An ordinance providing for the paving, curbing, guttering and ex- cavating of certain streets in the City of Salina, Kansas,., specifying the manner of construction and providing for the: costs thereof and the manner of payment.. WHEREAS, By resolution duly passed and approved by the'Mayor and Councilmen of -the City of Salina, .Kansas, upon the 7th day of Juh6$ 19172 it was resolved that Santa Fe Avenue from the south line of the'Union Pacific Railroad Right of way to the north line of -the Union'Pacific Right of Way should be excavated, paved, curbed and-g'-ttered; and'-by.resolution duly passed and.approved by said Mayor -and Councilmen upon July 16, 1917, it was resolved that North Street from the east line of Ninth Street to the west line of Fourth Street I-exe.ept-the intersection of Santa Fe Avenue and North Street should be excavated-, paved, curbed and guttered; amd by resolution duly passed upon July 16, 1917, -it was resolved by said Mayor and Councilmen that Eleventh Street from the south line of South Street to the north line of Morrison Avenue should be excavated and paved and, WHEREAS, within the time allowed by law therefor no protest was entered or filed against any of such work and improvements, - Now Therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Santa Fe -Avenue in the city of Salina, Kansas from the south line of the Union Pacific Right of way to the north line of the union Pacific .Right of way and North Street from the east line of Ninth Street to the WSst line of Fourth Street except the intersection of Santa Fe Avenue and North Street which is already paved, shoudl each and all be excavated, paved, curbed and guttered with such material as the Mayor and Councilmen shall -here after select and designate and that Eleventh Street from the south line of South Street to the north line of Morrison Avenue in said City of Salina, Kansas, should be excavated, and paved with such material as the Mayor and Council shall hereafter select and designate.." Such paving to be of such width as the Mayor and Council shall hereafter determine and shall extend to the lot line of such streets to the intersection of Streets and alleys. Sec. 20 It is necessary and hereby ordered that Santa Fe'Avenue J and North Street iwithin the limits aforesaid shall be curbed and gut- tered on both sides thereof with cement curbing and guttering, the - curb part to be.six (6) inches in thickness and the gutter part thereof to be forty-two (42) inches in width from the back edge of such curb to the lot line on such streets. The Lot line edge of such curb and gutter shall be set such distance from the center of of said streets as the Mayor and Council shall hereafter determine, Provided, However, that at the intersection of the streets and alleys such curbing and guttering shall return to the lot lines on such streets. Sec. 3. All excavating, rolling and grading for the proper construction of said paving, curbing, guttering and excavating shall be done and such paving, curbing and guttering shall ve laid -and constructed.on the established grade of said streets as here- tofore or ,hereafter established by the ordinances of the City of Salina. Sec. 4. The City Engineer shall.prepare the necessary plans and specifications and estimates of cost for the making of the improvements herein provided for, and shall file the same with the City Clerk on or before the 3rd day of September, 1917. Sec. 5. The Mayor and Council shall hereafter by ordinance de termine the kind of paving, :curbing, and guttering to be placed on the above described streets., -and shall let a contract for the construction of such paving, . curbing and guttering to the most responsible and satisfactory bidder or person. Sec..6. After the passage and publication of this ordin- ance the Mayor and Council shall appoint three disinterested householders of the City who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment and taxation for the cost of said improve - merits, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable to taxation for such improvements without regard to the improvements thereon, and after making said appraisement, shall return the same to the Mayor and Council, and after such appraisement is returned to the Mayor and Council, the said Mayor and Council shall designate a time for holding a special a session for the purpose of hearing complaints and equalizing laid appraise- ments, of which special session due notice.shall be given in the official City paper, and at said special session the Mayor and Council shall, if they deem it just and proper alter or change such appraisement. Sec. 7. For the purpose of paying for such paving, curbing and guttering and excavating, the Mayor and Council are hereby directed and authorized to issue bonds of the City of Salina, in anamount not to exceed the contract price therefor, and to run for such a period of time as -the Mayor and Council shall determine, __ not to exceed, however, ten years, from the date of such bonds, and to be payable in equal amounts each year during the life of 1 1 1 1 J 1 1 1 such bonds together with interest not to exceed the rate of five per cent per annum, which bonds shall be payable at the fiscal agency of the State of Kansas, and for the purpose of paying the principal and interest on such bonds as they severally become due, the Mayor and Council shall each year during the life of -such bonds, levy assessments against the lots and pieces of ground liable for taxa- tion for the improvements herein provided for, in an amount suffi- cient to pay the principal and interest for that year; Provided, that for the cost of defraying the cost of paving and excavating the squares and areas fromed by the crossing of streets and alleys as well as where the improvement is through or adjacent to City propertys for which the City would be liable, the assessment shall be made against all of the taxable property of the City, and the City Clerk shall certify said assessments, as they are severally made, to the County Clerk of Saline County, Kansas, at the same time and in the same manner as other taxes are certified, and said assessments shall be liable to the same penalties as other taxes; Provided, that the Mayor and Council shall by ordinance apportion and assess the special assessments aforesaid against the lots and pieces of ground in the taxing districts for'said improvements which assessment and apportionment shall hold good for all the in- stallments that are to be collected from the specific property charge- able with said improvements.
