each.
On several of the sewers, the contractor will find that
house connections have been made on end of sewers, wherever they
are encountered, the contractor will connect the same with the
new sewer which is being laid.
Connecting the -six inch sewer to house with "Y" on new sew-
er where no pipe will be needed.
Price at and for each connection $1.00
Connecting the'six inch sewer to house with 'Y' on new sew-
er where additional six inch, -sewer pipe is needed.
Price at and for each connection $1.75.
Price for new six inch sewer pipe used, uncluding "Y'S"
price per lineal foot 40 cents.
Sec. 2. The plans and specifications of the City Engin-
eer of the City of Salina for the sewers above described, dated
November 5th, 1917, and now on file with the City Clerk are here-
by adopted and approved as and for the plans and specifications
for the above described sewers and are hereby made a part of this
ordinance as fully as if "set out in full herein, and all the
work herein specified and descrived shall be done in accordance
and compliance with such plans and specifications and under the
directions of the City Engineer.
Sec. 3. The contract is hereby let to C. T. Snyder, for
the huilding and construction of the sewers, catchbasins and, -man-
holes heretofore described at and for the prices hereinbefore
set out
Sec. 4.It is hereby found and determined that the prices
hereby'agreed to be paid for each of siad sewers, cacthbasins and
manholes, is less than the estimated cost of such sewers, catch -
basins and manholes, and the estimates made by the City Engineer
therefor, and now on file with the City Clerk.
Sec. 5. ''Phe person to whom said contract is awarded as
aforesaid, shall execute a written contract with said City for
the purpose of building such sewers, catchbasins and manholes as
aforesaid, and shall file with the City Clerk a good and sufficient
bond in the total sum of said contract, conditioned that he will
build such sewers according to said specifications; that he will
refull the ditches made in the streets and alleys under which

such sewers shall be laid and constructed; that he will fulfill
the guarantee required in said specifications; and that he will
hold and save harmless the City of Salina, from all damage to per-
.,
sans and property which may arise through the carelessness or neg-
lect of said contractor or his servants and employees; that he will

protect said City t'rom all liens or claims for labor and material
used and employed in the building of such sewers.

See. 6. The cost and expense of constructing such sewers
shall be assessed against all lots and pieces of ground contained
in the City of Salina as a sewer district, as provided by Ordin-
ance No. 613, passed and approved December 23rd, 1887, and the
Mayor and Council are hereby authorized to provide for the payment
of the cost thereof by installments instead of levying the entire
tax or special assessments at one time, and for such installments

they may issue sewer improvement bonds of the City of Salina,
payable in installments of equal amounts each year, none of which
bonds nor the installments thereof shall run longer than ten years
I
or bear interest exceeding five per cent per annum, and such bonds
may be delivered to the contractor building such.sewers in payment
thereof or the Mayor and Council may sell said bonds at not less
than their par value and pay said contractor out of the proceeds
thereof, and for the purpose of paying principal and interest on
said bonds, as they severally become due, the Mayor and Council
shall each year, during the life of said bonds, levy an assessment

of special tax against all taxable real eztate in said City at the
assessed value thereof for general revenue purposes, in an amount
sufficient to pay the principal and interest of said bonds for
that year; and the City Clerk shall certify said assessments and
special taxes as they are severally made and levied as aforesaid,

to the County Clerk of Saline County, Kansas, at the same time and

in the saem manner as other taxes are certified.

Sec, 7. That said contractor shall properly refill all ex -
I
cavations made in the construction of the above desribed_sewers
according to the plans and specifications of the City Engineer
therefor and shall properly refill said excavations if any sink-
ing or depression appears therein within a period of one year af-
ter the acceptance of said sewers by the aforesaid City.

See. S. This ordinance shall take effect and be in
force from and after its publication once in the Salina Daily
Union.
