An ordinance specifying and selecting -the material to be used and
letting the -contract for curbing and guttering certain
streets in the city of Salina, Kansas.
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That the Mayor and Councilmen hereby determine
that North Street from the east line of Ninth Street to the west
line of Fourth Street in the city of Salina, Kansas, shall be curb-
ed and guttered with one-piece cement curbing and guttering. The
curb to be six (6) inches in thickness at the top and seven (7)
inches in thickness at the base and sixteen (16) inches in depth.
The gutter to be six (6) inches in thickness next to the curb and
eight (8) inches next to the street. The width of the gutter to be
forty twp (42) inches measured from the back of the curb to the edge
of the gutter next to the street.
Sec..2._,That a contract be and is hereby let and awarded to
L. H. Lyon for the curbing and guttering of all of the hereinbefore
mentioned streets, within the limits' hereinbefore defined, and with
the materials specified in Section One (1) hereof, at a price of
ninety-six cents (9 0) per lineal foot for the curbing and gutter-
ing actually laid on said streets; all of such work to be done in
strict a compliance with and in accordance with the plans and speci-
fications of the City Engineer of the City of Salina, Kansas, for
the construction of such curb and gutter.
Sec. 3. Such contract is awarded upon the express condition
that the work and improvements to be done thereunder shall be cb ne
ina proper and workmanlike manner; and in strict accordance with
Ordinance Number 2083; and upon the further condition that the said
L. H. Lyon to whom said contract is awarded, shall Bice to the city
of Salina, Kansas, a surety bond in a sum approximating the costs
of such improvements, guaranteeing said curbing and guttering against
all defects for a period of tw`o years from the date of the comple-
tion and acceptance of such curbing and guttering by the Mayor and
Council of the City of Salina. Said bond to be approved as to its
sufficiency by the Mayor of said City, and as to its form by the
City .Attorney.
Seca 4. The curbing and guttering of North Street within the
limits hereinbefore defined shall be so constructed that the lot line
edges thereof shall be thirteen (13) feet from and parallel with
the center of that part of such street which is to be paved.

Sec. 5. All excavating and filling necessary for the proper
construction -of such curbing and guttering shall be done in strict
conformity to and in compliance with the plans and specifications
of the City Engineer of the City of Salina, Kansas, for the con-
struction of such work and improvements, which said plans and
specifications are hereby made a part. of this ordinance and incor-
porated herein as fully and completely as though written out at
length herein._
Sec-. 6. This ordinance shall take effect and be in full
force from and after its publication once in the Salina Daily
Union.
